Puchalski Municipal Building, 212 Main Street, Northampton, Massachusetts. Present were Members: Chair Mason Maronn, Allan Doe, Michael Reed, William Rosen and Susan Roy (7:48 p.m.). Staff. Senior Planner John Bennett and Board Secretary Laura Krutzler. t Brisson was present and sought informal direction from the Conservation Commissio as to how t roceed to obtain permission for maintenance work in proximity to wetland s at the Leeds drivi range. (Assessor's Map 11A, Parcel 58) Members advised Brisson to le a Notice of Intent with t oal of setting up a regular maintenance plan for the property. Chair Maronn opened t eeting at 7:27 p.m. Minutes - Krutzler made a minor correction to the minbUs of De ber 7,1998. Rosen moved to accept the minutes as amended. Reed seconded. The n passed unanimously 4:0. At 7:29 p.m., Maronn opened the Public Hearing on a Reque for Determination filed by Christopher L. Frank for ongoing , ptar seasonal maintenance to serve approved drainage patterns, including patching holes and $lifter areas with gravel and regrading ' hin the buffer zone of a brook, at 50 Cooke Avenue, also known as Northampton Assessor's Ma 8C, Parcel 34. Christopher Frank explained- -that the request was for routine maintenance he normally did e h year. Bella to see if the placement of fill will have an impact on any wetland resource area on Coles Meadow Road, also known as Assessor's Map 8, Parcel 63. The applicant was not present. Maronn commented that, when they were talking about the placement of fill, usually the Commission received a plan showing where the fill would be placed. Bennett clarified that Mr. Bella had been trying to establish the buildable nature of the lot, but there were a number of problems. The lot does not meet the minimum lot width requirement, and the back of the lot is high, even ledgy, while the front of the lot is lower, and standing water and wetland vegetation are present. Also, various things had been deposited there, including concrete in liquid form, Bennett reported. Maronn said he would say members needed to visit the site. Bennett said it was not a tremendous wetland area, but it certainly seemed to be enough to qualify as a wetland under the local wetland ordinance. Maronn directed staff to either contact the applicant or send him a letter advising him that the Commission needed a plan with the wetlands delineated and contours in order to make a responsible determination. Bennett noted that the applicant would need a Variance for the lot width requirement. Roy moved to continue to January 11, 1999 at 8:40 p.m. Reed seconded. Puchalski Municipal Building, 212 Main Street, Northampton, MA. Present were Members: Acting Chair Michael Reed, Allan Doe, Frank Fournier, III (7:21 p.m.), Jim Kaplan and William Rosen. Reed opened the meeting at 7:05 p.m. Brook Nominee Trust. George Koho d two other abutters of property at 80 Leonard Street (Dan Keith another man who did not identifykimself for the record) were present to discuss issues relate the development of property owned by t eaver Brook Nominee Trust. Specifically, Koh asked how the appeal of the wetland delineation ted to the recently- submitted forestry c ing plan? Kohout said he had spoken to Bennett regardin e cutting plan and was under t mpression that the cutting plan could not proceed until the appeal w esolved. Kohout sai a had also spoken to a person from the Department of Environmental Prote ' n (DEP) wh ould not give him a good answer as to whether the cutting plan could proceed wit ho the solution of the appeal. Kohout said he was hoping to find out the Commission's position a hether the logging could proceed. Kohout added that he had talked to the P4artment of Envir ental Management (DEM) forester, Jennifer McDonald, and she could t answer the question of ther cutting could proceed. Reed said the Commissio ad only advisory input to the cutting plan, so lteqid not think they were the right Board. Fournier commented that it wouldn e any different from a truc acking up to a gasoline station. Gas would be worse than this, he obse ed. Kuzdeba said the Department of Public Work DP was in the process of sending final plans to DEP for approval and hoped to have constructio ompleted by December of 1999. At 8:48 p.m., Reed opened the Continuation of a Public Hearing on a Request for Determination filed by Christopher J. Bella to see if the placement of fill will have an impact on any wetland resource area on Coles Meadow Road, also known as Assessor's Map 8, Parcel 63. Reed read the legal notice. Christopher Bella was present. Reed confirmed that the Commission had not yet received a plan. He and Bennett explained that the Commission needed information as to the topography of the land, the location of wetland boundaries, and the location of proposed fill in order to make a determination. Bella said he had received information from his broker that people had looked into this before, and there were no wetlands there. He said he thought they might have talked to an environmental 7 engineer. 