Melnik, Attorney -at -Law, (Exhibit B), dated May 30, 2000 regarding above referenced subject. In this letter he states all work to be completed by October 15, 1999. As we both know extremely well the completion date was extended an additional six weeks at your request (see minutes of meeting at Conservation hearing dated October 14, 1999, Exhibit A). You asked us to draw a new site plan to reflect the removal of 200 cubic yards of fill in the front yard. On October 14, 1999 I presented the site map and all requested changes. You were the applicant and present at the meeting. The new completion date for the house was moved to approximately December 1, 1999 and it was too late for a lawn in December. It was told to the Conservation Commission we would install a new lawn the following Spring. It is total misrepresentation of the truth to lead anybody to believe the original date completion date would stay October 15, 1999. As we built a beautiful home with no flaws or problems reported to us or your attorney, we are at a total loss to understand our dismissal. We never refused to do the work to complete the lawn. As General Contractor and Field Representative to the Conservation Commission, we determined this lot, in particular, due to its highly sensitive location with water on three sides, that no lawn could be installed at 150 Main Street due to the excessive rain and cold weather from April 1, 2000 to about May 20, 2000. James Finn, late in May, made a personal visit to 150 Main Street, Leeds. Jim talked to Robert Grout and reviewed the silt fence at this time. Robert Grout made it clear he was happy we delayed the lawn, as we would have lost it all in the Mill River. '"W You were scheduled for loam delivery on Monday June 5, 2000. Spreading , raking and seeding were to be completed in the following days. Our price was not to exceed $2000.00. The $2000.00 was to cover loam only on flat areas as well as seeding and raking. This adjustment was agreed upon when we drafted all agreements for the October 14, 1999 hearing. The re mainin g side hills were to have wild flowers to grow in natural terrain. As advised to you by your landscape architect. The wild flowers on hill sides were to be planted in the Spring as well. As we are denied the right to complete work for the terms and prices stated, (with no reason offered for dismissal), you may not reserve the right to make additional claims, if you choose another Contractor. Due to your Breach of Contract, we expect payment in full of remaining balance of $2000.00 due upon receipt. Without final payment you could void your warranties. Discussion of Proposed Plan Changes - Grout Property (Arch Street/Main Street) Richard Finn, James Finn and Robert Grout were present to discuss proposed changes to the approved plan. Finn advised members that the house and garage had been constructed, but the septic system was not yet installed. He reported that there had been erosion at the base of the driveway due to 3 ...0' work done by the gas company to find a gas leak. Finn said they planned to stabilize the driveway by putting down twelve inches of trap rock grave in that area. Finn said the silt fence enclosed the areas shown in pink and green on the new plan submitted. Maronn recommended armored silt fence and bales of hay across the drive each evening. Finn requested approval of the following plan changes without requiring the filing of an amended Notice of Intent: 1) [Adjustments in grading to] change the water flow away from the septic system an d towards the back of the house. Finn indicated that this was a contractor's decision made in response to field conditions. 2) [Addition ofJ turn- around in the old area of the gravel drive. Finn also requested permission to "soften" the ridge along the top of the hill (shown in pink) and distribute the pitch at two percent (2 %). He clarified that he would leave permanent markers at the boundary as shown on the previous plan but just soften the pitch at the top of the bank. Members requested that Finn notify the Office of Planning & Development if the gas company continued work on the property. Members and Finn also discussed stabilizing the slope by Arch Street. Maronn recommended tobacco netting or a similar product to hold it until Spring. Members agreed that the - change to the plan shown in pink could be approved as a field change. The Conservation Commission orders that all work shall be performed in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the following conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of Intent, the conditions shall control. General Conditions Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by -laws or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: (a) the work is a maintenance dredging project as provided for in the Act; or (b) the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. The applicant is prohibited from using demolition materials, asphalt, large chunks of concrete, tree stumps and limbs, and general refuse; 7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings, before the Department have been completed. 