DECISION OF THE ZONING
BOARD OF APPEALS

On December 8, 1976, the Zoning Board of Appeals for the
City of Northampton decided to grant the petition of Gladys
Lamoureux for a variance to construct a single family home.
Based upon evidence presented to the Board, the Board
made the following findings:
1. There exists a special hardship owing to circum-
stances relating to the soil conditions, shape or
topography of such land or structures, but not
affecting generally the zoning district. The lot
in question complies with all requirements of the
zoning ordinance except the frontage line requirement.
This condition was aggravated by a county land tak-
ing to construct a road.
2. The desirable relief may be granted without substan-
tial detriment to the public good. The lot has
sufficient square footage to meet all other require-
ments.
3. The desirable relief may be granted without nullifying
or substantially derogating from the intent of zoning.
The variance is from only one of the dimension require-
ments and the use of the premises is in conformity with
the zoning ordinance.
The variance is granted subject to the home being constructed
in conformity with all other requirements of the zoning ordinance.

Gladys Lamoureux
December 8, 1976
The meeting to decide on the application of Gladys Lamoureux,
79 Reservoir Road, Leeds, for a variance to construct a single
family home, was called to order at 7:30 PM in the Hearing Room,
City Hall, by the Chairman, Charles W. Dragon.
The minutes of the public hearing, held on November 17, were
read and approved unanimously. The public hearing had been
advertised in the Daily Hampshire Gazette on November 3 and
November 10, 1976.
Mr. Dragon made the following findings:
o A condition affecting this parcel of land resulted from
the County's taking of a portion of the property to con-
struct a road. This taking reduced the property's
frontage so that it lacks the number of feet needed to
comply with the zoning ordinance.
o The lot has sufficient square footage to meet all other
requirements so there will be no detriment to the public
good.
o Since the lot in question is located in a Rural Residence
zone, a single family home is allowed, therefore, granting
the variance will not derogate from the intent of the
zoning ordinance.
Mr. Capers found that the special conditions affecting the
parcel, particularly the shape of the lot, did cause hardship.
He said that the intended use will not nullify the zoning ordi-
nance, nor derogate from its intent.
Mrs. McFarland, after being assured that the home would be
located on the lot in accordance with the submitted plans, found
that the topography of the property made it unsuitable for sub-
division, and also that since the lot width and depth requirements
could be met, there would be no derogation from the intent of the
zoning ordinance.
Mr. Capers moved to vote on the matter. Mrs. McFarland
seconded the motion, and the vote was unanimous to proceed.

The Board then voted unanimously to grant the variance on the
condition that the petitioner build the home in accordance with
the requirements of the zoning ordinance.
The meeting was adjourned at 8:00 PM. Present and voting
were Charles W. Dragon, Chairman, and Associate Members Jeanne
McFarland and Raymond Capers. Also present were Mr. and Mrs.
Lamoureux, Mr. and Mrs. Lynds, and Clare Fennessey, Clerk.
