Based upon my observations at the site, I believe that the work has been completed in substantial conformance with the. following plans: "Proposed Conditions, Stabilization of Intermittent Stream Channel ", by BEC, Inc., October, 2000. One minor deviation was noted. The construction plans called for a flared end section at the downstream end of the pipe. To accommodate field conditions, this was not installed. At construction, it was found that a municipal storm drain enters the stream channel near or at the location of the proposed flared end. By omitting the flared end, the overall length of the pipe was shortened a few feet, and the conflict was avoided. The riprap materials installed at the pipe end appear sufficient to stabilize the area. On behalf of the Skorupskis, we are submitting a Request for a Certificate of Compliance for the Order of Conditions issued by the Northampton Conservation Commission for DEP File No. 246 -483. It is stated that "The requirements of 310 CMR 10.60 have not been met." in reference to Wildlife Habitat Evaluations. As stated in the permit application, the proposed project will alter inland Bank beyond the thresholds permitted under 310 CMR 10.54 (4)(a) 5. Such alterations may be permitted only if they have no adverse effects on wildlife habitat. Adverse effects on wildlife habitat mean the alteration of any habitat characteristic listed in 310 CMR 10.60(2), insofar as such alteration substantially reduce its capacity to provide the important habitat functions listed in 310 CMR 10.60(2). As a competent professional with more than two years experience in wildlife habitat evaluation (see attached resume}, the following evaluation of the project area should be deemed acceptable under 310 CMR 10.60 (1)(b). Upon evaluation of the subject parcel, it is my professional opinion that the intermittent stream channel that bisects the parcel does not provide the important wildlife habitat functions of 310 CMR 10.60 (2)(a) 1 & 2. Wildlife habitat characteristics of inland Banks states "The topography, soil structure, and plant community composition and structure of banks provide the following important wildlife habitat functions: 1. Food, shelter and migratory and breeding areas for wildlife 2. Overwintering areas for mammals and reptiles" While there is no current DEP policy inforce relative to wildlife habitat evaluation, Form Policy 88 -1 addresses the issues and establishes evaluative criteria for Bank Resource. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his /her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and /or damage prevention controls it may deem necessary. Any fill shall contain no trash, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing. 7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 8. The Applicant is proposing to stabilize the banks of an intermittent stream channel that bisects their property at 33 Laurel Lane in the City of Northampton, MA. The banks of the channel are currently compromised and in danger of filling the channel. The undermined banks pose a threat to personal property and downgradient wetland resources. The sidewalls of the channel are ._ comprised of a deteriorated timber retaining wall and do not have natural riparian characteristics. The proposed project will stabilize the channel by connecting a length of pipe to the existing culvert beneath Laurel Lane along the length of the channel. Under the Massachusetts Wetlands Protection Act (MA WPA) and as regulated under the City of Northampton Wetland Protection Ordinance the area consists of Bank resource. As such, a Notice of Intent is required in order to allow the proposed work to go forward. The remainder of this narrative will discuss: • The existing wetland resource conditions, • The proposed work within the intermittent stream channel, • The mitigation measures that are being employed, and • The conformance of the project with applicable regulations under the MA WPA and the City ordinances. EXISTING CONDITIONS The proposed project is on two parcels of land, 19 and 33 Laurel Lane, with the majority being on the applicant's property. The lots are located on the east side of Laurel Lane (See Figure 1 — Locus Map). The area surrounding the property is residentially developed. The area immediately adjacent to the intermittent stream channel is composed of landscaped gardens, a flagstone patio, and Laurel Lane. There are no areas of natural riparian corridor present and wetland resources are limited to Bank due to intermittent stormwater flows. The channel is an average of 4 feet deep and varies between 2.5 feet to 6.5 feet wide. Deteriorated, rotted timber sidewalls reinforce the sides of the channel. Wooden crossbars -' prevent the sides from caving by supporting the timbers that are being undermined by erosive forces and in danger of collapsing into the channel. The integrity of the home and other structures are also in jeopardy, as the surrounding lands subside. Description of Wetlands The wetland resources on site are limited and derived from an upgradient wooded wetland and stormwater discharge from catch basins located along Laurel Lane. This drainage system is culverted beneath Laurel Lane and emerges on the project site from a 48" reinforced concrete pipe (RCP). Flow within the channel is clearly intermittent, flowing only in response to direct precipitation. Flow channels within the bottom of the channel are 1 — 2 feet wide, with evident 33 Laurel Lane Northampton, MA Notice of Intent Narrative Page 1 of 4 IM "*AWW 1..01.1 sediment deposits along its length. Because of the upgradient connection of a wooded wetland, the channel constitutes Bank resource. However, due to the lack of consistent hydric vegetation and absence of hydric soils within the channel, the banks do not appear to qualify as a Bordering Vegetated Wetland (BVW). While technically meeting the requirements for Bank resource, the area has little functional value beyond its water carrying capacity. Off of the property, the intermittent flow broadens into a small wooded riparian zone where hydrophytic vegetation, hydric soils, and hydrology become more readily apparent. As shown in the accompanying figures, there is no designated hundred -year floodplain within the project area. The Estimated Habitat Atlas does not identify the project area as an area of protection for rare wildlife habitats or certified vernal pools. PROPOSED WORK The proposed project seeks to install a culvert within a portion of an intermittent stream channel. It is proposed to extend the existing 48" RCP eight