Open space calculations were added to include a break down of wetland, floodplain and steep slope percentages. a. Standard floodplain mapping (FIRM) shows a floodplain along Clark Brook, but base flood elevations and hazard factors have not been determined for this area. As a result, estimated floodplain limits for Clark Brook were determined using Hydrocad 5 Stormwater Modeling for the 100 year storm event. The overall drainage area for Clark Brook was evaluated to determine the peak depth of the brook during a 100 -year storm event. The stormwater modeling results show that the brook overflows 0.3 feet above the top of bank. 2. Driveway widths for lots 1 and 3 have been reduced to ten feet. 3. Text has been added that indicates the future public access may be provided through lot 2 along the 20' wide easement and through lot 4. 4. Text has also been added that states the stone wall on lot 3 must be protected and preserved on either side of the driveway access. For the reasons cited herein, among others, we respectfully request that the Board deny the request for issuance of a Special Permit allowing the creation of a Flag Lot for Lot #2 on the petitioner's plan, and a single family open space residential development on Lot #1 on said plan. Lot 1 Lot 1 is represented on the plan as the most northerly lot, with a 458.60 by 166.07 feet rectangular layout, comprising approximately 76159.7 square feet. This lot area fails to meet both the minimum frontage requirement of 175 feet and the minimum area requirement of 80,000 square feet required by Section 6, Dimensional and Density Regulations, of the Northampton Zoning Ordinance. Additionally, the house site appears to infringe on the 20 foot side setback requirement on the northerly side. The petitioner apparently is seeking a reduction of required dimensional and density requirements by utilizing Section 6.3.3 and asserting that a rear parcel will be conveyed to the City. We have not as yet been privy to the Conservation Commission's recommendation, if one has been forwarded, but there are several evident ways in which this proposed land division does not comply with Section 6.3.3. These include the following: 1) Facts indicate that acceptance of this flag lot would not adequately protect the resource area being protected. The Assistant City Engineer's 7/23/03 Memorandum to the Planning Board indicates there is a tributary to the Class A drinking water supply located within the boundaries of Lot 1. Pursuant to 310 Code of Massachusetts Regulations 15.211 any septic system must be setback at lease 200 feet from a tributary to a surface water supply. Examination of this lot and its wetlands flagging along the course of the tributary as shown on the plan indicates there is no location on the lot which will satisfy this state regulatory requirement so as to protect the adjacent surface water supply from potential pollution. The granting of a special permit allowing the construction of a residential unit relying on a septic system which violates state law and has the foreseeable outcome of threatening pollution of the resource area being conveyed to the City would be incongruous and inconsistent with the intent of Section 6.3.3 2) There is also no showing, pursuant to Section 6.3.A.3. of any adequate public access to the rear parcel. The petitioner's plans in fact show no means of public access to the parcel to be donated. The Petitioner's application and accompanying plans also fail to adequately address other requirements for the granting of a Special Permit. When this petitioner conveyed the adjoining parcel with its existing residential dwelling to William and Maureen Dwyer in 2001, she represented that the only lot to be developed would be in the area of Lot 3. Current plans and this petition show a residence to be constructed on Lot 1 with a garage visible from the Dwyer's deck. There has been no showing that any attempt is contemplated or planned to comply with the requirements of Section 10.1.3.A regarding sound and sight buffers and preservation of views, etc. The only mention in this regard in the petition is a bald statement that "existing sight and sound barriers will be preserved to the maximum extent possible ". This conveys no intent to create such buffers, if necessary to avoid detrimental impact to the Dwyers, who relied on the petitioner's prior representations when purchasing their home from the petitioner. Also, as discussed above, the septic system which would be needed obviates any showing of compliance with Section 10.1.3.13 for the City's water resources. LOT 2 Lot 2 shows the creation of a flag lot immediately abutting the southerly side of the Dwyer property. The plan for this lot shows the driveway access to the proposed residence impacting directly on the flagged wetlands shown on the plan. There is also no evidence of compliance with the requirement of Section 6.13.4 of the Zoning Ordinance, requiring that the principal structure to be erected must be at least 262.5 feet from the side lot line (175 x 1.5). The plans also do not show all provisions for drainage and storm water runoff pursuant to Section 6.13.8. In addition to these failures to comply with the Flag Lot provisions of the Zoning Ordinance, all of the objections stated earlier with regard to the use of Lot 1 are applicable with regard to Lot 2. The Assistant City Engineer has identified surface water tributaries which would preclude the construction of a septic system in compliance with state regulation. Representations from the petitioner to the Dwyer's at the time of their purchase were that no building would occur on Lot 2. For all of the reasons recited above, William and Mary Dwyer, the immediately abutting property owners who would be most adversely affected and aggrieved thereby, are relying on the responsibility of their elected and appointed public board representatives and public officials to support, apply and enforce the laws, regulations and ordinances applicable to this proposed request and deny the issuance of a special permit for the use of Lots 1 and 2 on the Petitioner's plans for residential dwelling purposes.
