Project lots will be located off Glendale Road. HARDSHIP: CONDITION OF APPROVAL: FINDINGS: The Planning Board approved the modification to the original cluster subdivision to change the total build out to 4 house lots, 3 of which will be served by a common driveway instead of the original subdivision layout. The Board granted the Special Permit based upon the following updated plan submitted at the hearing: 1. Amendment to the Kensington Estates Site Plan/Special Permit Four Lot Conservation limited development Project of the City of Northampton, By the Berkshire Design Group, Inc. Sheet 1 of 1 dated September 2, 2016. In granted the amendment to the cluster, the Board approved the 3 lots off the common driveway and one frontage lots to contain single family homes to be located within the cleared/work limit area. Lot 1 structure will be setback 20' from the abutting parcel (123 Glendale Rd) instead of the required 15' side setback. The Board determined that the amendment reducing the total number of lots from 24 to 4 and increasing the preserved open space to 53+ acres met the following criteria in the Chapter 350: 1.The requested use protects adjoining premises against seriously detrimental uses. If applicable, this shall include provision for surface water drainage, sound and sight buffers and preservation of views, light, and air; and. The reduction in total housing units from 24 to 4 increases open space protection. The lot layout provides for additional buffer to the most impacted of the existing parcels. (2) The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, minimize traffic impacts on the streets and roads in the area. If applicable, this shall include considering the location of driveway openings in relation to traffic and adjacent streets, access by emergency vehicles, the arrangement of parking and loading spaces, and provisions for persons with disabilities; Three lots will be served by a common driveway. The number of lots is no more than what could potentially be developed by right. and (3) The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area; There is significantly more open space than what the Board previously approved through a cluster special permit and (4) The requested use will not overload, and will mitigate adverse impacts on, the City's resources including the effect on the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools; and (5) The requested use meets any special regulations set forth in this chapter; (the provisions in the cluster ordinance and shared driveway standards will be met) and (6) The requested use bears a positive relationship to the public convenience or welfare. The use will not unduly impair the integrity of character of the district or adjoining zones, nor be detrimental to the health, morals, or general welfare. The city's objectives to provide dispersed affordable housing options as well as acquisition and protection of sensitive ecological tracts of land will continue to be met in this amendment.
