Board of Health.This document gives you(or your representative)permission to enter
your unit only between the hours of 7:00 a.m. to 7:00 p.m. for the sole purpose of
cleaning your apartment as in the orders above. If you or anyone is found in the

Dear Mr Yaple:
Please be advised that this office and the undersigned arc counsel to the River
Run Condominium. I am contacting you with regard to conditions discovered on January
24,2010 in your unit located at 80 Damon Rd.,No.4-302.
As you are aware, the City of Northampton Board of Health issued a Notice of
Housing Code Violation and Order to Vacate your unit on January 25,2010. This notice
and Order is the third of its kind,others having been issued on May 1, 2009 and April 7,
2008. In addition you have been sent numerous correspondences to your attention
regarding unsanitary conditions in your unit. For your convenience I have included
copies herein.
As evidenced by the claims of the Northampton Board of Health and the notices
sent by the condominium association the issue of unsanitary conditions has been a
recurring problem in your unit Notice is hereby given that you correct the issues as stated
in the Notice of Housing Code Violation and Order to Vacate. If you fail to do so within
seven(7)days of the date of this correspondence the association will correct the issues in
your unit. Any costs incurred, including legal fees and court costs, will be assessed to
your unit.
The current Notice and Order was issued due to violations of the State Sanitary
Code discovered after a request was made by the Northampton Police Department to the
Northampton Board of Health to inspect the unit on January 24, 2010. Among the
conditions discovered were rotting food on the premises, pest infestation, and the
presence of bodily fluids. The previous Notices and Orders issued in 2009 and 2009
detailed violations that included accumulation of garbage, refuse, fond waste, battles,

soiled clothing and bed linens, overflowing cat litter, and animal feces scattered
throughout the unit. This situation has been persistent and ongoing. It interferes with the
use and quiet enjoyment of other residents and in some cases poses a serious danger to
their safety.
As stated in our previous dealings with you regarding this matter, in addition to
these conditions being a violation of the State Sanitary Code, they are a violation of the
Bylaws of River Run Condominium. More specifically, sections 5.1.14 and 5.2 of the
bylaws which state that each unit owner is responsible for the proper maintenance and
repair of his unit. The bylaws require that units be maintained so as not
affect the market value of other units, or to pose a threat to the health of safety of other
residents.
The bylaws go on to state that the Association has the right to enter and have
access into units in order to ensure compliance with the bylaws.If it is found that a unit is
in viulatiun of the bylaws the Trustees may request in writing that the conditions the by the unit owner. If the unit owner fails to complyte with the unit and rstens such costs
Trustees shall be entitled to perform the work necessary
associated to the unit and unit owner individually as a common expense. Included
herewith is a copy of the pertinent sections of the bylaws.
I am requesting that a key and access be provided to the association un or before
February 2,2010 so that the association may conduct an inspection of the unit. If at any
time the conditions are found not to be corrected the association will take measures
necessary to remedy the situation.You will be responsible for any such costs incurred to
do so. If you refuse to grant access to the unit for inspection, or provide a key, the
association will file an action in a court of appropriate jurisdiction to require you to
comply with the bylaws of the condominium. Any fees and costs incurred in such an
action will be assessed to you personally and to your unit pursuant to the condominium
documents and the Massachusetts Condominium Act.
In addition, any costs for damages reused to the common areas of River Run
Condominium as the result of the cleaning of your unit,such as hallway carpets,masonry
n in
work, etc., will be duly assessed to your unit. Any costs incurred lbyt duty ovation to
your clean up of the unit, i.e. bulk items at the dumpster, etc.,
your unit.
Though section 5.2.2 of the Bylaws of River Run Condominium requires a fifteen
(15)day period before the association may enter the premises to perform wok on the unit
owner's behalf,it allows for a shorter period if the Trustees determine the situation is an
emergency. In this case the board has determined the existence of special circumstances,
being the immediate Order to Vacate issued by the City of Northampton, which warrants
an emergency and shorter notice period.
Please be advised that any legal fees and costs which have been or are incurred by
the association in this matter will be assessed to you personally and to your unit pursuant

On May 12, 20101 received a call from Bob from River R
sere was an odor coming from Clif Yaple's unit Building 4 uni

On Friday May 14, 2010 Ben, Bob and myself met a Northampton Police officer to do the well
ieing check. After knocking on the door multiple times Bob and the police officer entered the unit. The

On May 14, 2010 the Health Department was asked accompany one of your representatives to do a well being

on Clifford Yaple who resides in Building 4 Unit Se. During the course of that check we found Mr.Yaple deceased
living room floor. After investigation by both a Northampton Police officer and detective as well as a State Trooper
determined that the body had been there approximately a week.
The Health Department, acting under 105CMR410, is ordering you to have Building 4 Unit eeaned by a

',sional biohazard cleanup company. In addition to that clean up the only people that are allowed to enter that
�g are officials or cleanup crews until our notice is removed from the door. Any objects that may wished to be
