ENERGY--Habitat_Agreement-Woodland_Drive_ CITY OF NORTHAMPTON, MASSACHUSETTS Agreement—Affordable Housing at Woodland Drive, Northampton THIS AGREEMENT, executed this 15h day of February 2022 by and between the City of Northampton, a Massachusetts municipal corporation, acting through its Office of Planning & Sustainability with a mailing address of Wayne Feiden, Director of Planning & Sustainability, 210 Main Street, Northampton, MA 01060, hereinafter called "City" and Pioneer Valley Habitat for Humanity, Inc. a Massachusetts nonprofit corporation with a principal place of business at 140 Pine Street, Florence, Massachusetts 01062 (mail address: PO Box 60642, Florence, MA 01062), hereinafter called "Habitat". This is a no-cost agreement, in accordance with City Council Order #20.140, approved by City Council on November 19, 2020 and approved by the Mayor on November 23, 2020. Whereas, the City is donating 0.7347 acres, more or less, parcel of land located on the easterly side of Woodland Drive in Northampton, Hampshire County, Massachusetts, 140 Woodland Drive, and shown as Lot 1 on a plan of land entitled “Approval Not Required Plan of Land Located in Northampton, Massachusetts (Hampshire County)”, Prepared for The City of Northampton, by The Berkshire Design Group, Inc., dated May 17, 2021 and recorded in Hampshire County Registry of Deeds in Plan Book 250, Page 110. Whereas, Habitat is using the property for an affordable single family home as outlined in a regulatory agreement to be recorded prior to or with the deed from the City to Habitat. Whereas, it is City policy that affordable housing units developed with the City’s Building and Sustainability Standards, attached and incorporated into this agreement. Now therefore, Habitat agrees to follow those attached Building and Sustainability Standards in the development of an affordable housing on Woodland Drive. IN WITNESS WHEREOF the Vendor caused these presents to be signed and approved by Gina- Louse Sciarra its Mayor and the said Owner has caused these presents to be signed and its official seal to be hereto affixed by its officer or agent thereunto duly authorized (by the attached corporate resolution). As part of these efforts, the City has created minimum standards for affordable housing projects which include significant City support. This support comes in the form of CDBG funding, CPA funding, short term rental fee funding, Tax Increment Financing, donation or bargain sale of surplus city land, conservation limited development projects, City obtaining state grants that support affordable housing (e.g., MassWorks and Housing Choice), and new zoning density incentives. These standards will not automatically apply for projects with small City contributions (e.g., housing rehabilitation or soft second affordable housing mortgages). The standards will also be adjusted for unique circumstances, such as rehabilitation of existing buildings where some of the performance standards are not practical. HERS ratings do not represent a linear relationship between energy savings and effort or expense. It is much harder to go from HERS 50 to 45 than from 55 to 50. However the difference in energy savings from 55 to 50 is larger than going from 50 to 45. On top of that, there is a small house penalty that makes it harder to get a lower HERS rating that with a large house, and yet a smaller house still inherently has a smaller carbon footprint than a larger home. DOE’s ZERH program has a more lenient HERS rating requirement, but does end up with a house that, at least in theory, can have energy bills that net out to zero dollars. For a lower income person, this is a big benefit. If the least cost way to achieve this is a ZERH, then we think this should remain an option. One benefit to using the ZERH standard is that we can count on DOE to revise it as technology and other standards change. -See detailed standards on the next page.
