The committee discussed how the farmers market framework has been established. The committee discussed how an agricultural commission might reach/help local farmers. All Other Business… Agricultural Commission meeting on November 7, 2007 John Omasta, Richard Jaeske, John Bobala, John Szafranski, Earle Parsons Meeting opened at 6:00 PM John Omasta discussed having a meeting with all the farmers in Northampton to setup a meeting with a representative of the NRCS to discuss agricultural issues The committee discussed the proposed alternative outflow onto DAR agricultural land adjacent to Hospital Hill Richard motioned that it be known that the Agricultural Commission prefer the alternative approach and that the DAR contacted and any overflow device be directed to the base of the slope. Richard motioned to require an ongoing monitoring system of the agricultural area and wetlands. John Omasta seconded the motion All in favor The committee discussed ongoing road maintenance in the meadows. Richard motioned to support the DPW efforts to continue maintaining the roads on behalf of the agricultural community for safety and continued operation of agricultural machinery John Omasta seconded the motion All in favor The committee discussed several issues in the meadows including: roads and the discontinuance of roads, hunting, jeep use, littering and partying. The Commission discussed the letter and staffing of the Agricultural Commission. The Commission decided to cc: Wayne Feiden and add a budget section to the letter John Omasta discussed budget issues, as discussed with Chris Pile. The Commission was interested in using the budget for mailings, contacting other farmers for training, trainers, administrative work, etc. John Szafranski stated that the Smith Vocational School could probalbly be used for training A draft budget was drafted: Liason-5 hours per month Mailing-$100 per year Professional Development (training)-$100 per year The committee discussed the poor condition of the roads in the Meadows. Bruce stated that he had discussions with Ned Huntley, DPW Director, about the roads and that Ned is working with the Natural Heritage and Endangered Species Program on permitting for road maintenance. The committee discussed the following issues: Introducing Growers without land to land without growers Discontinuing roads in the meadows Issues with the local farmers market The committee discussed the Smith Vocational Land and use of the State Hospital land The committee decided that they should produce a letter to agricultural community and community at-large for a larger discussion on the aforementioned issues. John recommended a passing out a generic questionnaire to the agricultural committee to get a better feel of the current issues. The committee discussed having a public meeting that would include a two hour discussion –half hour for each topic and half hour open session at end of meeting. He will be serving as the Commission’s new staff person. 3.Plan agenda for 2009-2010 Agriculture Commission meetings including place and times The Commission agreed to switch to daytime meetings at Smith Vocational School 4.Update on Farmers Market Subcommittee Ben James reported back on the Farmers Market Subcommittee and all of the work that they were doing. He reported that the subcommittee preliminarily identified their purpose. There was some Commission discussion on whether the subcommittee was discussion too little or too much, but there was consensus it was on the right track. 5. Bean Farm Discussion— The board had a discussion among themselves and with members of the public, including Lilly Lombard and Susan Lanz, on the Bean Farm project. Upon motion by Bob Borowski and second by Ben James, the Commission voted unanimously to recommend that they be consulted before the Bean farm deal is finalized. Upon motion by Richard Jaescke and second by Ben James, the Commission voted unanimously to recommend that all of the farmland at the Bean Farm be protected as open space and that such recommendation be passed on to the City Council, Recreation Commission, and Conservation Commission. Benneth Phelps and Rebecca Fletcher presented on community farm projects elsewhere and how those projects could be a model for Northampton. They suggested that 20 acres was the minimum acreage for a community farm, and some advocates suggest 30 acres. The Commission discussed different funding options for a community farm. Lilly Lombard introduced a possible taskforce of outside volunteers and agricultural experts to help advice the Agriculture Commission on the Bean Farm project and community farms in generally. The Commission agreed that such a task force would be useful and agreed that they would be interested in hearing the recommendations from such a group. After extensive discussion, there was a consensus from the Agriculture Commission that the 24 acres of recreation should be contiguous on the north side of Meadow Street. 3.Discussion of Farmers Market committee process Request that Ben James bring the Agriculture Commission a report and full discussion about farmers markets at the next Agriculture Commission meeting. 