16B_042A 273 North Main ZoningDECISION OF ZONING BOARD OF APPEALS At a meeting held on May 29, 1986, the Zoning Board of Appeals of the City of Northampton voted unanimously to deny the Variance requests of Francis E. Mandeville, 273 North Main Street, Florence, Massachusetts, for the purpose of renovating and converting an existing barn /garage into a residential dwelling at property located at 273 North Main Street, Florence (URB Zone). Present and voting were: Chairman Robert C. Buscher, William Brandt and Sanford Weil, Jr. The findings were as follows: W. Brandt, citing Section 6.8 (Paragraph 2) of the Northampton Zoning Ordinance and the definition of "principal structure ", determined that as there is already one principal structure on the lot, a Variance is required. He found that although the lot contains a large barn/ garage, he could find nothing unique regarding the land or house; that although it is unfortunate the structure cannot be converted to a residence, it does not constitute a hardship; that relief could be granted without detriment to the public good, as the lot closest to the structure is owned by the City and is unlikely to be developed; and that it is the intent of the Ordinance to retain proper setbacks and allow only one principal structure on a lot, therefore, the requested use would violate the intent of the Ordinance. S. Weil concurred with Mr. Brandt regarding derogation from the intent of the Ordinance, also citing Section 6.7 and Section 6.3. R. Buscher concurred and also found that, although the applicant's approach to hardship stressed that the presently useless building could be converted for family use, the applicant purchased the lot as a single - family residence with a barn,and a second income is not necessary for the applicant to continue to occupy the residence as a single - family home.
