NOTICE OF INTENT FLOOD CONTROL SYSTEM MAINTENANCE & MINOR REPAIRS PROJECT NORTHAMPTON, MASSACHUSETTS \\Win2\common\Dropbox\Kristine Baker\WPA\NOI Report.docx | Page 4 1 INTRODUCTION The Department of Public Works (DPW) is proposing a maintenance and minor repairs project for the flood control system to be conducted by an outside contractor for the Connecticut River and Mill River Levee Systems. The repairs are necessary to correct system deficiencies identified by the U.S. Army Corps of Engineers during periodic and routine inspections conducted in 2016 and 2017. 2 PROPOSED PROJECT The work includes the following activities as depicted on the Site Plans enclosed: • Removal of vegetation on an adjacent to the flood control structure, to include the following: o Pruning and clearing and grubbing within 15 feet of the earthen dikes and concrete floodwalls. o Clearing and grubbing of trees and vegetation within 20 feet of the South Street Drop Structure per MA Department of Conservation and Recreation Dam Safety Policy. o Foliar treatment, cutting and/or selective root removal of vegetation on rip rap slopes of the levee and diversion channel. Remaining cut stumps will be painted with herbicide. o Japanese Knotweed will be stem-injected with herbicide. o The use of herbicide will be in accordance with the Department of Food and Agriculture pursuant to 333 CMR 11.00: Rights of Way Management regulations, including a “No-spray Area” within 10 feet of wetlands or the Mean Annual High Water of any waterbody and herbicide products and use restrictions will be in accordance with the Massachusetts Rights of Way Sensitive Area Materials List published by the Massachusetts Department of Agricultural Resources. • Raising of the earthen levee up to 6-inches to match original grades. • Resetting of displaced rip rap along the levee slopes and diversion channel. • Abandonment of an 8-inch drain through the Mill River floodwall by filling with a shrinkage- compensating grout. • Concrete floodwall repairs including joint sealant and filling of spalled areas. • Placement of rip rap along an eroded slope between the Manhan Rail Trail and the levee system to stabilize the erosion. • Placement of loam and seeding of tire ruts and areas of depression on the earthen levee. 3 WETLAND RESOURCE AREAS Resources within the project area include Bordering Vegetated Wetlands (BVW), Bank, Land Under Water Bodies and Waterways (LUWW), Buffer Zone, Riverfront Area, and Bordering Land Subject to Flooding (BLSF). Johanna Stacy, City of Northampton Senior Environmental Scientist, reviewed available wetland resource information within the project area and performed wetland delineations on May 1, 2018 in the vicinity of the Hockanum Road Pumping Station (Areas 1) and the South Street Drop Structure (Area 2) in accordance with the Wetlands Protection Act (WPA), Massachusetts General Laws, Chapter 131, Section 40 and 310 CMR 10. Wetland resource area boundaries along the Mill River that were confirmed to be located outside the work area were estimated for use in determining Riverfront Area and Buffer Zone (Area 3). BLSF was determined using the current Flood Insurance Rate Map (FIRM) profile elevations, as shown on the 1978 Federal Emergency Management Agency (FEMA) mapping. The lateral extent of the floodplains were NOTICE OF INTENT FLOOD CONTROL SYSTEM MAINTENANCE & MINOR REPAIRS PROJECT NORTHAMPTON, MASSACHUSETTS \\Win2\common\Dropbox\Kristine Baker\WPA\NOI Report.docx | Page 5 adjusted on the Site Plans to match the cross-sectional elevations as depicted on the profile with more accurate ground elevations as derived from a 2015 topographical survey and state-wide LiDAR data. Area 1: Hockanum Road Pumping Station Area 1 is located on the riverside of the pumping station and is associated with the Old Mill River Channel as shown on Sheet C-3 of the Site Plans. This area experiences water fluctuations that mimic the Connecticut River as it receives backwater from the Connecticut River through a culvert crossing under Interstate 91. The upper boundary of the Bank is the first observable break in the slope as shown on the Site Plans since the statistical mean annual flood level based on monthly high water levels from 1945 to current was determined to be 113.3 feet, higher than the first observable break in the slope. The lower boundary of the Bank (limit of the LUWW) is the mean annual low flow level, which is approximately 103 feet. There are no Bordering Vegetated Wetlands in this area. The Bank has associated Buffer Zone and