4.Request for Proposals for Farmland Available from the City for Trade for APR in the Meadows 5.Other necessary business—The Commission discussed their schedule and agreed to one more Spring meeting in April, and then to end for the planting season unless something critical arises. Staff present: Wayne Feiden 1.Keep Farming: Ben Grosscup did a presentation on the Glynwood Center’s Keep Farming Program. He said that as they expand their effort out of New York’s Hudson Valley, they will provide the Keep Farming consulting package at no cost to Northampton. After discussion and upon motion by Ben James and second by Richard Jaescke, the Commission voted unanimously to endorse bringing the Keep Farming Program to Northampton and to co-sponsor (hopefully with the Planning Board and Conservation Commission) a resolution asking for City Council endorsement. 2.Bean/Allard Farm: Richard Jaescke and Wayne Feiden presented the current status of the Bean/Allard Farm project. The Task Force has identified 36 acres out of which the final 24 acre recreation area will be carved out, and is awaiting survey and appraisal information to work with TPL to make the final decision. The City will close on the first 1.1 acre parcel of floodplain forest in late April or early May in conjunction with the Beans selling the farmhouse parcel. The project is progressing, but with appraisal still out there are still no guarantees that the project will ultimately be successful. 3.Farm Land Bids: Wayne Feiden asked for input on the upcoming request for farm bids and outreach to find farmers for three Conservation Commission parcels, Elwell Conservation Area, Mineral Hills Conservation Area (LaPalme section) and Meadows Conservation Area (Bleiman section). The Commission supported keeping the land organic. 4.Farmers Market Subcommittee: Ben James briefed the Commission on the subcommittee’s work, especially the survey about to be released and collaboration between different markets and the Board of Health. 5.Local Agriculture Preservation Restriction Program: Wayne Feiden briefed the Agriculture Commission on Conservation Commission interest in expanding a local APR program to protect farmland with APRs even when the state will not fund the program. The City has a couple of locally funded APRs, one of which the City granted at Mineral Hills Conservation Area (LaPalme) and one of which the City holds on Park Hill Road. The Agriculture Commission previously discussed and supported the Conservation Commission’s local APR effort at the Rogers Farm. Upon motion by Richard Jaescke and second by Ben James the Commission voted unanimously to support extending the locally-funded APR program. 6.Conte Fish and Wildlife Refuge: The Commission discussed the potential expansion of the Conte Fish and Wildlife Refuge. They indicated no objection to floodplain forest and very marginal farmland being included but expressed strong concerns about any quality agricultural land from being included. 7.Open Space and Recreation Plan: Feiden updated the Commission on the seven-year open space and recreation plan that has to be adopted by the end of the year. There was hope that the Keep Farming process could help inform this process, depending on how quickly that planning goes, and agreement the Agriculture Commission would offer their advice in the fall when the planning process goes forward full stream. 8.Summer Schedule: The Commission agreed to have one mid-summer (evening) meeting because of the number of items that are likely to come up that cannot wait until the end of the growing season. 9.Minutes of February 2, 2010 and March 2, 2010. Commission members agreed to consider the plan, review the full plan on the city’s website, and make their recommendations at their December meeting. 2.Review key points for proposed changes to zoning related to chickens Dani Kahn presented a summary of a proposed ordinance to expand allowable chickens and fowl. The commission was supportive of the concept while being cautious about impacts from fowl, both at higher concentrations and if ducks, guinea fowl, or turkeys are allowed or if capons are allowed after they start finding their voice. There was some discussion about the challenges of enforcing some sections. 3.Review issues needed to resolve any partial closing of Dike Road Feiden reviewed the idea of closing Dike Road or gating the Pleasant Street end to reduce abuse problems to land and crops. Commission members understood the desire to stop abuse but expressed concern about closing the road if it is the only way to bring in large farm machinery, suggesting that the gating option might work better. The next step will be contact farmers using land in the area to see if closing the road would impact their operation. 4.Review current status of Keep Farming Northampton Richard Jaeske reported on the status of the Keep Farming program. The data collection aspect of the project is moving forward. 5.Review next steps for a local agriculture preservation restriction program Feiden reported that funding for the agriculture commission co-sponsored local APR program is moving forward and we hope to get City Council approval in December. The commission will discuss the program in more detail in December. 