APPLICABLE ZONING APPROVAL CRITERIA /BOARD FINDINGS
350 8.8(R) The Planning Board approved the request for a shared driveway to serve the existing house plus 2
additional lots upon review of the plans and determined:
(1) The lots will not service more than three lots.
(2) The driveway will provide the only vehicular access to the lots being serviced by it, and will be so
stated in the lot deeds.
(3) The driveway will be of suitable construction, grade, length and location, in the opinion of the
Planning Board, for the access and turnaround of cars, trucks, ambulances, fire, and police, which will
be utilizing such driveway. At a minimum, a common driveway shall not exceed grade of 10%, shall
have a width of a least 15 feet, shall have passing turnouts providing a total width of at least 20 feet
along a distance of at least 25 feet, spaced with no more than 300 feet between turnouts, and with the
first such passing turnout being located within 10 feet of the driveway connection to the street, and
shall conform to all other driveway requirements of this chapter.
(4) Is described on easements and easement plans approved with the site plan. Final Plans and
easement documents will be recorded prior to construction.
CONDITIONS
Prior to Commencing work General Conditions
The applicant shall install tree protection as noted by the
applicant’s arborist and shall submit a report by the
arborist indicating these measures have been installed.
This includes protection of the Tulip Poplar and two
trees along the western property boundary in relation to
the new location of the house fronting Riverside Dr.
Prior to selling the first lot, the applicant shall
show proof of recording of easements for the
maintenance of the driveway at the register of
deeds. A plan shall be recorded with the easement
showing the location of the lots and dimensioned
driveway.
Prior to Certificate of Occupancy of the first lot
The applicant shall show compliance with the tree
replacement requirements for the trees over 20” DBH
that have been removed.
