The 2015 Order, condition 36, required that all relevant ownership and homeowners association documents clearly indicate that passive recreation is the only activity allowed within the No Build Line Area and that removal of vegetation is not allowed. Please confirm that this condition is being met. Shaul Perry’s Attorney’s opinion is that the condition is not relevant yet because HOA has not been established. Condition will take place when transfer happens. 2. Please provide details regarding construction impacts within to no-build area of the buffer zone, and plans for restoration when work is complete. No work will take place in the 35-foot no-build area. All work will take place off of the cantilevered deck, which will be installed first. All materials will be delivered from the garage front to the back of the units. 3. Please confirm that the renovated garage units will not have a first-floor egress. Yes, a ground level egress will not be needed. First-floor egress is proposed to a cantilevered walkway with railing. See attached renderings. 4. What is the ground surface proposed for the rear of the new units, and how will incursion into the Protected Zone be prevented? Owner proposes that this area shall be planted with wildlife restoration mix to improve the wetland buffer. The area adjacent to the 35-foot no-build area along the back of the building will not be mowed and left to naturalize. Existing stone markers are in place. 5. In URB, the Protected Zone is reduced to 35-feet, “where development includes mitigation measures that will improve the existing condition of the wetlands or adjacent upland.” To meet that standard as part of the previous work, selective removal of invasive species, and plantings to discourage residents from entering the Protected Zone was proposed. Please provide detail as to how this standard will continue to be met with the new NOI plans.