6.Update on Bean/Allard Farm preservation project Feiden and Jaeske reported that the Bean Allard farm project is nearing completion and 120 of farmland should be permanently preserved in early December, along with 24 acres of recreation land and 35 acres of conservation land on the river. Members were comfortable endorsing the agriculture elements of the plan but wanted to emphasize needs to ensure that open space activity did not create conflicts with farmland- specifically suggesting no multi-use trails in the meadows, caution at any trails on farmland parcels except at conservation areas, and preventing off-leash dog walking at meadows farmland. The Commission agreed by unanimous consent to write a comments letter endorsing the agricultural aspects of the plan with the three comments above. 2.Kickoff of local agriculture preservation restriction program The commission began brainstorming on what is the best way to implement a local APR program. As part of the discussion, the reviewed the consideration of a state APR for a parcel adjacent to Manhan Road and Potash Road. 3.Keep Farming Program The commission met with the Keep Farming agricultural economics group (Nola Reinhardt and Deb Jacobs). They reviewed maps of farmland in Northampton, discussed what should be included in an agricultural forum, and discussed what should be on a keep farming survey. The commission discussed how the keep farming program can help inform the agriculture commission process. The commission helped brainstorm about who should be invited to the keep farming agriculture formum. 4.Solar PV by-right The commission reviewed the energy and sustainability commission’s discussions to create zoning for photovoltaic by-right and whether these activities should be allowed on farmland (special conservancy zoning) The commission adjourned at 9:50 PM. There was a reluctance to take any action that could take any farmland out of production, but a sensitivity to the fact that such efforts could provide much needed income for farmers. This is information that the Agriculture — Commission wanted anyway, and Keep Farming provides a framework for volunteers to gather that information. Snapshot of farming in Northampton (what we know so far) – Nola Reinhardt The committee has used city property records to put together a map that shows agricultural properties in Northampton (LUC 61, 61A, 393; and SVAHS and city leased land). Farmers were asked to help fill in the blanks on the map with any additional land being used for agriculture. They suggest that farmland is quite fragmented, although this can vary considerably by farm. We have only a rough idea of what crops are being grown. The city assessor can record only one use of a farm; even if a farmer has several crops, only the main one is listed. We have no records of land use for LUC393 properties. This is why the committee needs more precise information from the farmers. 4. Next step: The committee has put together a farmer survey which was distributed to those present. The surveys will not identify individual farms and the information collected will be used to put together more accurate aggregate data. The farmers were asked to return the completed surveys to the Agriculture Commission at City Hall, or to any of the Agriculture Commissioners. Their assistance was also requested in informing other Northampton farmers of the purpose and importance of this survey process. 5. About Glynwood and Keep Farming ; Virginia Kasinki presented a brief review of the history and purpose of Glynwood’s Keep Farming program. She introduced Nick Stanton from Great Barrington; where they are beginning a Keep Farming program. She also introduced Andrea Burns, who will be Glynwood’s new rep in Western Mass. Burns is an Easthampton City Counselor, and recently helped form an Agriculture Commission in Easthampton. About 150 towns in MA now have Ag Commissions. 2 Keep Farming Northampton 6. Discussion Farmers raised concerns about the difficulties of farming in Northampton. One problem is the loss of farmland to development. Szawlowski pointed out that the industrial park used to be farmland, but the city took the land by eminent domain in 1970s.Jaescke pointed out that the result might have been different if there had been an Agriculture Commission to represent farmer interests at that time. Many of the farmers pointed to problems with vandalism, theft, and destruction of crops by the public, especially in the Meadows. It’s harder to work farms when people want to come in to hike or ride ATVs –or City wants to put in a bike path or expand hiking trails or expand county fair property. People come to river to fish and drive across fields. Dogs run around and rip up fields. Trash is being dumped; roofers dump trash. People have been shot in the Meadows. Farmers feel that the city hasn’t responded adequately to their concerns about these problems. On the other hand, Franks pointed out, and others agreed, that when the Bean/Allard farm was up for sale it brought out a lot of support for small farms in Northampton; there is interest in and concern for farms. The Commission and the Committee hope that the Keep Farming process will generate more understanding of the farmers’ problems and their needs, as well as their importance to the city. Some farmers expressed interest in attending the Agriculture Commission meetings, and the Commissioners explained that they meet the first Monday of each month during the winter or if there’s a pressing issue. There is a vacancy on the Commission and farmers were encouraged to consider joining. The meeting adjourned at 8:30 pm. Nola reported that some of the larger property owners did not