ReviSEO 1976 '%WW .r/ DECISION OF ZONING BOARD OF APPEALS At a meeting held on June 1, 1987, the Zoning Board of Appeals of the City of Northampton voted unanimously to grant the Special Permit request of Joseph and Barbara Batura, 84 Spring Street, Leeds, MA for the purpose of replacing a barn with a two -car garage and installing an above - ground pool on property located within the Watershed Portection District at 84 Spring Street, Leeds, MA. Present and voting were: Chairman Robert C. Buscher, Peter Laband and Irene David. P. Laband noted that this request for the construction of a garage and an above - ground pool under normal circumstances in a URA zone would be allowed by right, however, under Section 14.3 (1) of the Northampton Zoning Ordinance, a Special Permit is required. Referring to Section 14.5, he found that the applicants have satisfactorily provided the Board with the information required under Paragraph #2• Referring to Section 10.10, he found that the requested use is allowed; that the requested use bears a positive relationship to the public convenience; that there will be no change in traffic; that the requested use will not overload municipal services; and that the requested use will not impair the integrity or character of the district. R. Buscher concurred, finding that the two accessory structures that are requested comply with the minimum setback requirements, and that although the Watershed Overlay District designation is valid and necessary, this stream represents a small tributary of the Mill River and is unlikely to bear a flood stage that would be altered by the erection of these structures. I. David concurred. i Robert C. Buscher, Chairman Peter L and Irene David `.r "M CITY of NORTHAMPTON OFFICE of PLANNING and DEVELOPMENT MEMORANDUM TO: Zoning Board of Appeals FROM: L.
