All wetlands in this area that may be protectable under the Massachusetts Wetlands Protection Act (M.G.L. chapter 131, section 40) and Regulations (310 CMR 10.00), as well as the Northampton Wetlands Protection Ordinance, have been marked in the field with consecutively numbered pink “wetland delineation” flagging tape or stake-flags. While these boundaries have been accurately identified, only the Northampton Conservation Commission, or the Massachusetts Department of Environmental Protection (DEP) on appeal under State law, can make the final determination of the extent of the wetland resource areas on the site. Delineation Methodology The methodology employed in my delineation utilized both vegetation and hydrology as outlined in the Regulations at 310 CMR 10.55 and in the DEP handbook Delineating Bordering Vegetated Wetlands under the Massachusetts Wetlands Protection Act (1995). Hydrophytic Vegetation was based upon the US Fish and Wildlife Service’s National List of Plant Species that Occur in Wetlands (1988), as well as all plant species listed in the Act. Wetland hydrology includes a high water table, water-stained leaves, and hydric soils. Hydric soils were determined based upon the interagency document Field Indicators for Identifying Hydric Soils in New England, Version 4 (2016). Site Description The area subject to my investigation is located at 176 Turkey Hill Road, and contains an existing single family home, out building, lawn, and driveway. To the west of the developed site, a braided intermittent stream (dry at the time of my site visits) flows down the rocky hillside, splits into two channels, and then combines again at the edge of the existing lawn before leaving the site to the southeast. Flags A-1 to A-70 and B-1 to B-60 mark the braided stream channels; D-1 to D-30 encircle an upland “island” between the streams. Flags C-1 to C-11 mark a wetland to the south of where the intermittent stream exits the vicinity of the lawn. This area is fed by groundwater discharge from the base of the hillside. There are other wetlands on the site that are not shown on the accompanying survey because 2 they are located outside of the project area. A perennial stream is located on the opposite side of Turkey Hill Road. Flags 2HW-1 to 2HW 10 and HW-1 to HW-36 mark the Mean Annual High Water Line (MAHWL) of this brook. The MAHWL was coincident with the top of the “bank” in this area. There is also a wetland fringe along the brook; flags F-1 to F-5, 2F-1 to 2F-16, and G-1 to G-10 mark this wetland. Wetland Resource Areas Under the state Regulations (310 CMR 10.00), wetlands are broken up into different resource areas, each of which is regulated in a slightly different manner. The delineated wetlands contain the following resource areas, to which there is a 100 foot buffer zone. * Bank (10.54) * Bordering Vegetated Wetland (10.55) * Land Under a Waterway (10.56) According to the most recent USGS Quadrangle, the stream on the opposite side of Turkey Hill Road is shown as a dark blue, perennial waterway. Therefore, the following resource area extends for 200 feet from the delineated Mean Annual High Water Line of the stream: * Riverfront Area (10.58) Project Planning It is my understanding that the current proposed project is to remove the existing single family home and to replace it with a new home, along with the repair and upgrade of the existing driveway. Given that the lower portion of the driveway is within the Riverfront Area, a Notice of Intent (WPA form 3) will need to be filed with the Northampton Conservation Commission. Northampton also has various setbacks from the wetland boundary that are required for buffer zone projects under the Northampton Wetlands Protection Ordinance. The site does not fall within the Estimated Habitats of Rare Wildlife or Priority Habitats of Rare Species according to the most recent online mapping. Therefore, unless new information becomes available, you should not have to make any filing with the Natural Heritage and Endangered Species Program.
