General Conditions 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Emergency Certification or subject to enforcement action. 2. This Emergency Certification does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of property rights. 3. This Emergency Certification does not relieve the applicant or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations. 4. Any work conducted beyond that described above, and any work conducted beyond that necessary to abate the emergency, shall require the filing of a Notice of Intent. 5. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect -the area subject to this Emergency Certification at reasonable hours to evaluate compliance with this Certification, and may require the submittal of any data 'deemed necessary by the Conservation Commission or the Department for that evaluation. 6. This Emergency Certification shall apply to any contractor or any other person performing work authorized under this Certification. 7. No work may be authorized beyond 30 days from the date of this certification without written approval of the Department. D. Special Conditions N/A E. Appeals The Department may, on its own motion or at the request of any person, review: an emergency certification issued by a conservation commission and any work permitted thereunder; a denial by a conservation commission of a request for emergency certification; or the failure by a conservation commission to act within 24 hours of a request for emergency certification. Such review shall not operate to stay the work permitted by the emergency certification unless the Department specifically so orders. The Department's review shall be cohdu'cted within seven days of: issuance by a conservation commission of the emergency certification; denial by a conservation commission of the emergency certification; or failure by a conservation commission to act within 24 hours of a request for emergency certification. If certification was improperly granted, or the work allowed thereunder is excessive or not required to protect the health and safety of citizens of the Commonwealth, the Department may revoke the emergency certification, condition the work permitted thereunder, or take such other action as it deems appropriate. (NEE) and Doucet Associates (Doucet) have prepared this request for an Emergency Certification on behalf of the residents of Fairway Village, in order to expedite replacement of a failing culvert under Fairway Road in Florence. The proposed work is necessary to protect public safety, in particular to maintain the ability for residents and emergency vehicles to access the residences which are located to the north of the culvert. 2.0 SITE DESCRIPTION AND CURRENT CONDITIONS Fairway Village is a residential neighborhood at the south end of Northampton Country Club, between Spring Street and Mill River in Florence. Fairway Road is a private roadway which serves as the sole paved access to this neighborhood. •Figure 1 illustrates. a site locus on the USGS topographic map. Figure 2 is an aerial photograph of the area, with the location of adjacent Estimated •IIabitat of Rare Wildlife indicated. Fairway Road crosses an unnamed tributary of Mill River, depicted as perennial on the USGS map. This stream is contained in a 7 -foot diameter corrugated metal pipe culvert under the road. The pipe is approximately 93 feet long. At the east end of the pipe, which is downstream, the pipe ends in a concrete headwall, followed by a level concrete flow restriction structure approximately 12 feet wide, which creates a waterfall at its notched downstream edge. The streambed below this waterfall is over 11 feet lower in elevation than the streambed at the upstream end of the culvert across- Fairway Road. Currently, Fairway Road has subsided in the vicinity•ofthe.culvert, such that runoff from the road does not reach two stormwater catch basins north of the stream crossing. Instead, runoff collects in the road over the culvert and then flows west, eroding the soil next to the road and the adjacent sidewalk before flowing into the stream. It has also opened a sinkhole between the sidewalk and the pipe inlet, so that stormwater is flowing underground and into the pipe and the surrounding soil. The pipe itself is no longer round, but has compressed to an irregular shape, and appears to be separating by at least one joint. The road surface was reinforced, filled; and repaved over the pipe in early June of 2009. Since then, the road surface has subsided further, more soil has eroded, and the pipe has become more mis- shapen. 3.0 PROJECT DESCRIPTION The proposed solution for the failing culvert is replacement with a reinforced concrete pipe of the same diameter. Because this roadway provides sole access to. 64 dwelling units in Fairway Village, the work will be done in phases, and a single lane of the roadwill remain open for vehicular traffic. The work will proceed generally from the downstream •end to the Upstream end. During construction, the stream will be impounded above the culvert and piped downstream. The downstream flow control structure will be retained. The construction phases are indicated on Sheet C -6 of the Doucet plans, with Phase I replacing the culvert east of the existing roadway. Phase II will replace the culvert under the east side of the roadway, maintaining access over the west side and Project Narrative for Emergency Certification July 23, 2009 Fairway Road culvert replacement, Northampton