Maintain pre-existing non-conforming buffer at the rear in order to demolish building to create parking lot.
HARDSHIP:
CONDITION OF APPROVAL:
1)The vertical clearance of the Private Parking sign shall be7' to meet MUTCD standards.
2). Prior to start of construction:
A. Tree protection measures shall be installed and inspected by the City.
B. The stormwater operations, inspection and maintenance plan shall be recorded in the Registry
of Deeds with the Planning Board decision. Prior to recording, final language shall be approved by the
City.
3) The 10' fence behind the garage on the easterly abutters property line shall be extended to the rear
lot line.
4) The 10' fence shall be extended toward the front up to a 10' front setback point.
FINDINGS:
The Zoning Board of Appeals granted the Finding for the changes to the non-conforming buffer between commercial and residential
zones based upon the plans and information submitted in the application.
The Findings of the Board under Section 9.3 for the change were as follows:
1. The Board found that no buffer currently exists and the wall of the building acts as a buffer. The demolition of the building and
replacement of a small planted strip with 6' fence would come closer to meeting the required buffer and the change would not be
substantially more detrimental to the neighborhood than the previous buffer.
2. The change would not create any new violation of other zoning provisions; and does not involve a sign.
