X Approval of the Stormwater Management Permit Amendment subject to any conditions, modifications or restrictions required by the Department of Public Works (see below) __ Disapproval of the Stormwater Management Permit Amendment based upon a determination that the proposed plan, as submitted, does not meet the purposes set forth in the Northampton Stormwater Management. Standard Permit Conditions: 1. All clearing, grading, drainage, construction, and development of the proposed Lia Kia Showroom shall be conducted in strict accordance with the following plans and information submitted with the application and as amended by any conditions attached to this permit amendment. a. Lia Kia Site Plan at 263 King Street, Sheets 1-10, revision dated June 21, 2012, prepared and stamped by Gregory P. Henson, P.E. Huntley Associates, P.C. b. Lia Kia Site Plan Drainage Report, dated June 21, 2012, prepared by Gregory P. Henson, P.E. Huntley Associates, P.C. All clearing, grading, drainage, construction, and development of the 263 King Street - Lia Honda Vehicle Storage shall be conducted in strict accordance with the plans, information, and conditions specified in the Stormwater Management Permit Approval dated 4/27 /06, revised plans and calculations dated 10/17 /2006 and as amended by the above referenced plans and information and as amended by conditions attached to this permit amendment. Specific Permit Conditions: 1. The Northampton Department of Public Works (DPW) understands that the applicant and owner are proposing to proceed with construction work that would be covered under an Amendment to the Stormwater Management Permit issued for 263 King Street-Lia Honda Vehicle Storage on April 27, 2006 and that the previously issued Amendment to the Stormwater Management Permit issued for 263 King Street-Lia Kia on September 10, 2009 is no longer applicable. The DPW hereby revokes the Amendment to the Stormwater Management Permit issued on September 10, 2009. 2. Previously, the DPW had required that the applicant confirm with As-Built Plans and revised drainage calculations that the Lia Honda Vehicle Storage project had been completed in accordance with the approved plans and specifications. Lia Honda Additional Parking As-Built Plans dated August 13, 2009 as well as revised Drainage Calculations dated October 2, 2009 were submitted to the DPW by Mark A. McClusky, P.E., Huntley Associates, P.C. The DPW reviewed the As-Built Plans and Drainage Calculations and discovered that the stormwater management system and the parking lot islands at 263 King Street had not been constructed in accordance with the approved plans and specifications and the stormwater management system was not functioning according to the approved design. Particularly the post-construction peak runoff rates from the site were not in compliance with the requirements of the Northampton Stormwater Ordinance or the approved Stormwater Management Permit. The proposed Lia Kia Site Plans and Drainage Report from June 21, 2012 indicate that post- development peak runoff rates will be less than pre-development runoff rates for all design storms and all design points. However, there is additional information and revisions that are required to confirm that the proposed stormwater system will function according to design. The DPW requests that within 30 days of the issuance of this Amendment, the following information must be submitted to the DPW for approval in the form of revised plans and documentation: a. The design of the subsurface detention/infiltration system has been proposed with an outlet through an existing catch basin to the drain line. The subsurface detention basin must have a direct piped connection to a drain line preferably at a manhole. The plans must be revised to show this connection. b. The plans must be revised to specify the elevations and details of the outlet structure of the subsurface detention/infiltration system consistent with the specifications in the drainage calculations. c. A soils investigation (by a Certified Soil Evaluator or Certified Professional Soil Scientist) must be conducted and documentation submitted to the DPW for approval including test pits or other tests at the location of the proposed subsurface detention/infiltration system. Information must be submitted to the DPW verifying the soil conditions, the elevation of estimated seasonal high groundwater, and how the proposed rate of infiltration was calculated. Stormwater Permits Internal\Permits_Active\King St 263 Lia Honda Vehicle Storage\0263 King St -Lia Honda_ Amendment 2.doc Page 2 of 3 infiltration is proposed, the soil test must demonstrate a separation of at least two feet between the bottom of the structure and the elevation of estimated seasonal high groundwater. If the soils investigation reveals groundwater or soil conditions inconsistent with the proposed design of the subsurface detention/infiltration system, the applicant must submit an alternative design to the DPW for approval. d. Sheet 6 of the Site Plans shows three enlarged parking lot islands and refers to Note 1. Landscape (Grass or Ground Cover). This note must be revised to specify only grass to be consistent with the drainage calculations. e. Sheet 7 of the Site Plans includes a note: "Remove Detention Basin. Grade to Sheet Flow," in the southeast corner of the site. Additional spot grades are necessary to clarify how the area will be graded. 3. The proposed stormwater management system and site work is designed to mitigate peak stormwater flows. If, after construction of the proposed project, the site is found to increase or concentrate stormwater flows to adjacent properties or roadways, the owner shall redesign and reconstruct the drainage system to prevent any increased stormwater flows to adjacent properties. 4. Construction plans shall be submitted to the DPW for approval prior to the start of construction. The construction plans will be reviewed by the DPW for additional information and consistency with the approved plans and specifications. 5. A Stormwater Management Operation, Maintenance and Inspection Agreement was recorded on November 21, 2006 for the Lia Honda site. This Agreement must be amended or a new Agreement recorded that includes maintenance and inspection items for all new components of the proposed stormwater management system. Lia Kia and Lia Honda must continue comply with all future operation, maintenance, inspection, and reporting requirements of the approved stormwater management systems or face notice(s) of violation and fines for non-compliance. In accordance with the Stormwater Management Permit, annual reports that are stamped by a Registered Professional Engineer documenting the actions completed as required by the Operation, Maintenance, and Inspection Agreement shall be submitted to the Northampton Department of Public Works by October 1st of each year. cc.