respond, but still a good response rate. 3.Grow Food Northampton Organic Policy: Annie Sullivan-Chin of Grow Food Northampton presented GFN’s April 2011 working definition of what their organic policy is. (A copy of this policy is located on the City’s Laserfiche Public File Cabinet.). She and Wayne Feiden gave background on the GFN lease with the City. The Commission supported the idea of a community gardens and an organic community gardens. Some members did not want to support additional CPA money for gardens that only allowed with 100% of the plots being organic and others were comfortable with this approach. Upon motion by Ben James and second by Chip Parsons, the Commission voted unanimously to endorse the use of CPA funds for the development of community gardens in Florence, although the Agriculture Commission prefers that a portion of the community gardens be allowed for conventional community gardens. 4.Continued discussion of Dike, Potash, and Manhan Roads: Discussion of whether Dike Road can be closed without harming farmers. Rich Jaeske said that he agreed the there is a huge problem with trash being dumped supports the closing of Dike Road. Dike Road is probably not a viable road anyway for large machinery. He said that Olive Street provides a reasonable alternative access as a basic access, but is concerns about large equipment in the future. Wayne Feiden presented a proposal to make an offer to accept a donation of the parcel of land Charles Jasinski owns adjacent to Sheldon Field Recreation Area, with consideration being Mr. Jasinski keeping a 15 year lease (after the expiration of his current lease in five years) to farm both the donated parcel and the other farmland at Sheldon Field. The Commission expressed concern about losing such valuable farmland (great soils, no stones, not subject to frequent flooding), but they also expressed an understanding of the need to think about recreation needs 20 years out. They expressed hope that any such acquisition would include provision that some land at the new Sheldon Field be reserved for future agricultural uses, although they indicated that they understood that there are unknowns in planning for recreation uses more than 20 years out. Chair John Omast opened the meeting at 7:05 PM. 1.Discussion of future joint forum with other area Agriculture Commissions. The Commission discussed holding a joint forum with agriculture commissions in Hampshire and Hampton Counties. The forum would probably include agriculture commissions, farmers, and local agricultural product vendors. The meeting would be held as Smith Vocational. The commission agreed to discuss the issue at their April meeting and in October, when they hear back from other agriculture commissions, start planning a February or March forum. The commission also agreed that this forum or some other session to reach out to Future Farmers of America (FFA) and possibly 4H to attract the next generation of farmers. 2.Updates from Keep Farming The Commission had a brief update that the surveys from residents and food providers are currently circulating. They will have more discussion when those have been completed. 3.Links between local farming and schools: Ben Wood, Director Northampton Health Ben Wood introduced himself to the commission and explained that the Health Department’s mission includes improving the quality of food that residents by examining policies and regulations. They are focusing on “making the healthy choice the easy choice” in the retail food environment and in public schools. Updates on Meadows and farmland land acquisition and farmland preservation efforts 4.. Wayne Feiden informed the Commission that Mr. Jasinski accepted the City’s offer to purchase a local agriculture preservation restriction on his 80 acres of Meadows property, for Mr. Jasinski to purchase the old Rogers homestead farm from the City, and for Mr. Jasinski to donate, subject to a 22 year retained lease, 3.2 acres he owns at Sheldon Field. The Commission indicated that they would be interested in exploring more local APRs after we see how smoothly the Jaskinski project goes. They will th meet and discuss the project in more detail on October 24 with Pete Westover, who is representing Massachusetts Department of Agriculture Resources and the Massachusetts Association of Conservation Commissions. The Commission members agreed to come with a list of desired vendors at their next meeting. They asked Wayne Feiden to follow up with DPW and request a status update. 4.Grow Food Northampton (GFN) access road The Commission asked for a status report on GFN’s access to their “main” field. Wayne Feiden responded that they have access through the Crimson and Clover Farm, and through strips of land that they own on the east and the west side of the Florence Recreation Fields. Using either strip will require that they make improvements to the land (cut brush and level the sites), which they have the right to do. The city has also granted them permission to cross the parking lot on the east side of the fields for farm machinery (but not for customers if they set up a CSA because of the high traffic that would entail). 5.Membership Ben James has announced his resignation from the Agriculture Commission. The Commission discussed outreach to a possible new member. 