Page 1 NEE Project 09 -3440 the adjacent sidewalk. Phase III will replace the remaining culvert sections under the west side and sidewalk, while restoring traffic to the newly filled east side of the road. Phase IV will install the remaining sections west of the sidewalk, and construct a headwall at the invert. Phase V will restore the roadway surface, sidewalk, guardrails, and adjacent surfaces. The proposed work will improve current stream conditions by eliminating a source of erosion into the stream, and by rerouting all roadway stormwater to the existing catch basins. Existing conditions in the stream are not consistent with fish passage, and it is not possible to reconfigure the stream under the road to allow fish passage, due to the change in elevation. Wildlife passage through the culvert after rehabilitation will be equal to or better than current conditions. 4.0 WETLAND RESOURCE AREAS New England Environmental, Inc., (NEE) completed a wetlands delineation near the Fairway Road culvert on June 24, 2009. The following resource areas are in the vicinity of the proposed work: Bank Bank, Land Under Waterway, Riverfront Area, and Bordering Vegetated Wetlands. No other wetland resources were found at this site. The Flood Insurance Rate Map for the area shows no land subject to the 100 year flood on the site (see.Figure 3). Bank is found along the brook that runs under Fairway Road, and along a small drainage channel draining wetlands southwest of the crossing. Flags BK1 -3 and BK11 -14 Mark the top of Bank west of the culvert. Flags BK21 -24 and BK31 -34 mark the top of Bank east of the culvert. Under current DEP interpretation, the culvert itself is also considered. Bank. Flags Al and A2 mark the eastern side of Bank along an intermittent stream, the drainage `channel mentioned earlier. The proposed work will alter Bank by replacing the failing culvertand building, a headwall at.the entrance to the new pipe. These alterations to Bank are intended to stabilize the Bank on this site. Bank has a 100 foot buffer zone. All the proposed work is either within Bank or its buffer zone. Land Under Waterway Land Under waterway is located between the Banks of the stream, and is that part of the streambed which remains under water during annual low flows..: It was. not delineated. Land Under Waterway (LUW) on this site is very stony. It may also be considered to include the bottom of the pipe. Alteration of LUW will be limited to the replacement of the pipe and restoration of the streambed Project Narrative for Emergency Certification July 23, 2009 NEE Project 09 -3440 Fairway Road culvert replacement, Northampton Page 2 west of the new headwall. This area was armored with 'stone when the current pipe was installed, and stone will be placed at the entrance to the new pipe. No other alteration of LUW will be necessary. Riverfront Area Riverfront Area on this site is presumed to extend 200 feet from the BK flags and the existing culvert. Excavation to replace the culvert will temporarily alter Riverfront Area. Paved surfaces and vegetated surfaces will be restored after installation of the new pipe. All proposed work beyond Bank is within Riverfront Area. Bordering Vegetated Wetlands Bordering Vegetated Wetlands (BVW) are found on the southwest of the stream crossing, on the west side of the drainage channel marked by flags Al and A2, and extending south on the west side of flags A3 to A5. This is a wooded area dominated by Red Maple. BVW is not found north of the perennial stream, or south of the stream on the east side of the culvert, due to steep slopes adjacent to the stream, which are covered with upland vegetation above the delineated Bank. Bordering Vegetated Wetlands have a 100 foot buffer zone. A small area of BVW may be disturbed in order to install the southern wing of the western headwall. This area, and the adjacent 100 foot buffer zone, will be revegetated after installation of the culvert and associated structures. 5.0 SEDIMENTATION AND EROSION CONTROL The proposed erosion control barrier for this project is a. silt fence and hay bales, staked and anchored in the ground, at the limit of work depicted on the plans, except where the limit of work crosses pavement. In addition, a turbidity curtain will be installed at the downstream end of the flow control structure. This protection will be in place before 'any construction work begins. Hay bales and silt fence will remain in place until all exposed soil surfaces have been revegetated. Extra erosion control materials will be maintained on site during construction for any needed repairs or additions. Soil lodged against the silt fence when it is removed, will be disposed of in vegetated upland areas. 6.0 SUMMARY Project Narrative for Emergency Certification July 23, 2009 This request for an Emergency Certification proposes replacement of a failing culvert under Fairway Road in Florence. The replacement of the existing pipe, and construction of a headwall at the upstream end of the new pipe, will serve to stabilize the Bank of the stream, and will also improve drainage of stonnwater by directing roadway runoff to two catch basins and eliminating erosive flows which currently send sediment into the stream. The work will alter the existing Bank and Land Under Waterway, primarily the pipe and its inlet, andmay also disturb a small area of BVW. Surfaces disturbed by the work will be restored to their pre- existing condition, either vegetated or paved.