8. No work shall be undertaken until the Final order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. Excavated material and topsoil stockpiles shall be located and stabilized so as to minimize washing into wetland areas or waterways; 16. Soil Conservation Service, "Guidelines for Soil and Water Conservation in Urbanized Areas of Massachusetts ". Placement of sedimentation and erosion control shall be directed at the site by the project engineer in order to accomplish maximum control of erosion to ensure that no eroded materials will enter wetland resource areas. Hay bales must be staked. Silt fencing must be installed in a dug trench with sufficient porosity to allow detained water to pass through while trapping suspended sediments; 17. Areas of construction shall remain in a stable condition at the close of each construction day. Erosion controls shall be inspected at this time, and maintained or reinforced to meet specifications in the plans and this order; 18. All construction areas shall be restored to original condition or better upon completion of the project, including replanting of vegetation; 19. The Commission and its agents shall have the right to enter and inspect the property at any time for compliance with the conditions of this Order, the Act, and Wetlands Protection Regulations: 310 CMR 10.00 and Chapter 24 of the City's Ordinances: "The Wetlands Protection Ordinance ". They shall have the right to request and receive any data or documentation that is deemed necessary for evaluation of compliance. 20. This Order of Conditions shall apply to any successor in interest or successor in control; 21. The contractor is as responsible as the applicant and property owner for any violations of the Orders of Condition and penalties under the law, while all activities regulated by this Order are being performed. A copy of this Order and associated plans shall remain on site during all construction and/or building activities. The project manager and all equipment operators shall be familiar with the approved plans, and shall be informed of their location on the site. This location shall be accessible to all contractors whenever work is occurring on site. A copy of the Notice of Intent, all plans and Order must always be on -site and in all excavating machinery when work is being performed; 22. All required permits must be obtained from the Army Corp of Engineers (404, Water Quality Certification),Planning Board, Zoning Board, Department of Public Works, and Building Inspector prior to the start of projects involving fill within any wetland resource area; 23. Discussion of Proposed Plan Changes - Grout Property (Arch Street/Main Street) Richard Finn, James Finn and Robert Grout were present to discuss proposed changes to the approved plan. Finn advised members that the house and garage had been constructed, but the septic system was not yet installed. He reported that there had been erosion at the base of the driveway due to 3 Vol work done by the gas company to find a gas leak. Finn said they planned to stabilize the driveway by putting down twelve inches of trap rock grave in that area. Finn said the silt fence enclosed the areas shown in pink and green on the new plan submitted. Maronn recommended armored silt fence and bales of hay across the drive each evening. Finn requested approval of the following plan changes without requiring the filing of an amended Notice of Intent: 1) [Adjustments in grading to] change the water flow away from the septic system and towards the back of the house. Finn indicated that this was a contractor's decision made in response to field conditions. 2) [Addition ofl turn- around in the old area of the gravel drive. Finn also requested permission to "soften" the ridge along the top of the hill (shown in pink) and distribute the pitch at two percent (2 %). He clarified that he would leave permanent markers at the boundary as shown on the previous plan but just soften the pitch at the top of the bank. Members requested that Finn notify the Office of Planning & Development if the gas company continued work on the property. Members and Finn also discussed stabilizing the slope by Arch Street. Maronn recommended tobacco netting or a similar product to hold it until Spring. Members agreed that the change to the plan shown in pink could be approved as a field change. The motion passed unanimously 4:0. At 7:48 p.m., Maronn opened the Continuation of a Public Hearing on a Notice of Intent filed by Willard G. Cutler, Jr. to replace an existing shed with a new floating shed for property located at 78 Oxbow Road, also known as Assessor's Map 46 Parcel 11. Maronn asked if Cutler had heard from the endangered species program, and Cutler said he had not. Cutler noted that the required period for allowing comments from the program had expired this p t as Friday. Maronn confirmed that since the thirty days had elapsed, they were obliged to assume that Natural Heritage had no comments. However, he advised the applicant that there had been times when they had issued Orders of Conditions and Natural Heritage had issued comments during the appeal period, so he was not yet out of the woods. Maronn expressed surprise that the Department of Environmental Protection (DEP) had had no comments. He said it was the first time he had seen a floating shed, and he had expected some comments. Reed asked if there were any endangered species down there. Maronn said there was short-nosed sturgeon and others he could not recall. Kaplan moved to close the hearing. Reed seconded. The motion passed unanimously 5:0. Richard Finn & Sons - Request for Approval of Change to Approved Plans for Arch Street, Leeds, Property of Robert and Mary Lee Grout. Richard Finn identified himself as the contractor and introduced Greg Newman of Newman Environmental Engineering and