feet to connect with the proposed precast manhole. Stormwater flows from this manhole will exit into a 36" high- density corrugated polyethylene pipe (HDPE) for 193 feet before discharging into a 15' riprap outlet protection basin. This basin will be graded with a 2:1 slope to decrease flow velocities while detaining small volumes of water to increase the removal of total suspended solids. Two area drains with cast -iron grates are proposed to accept sheet flows from the adjacent landscaped lands into the proposed 36" HDPE pipe. The proposed work will be completed in stages proceeding in a downstream to upstream fashion. A temporary row of haybales shall be placed downstream to intercept suspended solids. The excavation of the outlet protection basin will follow in order to collect small flows and settle out -" sediments. Any baseflow within the channel shall be temporarily housed in a closed conduit or the use of an upstream sandbag checkdam with a pump system can be used when flows are at a minimum. All new drainage structures shall be supported by a 12" thick foundation of crushed stone. The new pipe shall be placed on a bedding of Y4 crushed stone. All timber materials supporting the existing channel shall be removed and disposed of by the contractor in a legal and lawful manner. In order to provide the contractor with the flexibility to change the construction sequence it is suggested that a preconstruction meeting be held with a representative from the Conservation Commission, the applicant, the contractor and the applicant's representative to confirm the process that will be implemented for the proposed work. The following is an anticipated — construction sequence: 1. Install downstream erosion control barrier _ 2. Excavate outlet protection basin 3. Remove existing timbers, 6. Add appropriate crushed stone bedding, 7. Install 36 "HPDE, 8. Install area drains, 9. Add appropriate backfill, 10. Install secondary erosion control barrier, -- 11. Repeat steps 3 -10 for addition sections of pipe, 12. Install precast manhole, 13. Install 48" RCP, 14. Add appropriate backfill, 15. Grade and loam to match topography, 16. Line outlet protection basin with riprap -- 17. Seed and mulch disturbed soils. MITIGATION MEASURES -- Erosion controls shall be installed as indicated on the Proposed Conditions Plan in order to minimize turbidity and siltation in downstream waters in all phases of the work. Erosion controls on -site will consist of siltation fencing and hay bales adequately anchored into the ground and installed immediately following backfilling. Erosion controls will be maintained as necessary throughout the period of construction. All work is contingent on work being conduct during a low flow conditions. The contractor shall discontinue construction in the event of a significant storm event where flows exceed the capacity of the bypass conduit or sandbag checkdam system. The adjacent land will be graded as specified; all disturbed soils shall receive a minimum of 4" of loam and shall be seeded and mulched to stabilize disturbed soils. CONFORMANCE WITH REGULATIONS The proposed work conforms to the Massachusetts Wetlands Protection Act Regulations (3 10 CMR 10.00) and the City of Northampton Wetland Protection Ordinance Ch. 24 by avoiding any unnecessary impacts to Bank and meeting the relevant performance standards for the resource area. The performance standards for Bank (3 10 CMR 10.54(a) are met by providing for the continuing physical stability of the channel (Bank) area and its water carrying capacity. The groundwater and surface water quality are not impaired in this area because no additional stormwater runoff is to be allowed to enter in this channel. _ The wetland resource does not contain "important wildlife habitat functions" (3 10 CMR 10.54(4)(a)(5)). Relative to wildlife habitat functions, the proposed impact to Bank resource exceeds 50 LF, thereby exceeding the presumption of no significant impact. However, as per 33 Laurel Lane Northampton, MA Notice of Intent Narrative Page 3 of 4 IM N%W r..0' •• 310 CMR 10.54(a)(5) additional alteration can be allowed if "there are no adverse effects on wildlife habitat as determined by procedures contained in 310 CMR 10.60 ". According to 10.60(1) an adverse effect on wildlife is defined as "alteration of any habitat characteristic in 10.60(2) insofar as such alteration will substantially reduce its [the Bank resource's] capacity to provide important wildlife habitat function." As per 10.60(2)(a), Bank wildlife habitat characteristics include (1) the provision of food, shelter, migratory and breeding areas for -- wildlife, or (2) overwintering areas for mammals. Bank is defined (3 10 CMR 10.54(2)(c) as that area between the first observable break in slope (or mean annual flood level, whichever is lower) and the mean annual low flow level. Therefore, this is the area that must be assessed relative to the wildlife habitat characteristics. Within this 220 -foot long channel, the typical flow channel is a slightly meandering 2.5 to 6.5 -feet wide -- channel, meandering between sandy sediment deposits within the channel. Because the only flow that enters into channel is from an 48 -inch dia. culvert, the area of Bank resource can reasonably be interpreted to be limited to the bottom of the channel. While there is extremely sparse vegetation within the bottom of the channel, most of the adjacent vegetation near the channel occurs in landscaped gardens on either side, immediately outside of the Bank resource and by mown lawns associated with the existing residential house on the north side of the channel. Therefore, the only potential wildlife habitat in this area would be associated with the 100 foot Buffer Zone to the Bank resource, not within the Bank resource itself. Due to the artificial nature of the Bank resource, the limited vegetation, the obvious recent and reoccurring sediment deposits associated with runoff from Laurel Lane and the frequent scour in this area, it is doubtful there is any important wildlife habitat within this Bank resource area. Runoff values were calculated for the present conditions. Drainage Watershed and Soils The watershed determined for the site drains into a 48" reinforced concrete pipe (RCP) culvert that crosses underneath Laurel Lane. The culvert is located just south of lot 33 along Laurel Lane (see Figure 1). The hydrologic soil groups and land uses are listed in the following table with their corresponding area and runoff curve number. The weighted RCN assigned to the entire watershed is also indicated.
