Saranowski, Chairman - 2 -- I .../ CITY OF NORTHAMPTON BOARD OF APPEALS nVnrcrnM Re: Petition for a Variance by O'MEARA MOTORS INCORPORATED This is the Decision of the Board of Appeals of the City of Northampton on a petition filed by O'MEARA MOTORS INCORPORATED requesting a variance from the provisions of Chapter 44, Sections 24 and 26, of the Revised Ordinances of the City of Northampton. The petitioner requests the Board grant a variance to permit the petitioner to convert an old mill building to a twenty -five (25) unit apartment house. The premises affected are situate on the west side of Main Street and are designated on the Assessors Map of the City of Northampton as Parcel 81, Sheet 10B. The matter was duly advertised on January 29, 1974 and February 5, 1974, in the Daily Hampshire Gazette, and was heard by the Board on February 13, 1974. Charles W. Dragon, Chairman presided at the hearing and heard the matter with Board members, Cecil I. Clark and Edward E. Keefe. The petitioner was present and was represented by Attorney James C. O'Donnell. There were objectors who were represented by Attorney Francis E. Collins, Jr. After due hearing the Board voted unanimously to,deny the variance for the following reasons: 1. The petitioner failed to establish a substantial hardship. 2. The granting of the variance would result in substantial detriment to the public good as the Board found that the building would be unsafe for human habitation due to the proximity of the building to the street line in the front and the river in the rear. The Board V also found that the proposed use and construction does not provide sufficient fire prevention and protection. 3. The granting of the variance would derogate from the intent and purpose of the Zoning Ordinance as the proposed use is not in keeping with the nature and the character of the neighborhood and fails to meet the 500 square feet per unit requirement of the City Ordinance. M The Northampton Board of Appeals held a public hearing on the petition of O'Meara Motors, Inc., on February 13, 1974 at 7:30P.M., in the Council Room, City Hall, Northampton, Mass. All members of the Board were present. Attorney James C. O'Donnell represented the petitioners, Pioneer Home Sponsors on the conversion of an old mill building in the center of Leeds to a 25 -unit apartment house. O'Meara Motors of Connecticut is the owner of the premises. The Massachusetts Housing Financial Agency will grant 1/2 of 1% to modernize the building into apartments which is considerably less than conventional sources. The building is too old and obsolete for continued use as a mill. Variance needed because of less than 5000 square feet of lot area for each - family dwelling unit. The building is three stories high and is more than 40 feet in height; no elevator service because of extreme high cost of install- ing it. A practicing Architect in the City of Boston spoke by the name of Mr. Lawrence Raider. He stated that the building in question is an architectural heritage and would be a valuable contribution. It would be economicaly feasible to restore the building and the City would be helped also. Mr. Francis Cole a Real- Estate Broker said it would be difficult to market this building as a mill. The building has been for sale before and it still has not been sold. Mr. Douglas Herring- Registered Architect: Site in question has a very lovely view and the building is structually sound. The roof leaks and it is also very drafty and does have some weather damage. The mortgage department of Massachusetts Housing has reviewed this. Potential is very high and would also be a great asset. Apartment lay -out: 2 new fire egress stairs. Sprinkler pump. Two doors in each apartment. Third and fourth floor would be like a duplex apartment. With kitchen, dining room and living room and the bedrooms would be located above. On the first and second floor they would be what is called as "flats ". The final drawings haven't been decided upon as yet. Fire -proof partitions would be in each apartment. Mr. Dragon asked about the sewer system and the heating plant? At this time raw sewerage is discharge into the river directly behind the building. Mr. Clark asked about the State Code - two people per bedroom and not more than four. Mr. Herbert Berezin- Markin Corporation, Inc. of 667 Main Street, Holyoke, Mass., is a development firm in the Rehabilatation of Housing. Letter presented to Board from Mayor Taupier and the Holyoke Planning Board. The building in question is very cut up - construction beams all floors 15' apart. Cost of heating the building is not known. All new heating systems would be installed. Hot water base -board either gas or oil with duct work out to the various rooms. A great deal of oppostion to housing on the particui.ar site in question for apartments. The site is not idea for small children - State law that we cannot discriminate. Mr. Francis Collins, Attorney representing oppositon. Zoning Ordinance Chapter 40A less congestions, light and air - prevent overcrowding,conserve value of land and building. Purchase price $36,745.55 , conservative value $504,779 wrong use of public subsidize funds. Powers of the board authorization of appeal on a particular parcel not generally affecting or causing a substantial hardship. Measuring the tract of land in question 120' -90' accross approximately 500' along roadway 100' x 120' of dry land - considerably under the stated 2.2acres. Reguirements of 500 square feet per family unit - 1100 square feet short - 3000 `-square feet short of lb,,. located on the lot. Tax payer be required to subsidized this kind of an operation. Now under construction are 207 units on Barrett Street, 200+ on Bridge Road and 150 -170 on Damon Road. We have more than enough subsidized housing located already in the City of Northampton. We do not need to have more people coming in from any other areas so that the citizens can have to pay out for this burden on the tax rate. Mr. Russell Christenson -I personally tried to buy this building for the Handicap Center. I inquired severaly times and they never called back. Mr. Donald Berniche, President Leeds Civic Association oposes the plan. He has talked to a number of people in Leeds as he is a clerk in the Post Office and over 80% of the people are opposed to this apartment complex. Among the reasons are the sewage problem and the overcrowding that would be caused in the Leeds school. Mr. Levay asked if their really is a need for this king size apartment building project in Leeds. We already have a number of apartments located in the village of Leeds. Mr.Karl Bauver - cost to convert this old mill into apartments very costly and would be more reasonable to convert back into an industrial building. We do not need twenty -five more apartments at the junction of Mulberry Street as it already is a very dangerous intersection. Mr. O'Donnell - rebuttal - does include 2.+ acres of land in taxes. Loan would be repaid in full as we could borrow at a lower figure and the profit would flow back into the state. It is zoned industrial and is not paying the taxes it should be. It would not be offensive to the neighborhood and would also benefit the village and the neighborhood. A legal brief that would be submitted by the two attorneys has been requested by the Board of Appeals .
