Director Pg.1/2 Memorandum To: St. Elizabeth Ann Seton Parish CC: Mark Darnold, P.E., The Berkshire Design Group From: Doug McDonald, Stomwater Management Coordinator Date: September 20, 2012 Re: Status of St. Elizabeth Ann Seton Parish Stormwater Management Permit Compliance On April 14, 2011 a Stormwater Management Permit for the St Elizabeth Ann Seton Parish project was issued by the Department of Public Works (DPW). On August 16, 2012 the DPW received a set of Plans for St. Elizabeth Ann Seton Parish, New Parking Lot Phase 1, Sheets L1, L2, L3, L5, L6, L7, dated August 1, 2012, stamped by Mark B. Darnold, P.E., The Berkshire Design Group, Inc. and a letter dated August 15, 2012 from Mark Darnold, P.E. The Berkshire Design Group, regarding New Parking Lot—Phase 1. The DPW has reviewed the Phase 1 plans and other correspondence and is satisfied that the plans are consistent with the approved plans and specifications for the project. However, the DPW finds that all the conditions of the Stormwater Permit are not in compliance at this time. Particularly, the DPW requests that the following conditions be satisfied: 1. Prior to the start of construction or issuance of a Building Permit, the applicant shall record an executed Stormwater Operation, Maintenance, and Inspection Agreement that is binding on all subsequent owners of land served by the private stormwater management facility by recording it in the land records of the Registry of Deeds. The maintenance schedule and responsibility for maintenance of all components of the proposed stormwater management system must be adequately specified in Attachment A to this Agreement. The Stormwater Operation and Maintenance Plan submitted as Appendix D in the Stormwater Drainage Report must be revised as necessary and approved by the Northampton DPW. This agreement shall be approved by the Northampton DPW and signed by the owner and the Mayor of Northampton. Chapter 281 of the Northampton Stormwater Management Ordinance provides additional guidance for the requirements of this agreement. 2. This project will be required to submit one or more Notice of Intent (NOI) to the U.S. EPA for coverage under the NPDES Stormwater Construction General Permit. A copy of Pg.2/2 the final NOI and Stormwater Pollution Prevention Plan (SWPPP) shall be submitted to the Northampton DPW for approval prior to the start of construction and prior to issuance of a building permit. 5. Prior to the start of construction of the proposed subsurface dry wells and subsurface detention basins, the applicant shall: a. Notify the DPW of the expected start date of construction of these structures for inspection by the DPW b. Submit to the DPW for approval, the results of laboratory testing using an appropriate ASTM testing method that demonstrates the stone to be utilized for the subsurface dry wells and subsurface detention basin will meet the specified 40% minimum void space c. Submit to the DPW for approval, written confirmation by a Professional Engineer of Record in the Commonwealth of the soil textures, soil types, and the elevation of seasonal high groundwater at the location of each of the proposed dry wells and subsurface detention basins.
