[1] The Commission should wait to close the public hearing until NHESP has issued its determination.
[2] The parties need to make note of 310 CMR 10.53(7) where it states "The Notice of Intent for any projects
involving the construction, repair, replacement or expansion of public or private infrastructure shall include an
operation and maintenance plan to ensure that the infrastructure will continue to function as designed.
Implementation of the operation and maintenance plan as approved by the Issuing Authority shall be a continuing
condition that shall be set forth in the Order of Conditions and the Certificate of Compliance."
ADDITIONAL REQUIREMENTS:
This project proposes a discharge of dredged or fill material into “Waters of the United States” potentially subject to
the federal Clean Water Act. Per the Massachusetts General Permit (MAGP) issued under the federal Clean Water
Act, you may be required to notify the US Army Corps of Engineers, New England District of this project proposal.