6.Approval of Agriculture Commission Minutes of April 23, 2012 Upon motion by Chip Parsons and second by Rich Jaescke, the Commission voted unanimously to approve the minutes 7.Mineral Hills Conservation Area agricultural parcel. The Chair and Pete Westover split the outreach to other agencies (NRCS, extension). 4.Minutes of October 3, 2012 Upon motion by John Omasta and second by John Bobala, the Commission voted to adopt the minutes, with two abstentions from members who missed the last meeting (2-0-2 vote). 5.Follow up on DPW maintenance of roads in the meadows DPW reported (by email) that due to issues of private way, they could only do limited grading in the meadows. They reported that “ideally DPW would like to do these roads twice a year… If we were only able to do it once, is there a preference? The Commission agreed that if grading could only be done once a year, the Spring season before crops are planted is most important, although twice is obviously better. Jerry Budgar, of the Ward 3 Association, reported that he thinks that all or almost all of the roads in the meadows are public roads or private roads that the public has the right to use and should be treated that way, with the public not being kicked off the land, as he reported was done this summer in an incident where the police were called. Commission members suggested that more research is needed and that they believe that more roads should be graded by the DPW. Staff offered to send thank you notes to vendors and presenters if Rich Jaescke can send a list of who was there and their contact. The Commission discussed doing a forum again next year and wants to pursue:  Outreach to Pete Westover, consultant to MAAC and MDAR and to Dick Ward, president of the MAAC, to get his thoughts and see if next year this can be part of a MAAC regional meeting.  Outreach to Phil Korman, CISA to get his thoughts and help.  Outreach to the Amherst Agricultural Commission to get their thoughts and possibly co- sponsorship. 3.Vandalism issues The Commission discussed with Ben Perrault, Mountain View Farms, and Mary Shanley-Koeber and Steven Walker, MassAudubon, the vandalism that Mr. Perrault has had to his crops from vehicles driving through his fields and options to reduce that kind of damage. After a discussion, the Commission asked if we could invite Sgt Victor Caputo of the Northampton Police Department to one of their next two meetings to explore opportunities to address this problem. 4.Meadows roads maintenance, parking by water standpipe, and related issues Wayne Feiden reported that DPW will draft a no parking by the standpipe ordinance and take it to the Transportation and Parking Commission, which is the next step in the process. 5.Other issues not anticipated when agenda written Keep Farming reports that they completed restaurant interviews and expect that section of the plan to be ready shortly. The Commission reviewed staff request for a recommendation on the renewal of a farm license at Mineral Hills Conservation Area, currently with Henry Parsons. The Commission recommended:  Maintaining licenses with existing farmers when possible to allow long term planning and operations continuity for the farmers.  Specifically, recommended approval with Henry Parsons who is farming responsively and sustainably and may not have the problems that some farmers have presented to the city not honoring their license terms.  Require as a condition of the license that the fields be brush-hogged to the limits of the historical fields so we don’t have them shrink each year.  Require as a condition of the license that if the farmer leaves the land they leave a cover crop behind. 6.Set March meeting The Commission set their next meeting for 7:00 PM on Wednesday March 6, 2013. Pete Westover suggested a roundtable discussion for local farmers and agriculture commissions. The Commission focused on having the meeting in Northampton at Smith Vocational School. Rich Jaeske reported that he spoke to Dick Ward at the MAAC annual conference and wanted to keep some of the vendors but shorter formal presentations. There was a consensus  9:00 to 3:00 time schedule, including coffee and Danish and a full lunch  Primary goals: Engage agriculture commissions and the local farming community.  Limit agencies to ten very brief presentations.  Include a theme presentation or two to kick off round table discussions  Break into round table discussions  Pete Westover will be the liaison with MDAR and MAAC. th The Commission tentatively set 9:00 to 3:00 on Saturday January 11, with a snow date of th Saturday January 18, if space is available at Smith Vocational School. 3.Discussion of approaches to address vandalism issues Ben Perrault, Mountain View Farm, summarized the vandalism (vehicles driving through the fields) that he experienced. (Also discussed at the Commission’s February meeting). Sergeant Victor Caputo, Northampton Police Department attended and participated in the discussions. He discussed the work he and others have done on addressing vandalism:  Increased police patrol requests for problem areas  Police outreach to high clearance vehicles to warn them that they can’t trespass.  Create an association for the meadows (Old Springfield Road/Pynchon Meadows/Manhan Meadows) not covered by the existing Northampton Agricultural Association (Hockanum Meadows) and agree not to allow vehicles on their property.  