First Churches Boundary Line Agreement Resolution

Upon the recommendation of Mayor Mary Clare Higgins and Councillor Rita Bleiman
WHEREAS, The First Churches property was established in an era before strict separation of church and state; and
WHEREAS, As a result, the property boundary between the First Churches and the City is not clear and may be subject to claims and counter-claims; and
WHEREAS, The First Churches and the City would like to sign a boundary line agreement and easement to resolve this uncertainty and define their respective ownerships; and
WHEREAS, The agreed upon boundary would be the best estimate of the actual boundary based on surveys, historical road layouts, historical photographs, existing monumentation, and current
occupation; and
WHEREAS, The agreed upon boundary line agreement and related easements would give the City clear title to the property on which a portion of the City’s Art Kiosk sits and would ensure
that the First Churches maintains the portion of the park-like setting they have maintained on City land for many decades;
NOW, THEREFORE BE IT ORDERED
The City Council hereby authorizes the City of Northampton, acting through its Mayor, to accept and acknowledge said boundary line agreement(s) and easement(s).