Riverfront Area. The work area riverward of the flood wall is located within BLSF. Area 2: South Street Drop Structure Area 2 is located on the downstream side of the South Street Drop Structure as shown on Sheet M-8 of the Site Plans. Bank and BVW within the limit of work was delineated. Estimated Bank is shown on the plan outside of areas with direct impacts to estimate Buffer Zone and Riverfront Area. The Bank has associated Buffer Zone and Riverfront Area. The area is almost entirely located within BLSF. Area 3: Mill River Diversion Channel Bank and BVW have been estimated along the Mill River and Mill River Diversion Channel. There are no direct impacts to BVW, LUWW, or Bank. The work area is located along the rip rap slopes of the channel, which is located within Buffer Zone, Riverfront Area, and BLSF. 4 WETLAND IMPACTS Proposed activities are being conducted within BVW, Bank, LUWW, Buffer Zone, Riverfront Area, and BLSF. The wetland impacts are summarized in Table 1 and are shown on the Site Plans. This is a Limited Project in accordance with 310 CMR 10.53(3)(i) for the “The maintenance, repair and improvement … of structures, including dams and reservoirs and appurtenant works to such dams and reservoirs, buildings, piers, towers, headwalls, bridges, and culverts which existed on the effective date of 310 CMR 10.51 through 10.60 (April 1, 1983).” Herbicide application will be conducted in accordance with the Department of Food and Agriculture pursuant to 333 CMR 11.00: Rights of Way Management regulations. A Limited Application Waiver is anticipated to be obtained for the project and required public noticing will be conducted in accordance with 33 CMR 11.07. Table 1. The LUWW and Bank disturbance within the project area is temporary and will be restored, although there will be tree and brush removal from within the resource areas. Although there is a significant amount of the project area within and BLSF, minor changes in grade are proposed that will result in no net change in floodplain storage volume. Silt fence, straw wattles, and/or silt fence backed with straw wattles will be placed in areas down-gradient of proposed ground disturbance as depicted on the Site Plans. Stabilized construction entrances are provided at various access locations to avoid sedimentation onto local roadways. The herbicide application will be overseen by a person with a Certified Applicator’s license. Herbicide products and use restrictions will be in accordance with the Massachusetts Rights of Way Sensitive Area Materials List published by the Massachusetts Department of Agricultural Resources. 4.1 RIVERFRONT AREA - ALTERNATIVES ANALYSIS Due to the water-dependent nature of the project, there is significant Riverfront Area located adjacent to the flood control structure and within the proposed work area. The flood control structure was constructed in 1939 and has been maintained since its construction. There will be no modifications to the flood control structure and no additional impervious area constructed as part of the project. The project activities are exempted from the Riverfront Area requirements under 10.58(6) “Notwithstanding the Provisions of 310 CMR 10.58(1) through (5), Certain Activities or Areas Are Grandfathered or Exempted from Requirements for the Riverfront Area” for maintenance of structures in existence on August 7, 1996. 5 OTHER PERMITS The project is not within an Outstanding Resource Water or Area of Critical Environmental Concern (ACEC). 5.1 ENDANGERED SPECIES (MESA) REVIEW The project area is within a Coldwater Fishery Resource, the Mill River. The project area associated with the Mill River Levee System is located within Estimated Habitat of Rare Wildlife. A Streamlined Massachusetts Endangered Species Review (MESA)/WPA review is being submitted to the NHESP office for their review and approval concurrent with the Notice of Intent. 5.2 SECTION 408 PERMIT (LEVEE SAFETY) Formal U.S. Army Corps of Engineers Section 408 approval is not required because no alteration to the flood control system is proposed. A notification letter will sent to the Corps prior to construction. 5.3 SECTION 404 PERMIT (CLEAN WATER ACT) A Self-Verification Form will be submitted to the U.S. Army Corps of Engineers Regulatory Division once a Contractor is selected. The project activities meet the conditions of General Permit 1. No time of year (TOY) restriction is required since the activities are not disturbing the ground near a wetland and are not expected to contribute turbidity to the Mill River.