Post property against trespassing  Police non-criminal disposition (fines) for vehicles driving on private land.  Follow up on debris dumped on the side of the road and in fields.  Sergeant Caputo is happy to share contact information with farmers and property owners.  If property owners install their own surveillance cameras the Police are happy to review relevant footage.  Potentially install markers to help identify areas for easy identification (as was done for the Hockanum Meadows). A.Coordination with the Northampton Conservation Commission, Kevin Lake, Chair: The Commission briefly discussed areas of joint interest were there has been successful coordination: agriculture preservation restrictions (which require votes of both commissions to approve if funded using the city’s current CPA allocation), open space preservation (informal coordination when farmland involved, such as the city effort to preserve farmland from the state on Venturers Field Road), and licensing conservation land for farming, where the Agriculture Commission has been consulted as recently as the last meeting. Most of the discussion was about maintenance of roads in the Meadows and what projects were easy to permit or even exempt from wetlands rules and what projectgs where harder. The discussion was productive, but more research is required, which the Conservation Commission will briefly start at their next meeting. 3.Update on status of projects: A.Dike Road closure at Pleasant Street—Completed a year ago and now permanent. B.No parking under and adjacent to water standpipes—Ordinance introduced and working its way through the City Council committee process. C.Final date(s) for 2014 Agriculture Forum—January 11, 2014 with a snow date of January 18, 2014. D.Keep Farming—Fran Volkman and Adele Franks presented the Keep Farming restaurant survey. The Commissioners expressed their appreciation for the work. Keep Farming will finalize the write up and the city will post it on its website. Keep Farming next step is the fourth and final survey, institutional users. (Past surveys were community members, farmers, restaurants.) They proposed having a Smith College capstone class taught by Paul Wetzel coordinate the final survey and putting together the next stage of the project. The Commissioners agreed with that approach. 4.Set next meeting: The Commission’s next meeting will be at 7:00 PM on Wednesday September 25, 2013. The Commission agreed to hold an extra meeting during the summer if necessary. 5.Other issues not anticipated when agenda written/public comment Laura, an abutter to the farmland at Mineral Hills Conservation Area on West Farms Road, said that she would prefer if the city didn’t allow Roundup at the Conservation Area. The Commission briefly discussed the benefits that Roundup allows no-till agriculture and reduces soil erosion. Russell Brain from the Easthampton Agriculture Commission said that he was observing because Easthampton’s new Agriculture Commission is studying what works and doesn’t in other communities. Commissioners invited the Easthampton commission to participate, if not cosponsor, of the 2014 agriculture forum. At 7:00 PM, A representative of the North Street Neighborhood Association announced that they would be videotaping the meeting. John Omasta opened the meeting at 7:01PM 1.Public Comment  Rick Clark suggested that there is a need for better clarity on public access rights in the meadow. He said that there is legal public access to Rainbow Beach and along all Meadows roads, with the possible exception of Young Rainbow Road. He recommended that the Agriculture Commission be the body issuing licenses for farm use on conservation commission farmland.  Lilly Lombard, Grow Food Northampton, said that all the farmland at GFN’s site is now leased. She also recommended that the Conservation Commission hold RFPs for any new or renewed farm licenses and that bids should be awarded based on the highest conservation values offered.  Laura Friedhan Keyes suggested that the next license for Mineral Hills farmland should not allow the use of Roundup.  Mac Everett said he supports public access to the Meadows and believes that the public has the right to reach Rainbow Beach.  Jerry Budgar offered support for the Agriculture Commission mediating public access issues but that the given should be that all roads in the Meadows are public. He stated he is working on a public access coalition.  Marvin Ward stated that the Meadows Roads were designed to create public access for all citizens. 2.Discussion of opportunities for public access to Rainbow Beach and plan process for public discussion/mediation of status of Meadows Roads Commission members discussed possible approaches:  Outside mediator (e.g., Massachusetts Office of Dispute Resolution).  Identifying as much data as is available first What roads are city owned o What roads are city maintained o What roads are not city owned but for which there is public access rights o What roads is the status not clear (what do we know and not know) o What is the status and ownership of land between the road and Rainbow Beach o  Is mediation possible, or is this a legal adversarial process  Is mediation an outside mediator or the Ag. Commission working with landowners to see if some new public access is possible without compromising their operations.  