11V, Rosen suggested that the applicant find out who they spoke with. Bella expressed confusion about the process for obtaining a delineation, and Reed explained that an engineer or a wetlands specialist should delineate the wetland boundary. He indicated that the City did not generally perform delineations. Bennett described the site as high and ledgy in the back and low in the front. He said it also looked as if some material had been deposited there. Bennett advised the applicant of other constraints of the site, namely, that the lot did not meet the minimum lot width requirement and that the only place where a house could be located was right in the middle of the wetland. Bella noted that there was a house on the adjacent lot which was located in basically the same place. Rosen suggested that there might be a delineation on file from when that house was constructed which might extend across the lot boundaries. Bennett said he would research the activity on the adjacent lot and told the applicant to give him a call. The applicant indicated that he would like to continue the hearing for a month. Kaplan moved to continue the Public Hearing to February 8,1999 at 7:30 p.m. Doe seconded. The motion passed unanimously 5:0. At 8:58 p.m., Reed opened the Continuation of a Public Hearing on a Notice of Intent filed by Matthew M. Pitoniak for the construction of a medical office building and associated parking within the hundred -foot buffer zone of the Barrett Street marsh on property located at Lot 6, Carton Drive, Northampton, also known as Assessor's Map 2413, Parcel 46. Reed read the legal notice. David Loring, P.E., of Almer Huntley, Jr. and Associates noted that the previous hearing had been continued to await comments from DEP. He noted that DEP's comments had been faxed to him today, and he had nine sets of revised plans which addressed those remarks. In response to DEP's request to explain how storm water would be pretreated prior to infiltration, Loring reiterated that drainaga from the front of the site would be picked up by a trench drain and a deep -sump catch basin before flowing to the rear of the site into a water quality swale leading to the infiltration pond. Any storm water entering the infiltration pond would have been treated long enough so that suspended solids would have settled out, he commented. Kea At 7:44 p.m., Maronn opened the Continuation of a Public Hearing on a Request for Determination filed by Christopher I Bella to see if the placement of fill will have an impact on any wetland resource area on Coles Meadow Road, also known as Assessor's Map 8, Parcel 63. Krutzler reported that she had spoken to the applicant, and he had verbally informed her that he wished to withdraw his application. Bella said he would forward a letter formally requesting withdrawal, she said. Roy moved to accept the verbal request for withdrawal pending a letter confirming his intent. Kaplan seconded. The motion passed unanimously 4:0. Acceptance of Bid for LaPalme Conservation Area. Bennett advised members that there was a bid process for mowing the meadows and keeping the trails open at the LaPalme Conservation Area, and there was one bidder, who bid $100 for the job. (He would pay the Commission the money for the hay.) Roy said that, until they were familiar with the guy, she would just as soon give him a three -year contract, and then, if things worked out, they could give him a five -year contract. Roy moved to accept the bid for three years. She said that if the arrangement worked out, the Commission would give a fi- a -year contract next time. Kaplan seconded. The motion passed unanimously 4:0. Carlon Drive Subdivision Detention Pond Complaint. Former City Councillor Michael Kirby was present to convey his concerns regarding the functioning of the detention basin for the recently - constructed Carlon Drive subdivision. Particularly, Kirby expressed concern about the level of the detention pond and the fact that, if there were another rain storm, drainage would flow directly to the marsh. Kirby said his concern was that, in wintertime, the pond was half - filled with ice, resulting in three feet of ice or water and only about a foot [of remaining storage capacity] before the water spilled over into the marsh itself. He noted that this prevented the benefit of water quality treatment of drainage before its discharge to the marsh. Kirby stated that, with the present situation, the first flush was coming off the parking lot, and there weren't any gas catchers in the manhole... Kirby also said the water wasn't moving at this point, since he'd dropped a stick in and it did not move. He commented that the blockage was between the outlet of the detention pond and the main body of the creek, which was about 100 yards away. He observed that there was no real channel [in this location]; rather, it was like [the detention basin] 3 ...
