[1] Aerial photos and the submitted information do not appear to justify the assertion about the degraded area on
the property. One must have had the degraded area there in 1996 and it must be there now.
[2] Here is the definition of degraded "A previously developed riverfront area contains areas degraded prior to
August 7, 1996 by impervious surfaces from existing structures or pavement, absence of topsoil, junkyards, or
abandoned dumping grounds." Please note that "contains" means present tense. Degraded area also is based on
specific square footage, not usually an entire area of a site if it is a junkyard or dumping grounds.
[3] Based on the information included in the NOI, it does not appear that sufficient information has been included to
show that the performance standards are met. Historical photos dating back to 1962 do not appear to show a
contactors yard where the degraded area is alleged to be located and no current photographs were included in the
NOI to justify the degraded area.
[4] 310 CMR 10.58(5)(a) in part states " When a lot is previously developed but no portion of the riverfront area is
degraded, the requirements of 310 CMR 10.58(4) shall be met.

[5] If the commission determines that 310 CMR 10.58(4) applies, then an alternatives analysis is required and no
work will likely be allowed in the inner 100. See 310 CMR 10.58(4)(d)1.a.
