DECISION OF
ZONING BOARD OF APPEALS
At a meeting held on July 17, 1985, the Zoning Board of Appeals of
the City of Northampton voted unanimously to grant the Variance request
of Rosemary Rachel Black, 2 Florence Street, Leeds (Northampton) to convert
hersingle- family dwelling into a two - family dwelling (URA Zone). Present
and voting were: Chairman Robert C. Buscher, William Brandt and Peter Laband.
The findings were as follows:
P. Laband, referring to criteria necessary to grant a Variance
from Chapter 40A, MGL, found that the shape and topography of the
lot with the two projections is most unusual and unique to other lots
in the zoning district; that a literal enforcement of the Ordinance
would involve a hardship, as a 1.3 acre lot with a single - family
dwelling is an underutilization in an area where there are several
multi - family dwellings; and that the request will not derogate from
the intent of the Ordinance nor be of detriment to the public good.
R. Buscher concurred, finding that the applicant is unable to sub-
divide the oversized lot, as there is only 120 ft. of frontage; and
although the normal intent of the Ordinance in regards to a URA zone
is to keep single family dwellings, the inclusion of basically a block
of multifamily dwellings constitutes relief to the applicant without
derogating from the intent of the Ordinance.

July 17, 1985
The Northampton Zoning Board of Appeals held a public hearing on July 17, 1985
at 9:00 p.m. in Council Chambers, Wallace J. Puchalski Municipal Building on the
Variance request of Rosemary Rachel Black under the provisions of Section 5.2,
Page 5.2 of the Zoning Ordinance of the City of Northampton for the purpose of
converting a single- family dwelling into a two - family dwelling at 2 Florence Street,
Leeds (Northampton) (URA Zone). Present were: Chairman Robert C. Buscher, William
Brandt and Peter Laband.
The Chairman read the public notice as it appeared in the Daily Hampshire
Gazette on July 3 and 10, 1985. He reviewed Section 5.2 and criteria necessary
to grant a Variance from Chapter 40A, MGL. He noted receipt of a memo from L. Smith,
Planner, on behalf of the Northampton Planning Board recommending in favor of
the petition. He advised those present of their right to appeal.
Ms. Black stated that the house,situated on an oddly shaped 1.33 acre lot, is
the only single family dwelling surrounded by multifamily houses, and cited an
8- apartment building, a 4- apartment building and a 7- condominium building (Grove
Hill Mansion). She stated that at the time of purchase, six years ago, she was
married, but is now divorced and the single parent of two children, and she cannot
afford the large mortgage without some additinal income.
She referred to the submitted plans where the second apartment was drawn out
in detail and explained that the right -of -way to her house comes in front of the
Leeds School, with the private road blocked. She added that there is adequate
on -site parking.
It was moved, seconded and voted unanimously to close the public hearing.

meeting adjourned at 9:22 p.m. Present in addition to those mentioned, was J. Parker
Board Secretary.