Is a private effort for informal conversation with a few volunteers the first step. Laurie Sanders suggested creating a strategy for public access to Rainbow Beach but caution to avoid the problems of 20 years ago that lead to gating the lower Meadows, cars driving on Rainbow Beach and through farmers’ fields. Other comments expressed skepticism about data from DPW since they don’t want to maintain roads, about whether the Agriculture Commission could be neutral, and about the virtue of any discussions taking place outside of a public meeting. Fred Zimmock suggested that limited access to Rainbow Beach was good but agreed that access needed to be limited to avoid abuse. Rich Jaeske and Chip Parsons summarized that there was at least common ground that no one was asking for vehicle access to Rainbow Beach or through farmers’ fields, a first step. They discussed the enormous problems farmers have with the public using farmers’ fields for recreation. The Commission asked that Planning compile what information is available and report back. 3.Update on water standpipe no-parking zones The no-parking zones have been approved. DPW reported that signs have either been installed or are coming shortly. 4.Plan January 2014 agricultural forum Pete Westover, MACC and Phil Korman, CISA, worked with the Commission to plan the full th day January 11 agricultural forum. CISA will handle registration and MACC will provide the preliminary agenda to get agriculture commissions talking to each other and not simply present information. Northampton Agriculture Commission’s goal of including opportunities for vendors can be included in the forum. Pete and Phil will report back with a draft agenda at the next Agriculture Commission meeting. 5. Set October meeting date and time The Commission agreed to meet at 7:00 PM on October 23, 2013. 6.Update and discussion licensing conservation areas for agriculture and related policies The Commission reviewed the status of licensing of conservation commission agricultural lands. The Commission agreed, by consensus, that:  Renewing licensees for farmers who serve as good stewards instead of doing a formal RFP process is preferred because 1) it rewards good stewardship, 2) if provides incentives for farmers to manage property for long term stewardship and conservation, 3) it reduces the risks of failed licenses, that have happened at least twice recently when new farmers with new models of farming failed to thrive.  Allowing farming in accordance with the City’s Right-to-Farm ordinance which notifies the public that farming is going on here and puts on-going farming following a tradition going back 360 years is above nuisance complaints from more recent development.  Acknowledged that while organic treatment uses less chemicals and is desired by many consumers, 1) it may create more soil erosion since no-till agriculture is harder which reduces the conservation value of the site and 2) is easier for some crops (e.g., produce, hay) than for other crops (e.g., corn and soybeans) and therefore the decision may be site specific. 7.Pending or new Agriculture Preservation Restrictions (APR) and recommendations --Parcel D, Northampton State Hospital—Feiden updated the Commission that the City closed on its acquisition of this new APR. --Russell, Northampton Meadows—Upon motion by Chip Parsons and second by Rich Jaeske, the Commission voted unanimously to support this APR and to use CPA APR funds for the city share. --Venturers Field Road, Northampton Meadows – Upon motion by Rich Jaeske and second by Chip Parsons, the Commission voted unanimously to support legislation that would put the former “jail work farm” back into agriculture production, with the city either holding the land in fee or holding an APR. 8.Executive Session—land acquisition—The Commission discussed going into executive session to discuss negotiation for the purchase of interests in land on issues that would be sensitive to public disclosure. The Commission reported that they would adjourn immediately after the meeting and no other item would be discussed. B.Updates on road maintenance—the commission will write a letter to 1) DPW thanking them for the work that they have done with the increased maintenance of Meadows roads this year, and request that those efforts continue and 2) the Police Department asking them to monitor roads in the meadows, especially Riverbank Road, to ensure that that there is a 12’ wide open travel lane even when cars are parked. C.Right to farm ordinance and pesticides/herbicides- the commission briefly discussed that Grow Food Northampton has asked for time on the Conservation Commission agenda to oppose the use of pesticides and herbicides on farmland the commission leases. The commissioners opposed any blanket policy that would prohibit herbicides on all conservation land, preferring a case by case analysis of how the farmland can remain in active agriculture. D.City stormwater ordinance and farmland- the Commission supported sending comments to DPW and City Council ensuring that large agricultural landowners only pay one stormwater fee (maximum $100) even if they own multiple parcels, that protected farmland and open space not pay any fee, and that the stormwater ordinance acknowledge the ecosystem services provided by farmland and open space in holding stormwater and so credit farmers and landowners for these services.