property owner Robert Grout. Finn explained that it was economically impractical to connect to the sewer - he had some estimates in the mid - twenties to connect. He said the Department of Public Works (DPW) also would not allow connection to the water system because there was not enough pressure, so [developers] were trying to contain themselves within the property. Finn displayed a revised plan showing the proposed subsurface• sewage disposal system and well. Finn said they had not had much of a choice as to where to put the septic system on the site. Newman reviewed the septic system design, noting that it was within the hundred -foot buffer zone 5 *+.r I./ of the riverbank. He said he had kept it as far away from the river as he could. Members discussed whether the property was subject to the provisions of the Rivers Protection Act. They noted that the order was issued after the enactment of the regulation, but the lot had been created prior to its enactment. Finn asked if the Rivers Act included things below grade or above grade? Maronn said the Rivers Act basically liked to see no disturbance within a hundred feet ... Finn explained that they had to fit a well on the site because of being unable to connect to City water, so they had the challenge of fitting the house, the well and the septic system on the property. Reed said they would not necessarily have to move the limit -of -work line, they could require that there be no further disturbance beyond that area once the septic system was installed. He suggested requiring that it not be mowed, or mowed only once a year. Newman said he didn't have a problem with plantings except on top of the system. He said it would be fine as long as it held the slope. He said on top he would only want to see grass because that was what really protected it with the shallow roots. Bennett clarified that the applicant was making a request as to whether the change to the plans would require the filing of an amended Notice of Intent. Maronn said his gut reaction was that the change would require an amendment. He explained that this would involve a public hearing, but the original date of the order would still hold. He indicated that he thought the change from tying into the municipal system to a septic system was significant. He pointed out that it would require some grading changes and some changes to the non - encroachment line. The applicant asked about procedure, and Maronn advised the applicant to submit the plans and request an amendment to the Notice of Intent. Members noted that there was an amended Notice of Intent form. Krutzler informed the applicant that if he submitted something by Thursday noon, he could be on the next agenda. Maronn said he would also have to submit a request to change the condition regarding permanent markers. Upon review of the site it was evident that the embankment on the east side of the parcel would be difficult to grade in conjunction with the grading for the proposed house, resulting in a slope of approximately 50 linear feet and 20 feet in height graded down to the garage wall. See the parcel cross section attached and the revised site plan. Moving the erosion control limit to the revised location further east will allow for the top of the embankment to be graded out and allow for a more reasonable grading scheme adjacent to the proposed garage. The contractor will utilize care in the excavating of the embankment area. Erosion controls will be installed prior to any activity and will be maintained through out the duration of the site work until adequate vegetation is established. Additional controls will be utilized as necessary to assure that erosion does not occur on the undisturbed portion of the embankment. Another matter that the applicant would like the input from the Commission on, is the status of a large oak adjacent to the access wood road that leads down to the river flood plain on the upslope, north side. A large oak that has fallen across the flood plain access wood road as a result of last winters storms is scheduled to be removed. Another oak just west of the fallen oak has not fallen as yet, but appears to be in an unstable position very similar to the tree that has fallen. Roots from the tree along the embankment are exposed and the tree is leaning downslope towards the wetland and river area. When this tree falls, it will be necessary to access resource and buffer zone areas to remove it. Placement of sedimentation and erosion control shall be directed at the site by the project engineer in order to accomplish maximum control of erosion to ensure that no eroded materials will enter wetland resource areas. Hay bales must be staked. Silt fencing must be installed in a dug trench with sufficient porosity to allow detained water to pass through while trapping suspended sediments; 17. Areas of construction shall remain in a stable condition at the close of each construction day. The contractor is as responsible as the applicant and property owner for any violations of the Orders of Condition and penalties under the law, while all activities regulated by this Order are being performed. A copy of this Order and associated plans shall remain on site during all construction and/or building activities. The project manager and all equipment operators shall be familiar with the approved plans, and shall be informed of their location on the site. This location shall be accessible to all contractors whenever work is occurring on site.
