A subsequent site visit revealed that the septic system installation was not done according to plan. There were significant tree roots and brush left within the buffer zone of the wetland as shown on the plan entitled "Plan of Proposed Sewage Disposal System prepared for John Skibiski to be located at 160 Coles Meadow Road, Northampton Massachusetts," dated 10/30/98 and revised 12/28/98. There was no loam and seed over the repair area. Further delays in rectifying this problem may constitute a violation of the Wetlands Protection Act. Puchalski Municipal Building, 212 Main Street, Northampton, Massachusetts. Present were Members: Chair Mason Maronn, Vice Chair Michael Reed, Allan Doe, Jim Kaplan and William Rosen. Staff: Senior Planner John Bennett and Board Secretary Laura Krutzler. Maronn opened the meeting at 7:03 p.m. Reed noted a nkor correction to the minutes of June 22, 1998. Particularly, he said that, before, parking wrapped around the side and houses were in a little. Now, houses were right to the edge of the hundred foot buffer, and some of the decks were a little over. The limit -of -work line had moved a little closer to the wetlands but was still sixty feet from the wetlands at the closest point, he said. Kohl observed that as people customized their houses, they tended to expand out. They began to hit grade problems on one side of the project, so, in order not to do that, they shifted the project toward the other side. He noted that the project had moved fifteen to twenty feet closer to the wetland. Members discussed the impacts of the change. Bennett suggested the idea of permanent markers along the limit -of -work line. Kohl said he had had rebars made that said wetlands on them. Members asked him to bring them in to show them at some point. Members noted that the length of the limit -of -work line was two hundred and twenty feet, and Reed suggested that permanent markers be placed every seventy feet. Bennett marked the location of the markers on the plans. Reed moved to approve the changes to the plans [without requiring the filing of an amended Notice of Intent]. Rosen seconded. Chekej_,, Since Kohl was present, members noted that the detention basin had not been constructed for a proj ect on Turkey Hill Road. Kohl said the second driveway was not done either. Kohl offered to pass the word along to Todd Cellura but said that if members wanted to send a formal letter, that was okay with him. Maronn said the next step was an enforcement order. Bennett suggested sending him a nice letter. Maronn said the last sentence could be that the next letter would contain an enforcement order ordering Cellura to cease and desist unless drainage structures were installed according to plan. Bennett asked if members wanted any kind of time line? Commissioners decided to give Cellura until their next meeting (May 24') to complete the work. Greg Stone -160 Coles Meadow Road. Greg Stone was present to lodge some complaints about the work to install the septic system at his property on Coles Meadow Road. Particularly, Stone said that the tank had been put in the wrong place, and the area had not been reseeded. He said the work was done in the winter, and he never saw it because it snowed. He said the land was just covered with hay, and no seed was ever put 7 down, and you could see where soil had washed away. Stone said there was also an area where workers topped some trees and left stumps in the ground. scanne" /;? /v -; , Jigitizec— _ . _ He said Huntley was the engineer and Skibiski was the former owner. ; perked Bennett reminded Commissioners that the work had been an after - the -fact filing over the winter. Kaplan asked what Stone would like them to do, and Stone said he would like somebody to come in, put top soil where the dirt had washed away so badly, and seed. Maronn said the only way he knew to get rid of roots was to throw gallons of gas on them and light them up, but other members pointed out that it was no longer burning season. Maronn noted that a Cease and Desist order had to be issued to the owner of the property, so if they issued one, it would have to be to Stone, who would then have to go after the contractor. Stone said he thought Skibiski had put the tank where it was convenient for them... He said he had written to Huntley, and they had said their contract was not with him, [so they had no responsibility to repair the area]. He said he asked them to take some off the closing costs, but they declined. He said he talked to Skibiski and asked if Huntley was going to take care of the area, and Skibiski said he didn't think so. Maronn reviewed the determination, noting that Commissioners had issued a Negative Determination checking Box #3, with the condition that disturbed areas must be seeded and the silt fence must remain in place until the seed is established. Bennett noted that the applicant was Skibiski. Maronn said he supposed they would have to issue an enforcement order to Skibiski. Maronn suggested [first] sending a friendly letter addressed to Skibiski with a copy to Andrew Kawczak at Huntley. He suggested acknowledging the complaint of the landowner about the repair of the septic system and continuing as follows: "A subsequent site visit has revealed that the septic system installation was not done according to plan. SITE CONDITIONS The existing septic system under study does not meet Title 5 requirements and requires an upgrade. The site is located at 160 Coles Meadow Road, Northampton, MA. Coles Meadow Road connects with Route 5/10 near the Massachusetts State Police Barricks. See attached plans. The existing home is located on a gently sloping piece of land with slopes of approximately 1 - 3 percent. The current septic system is adjacent the house, southerly side. WETLAND DELINEATION On October 21, 1998, Andrew I Kawczak a wetlands scientist working for Almer Huntley Associates performed a wetlands delineation of the parcel. The results of the delineation are shown in the table below and on the attached drawing. The delineation was performed in accordance with the Massachusetts Wetlands Protection Act 310 CMR 10. Wetland vegetation, topography and general hydrology was used to evaluate the site. The site was reviewed for the normal signs of wetland vegetation associated with low lying wetland areas. The Bordering Vegetated Wetlands (BVW) were evaluated using the 50% vegetative criteria specified in the Massachusetts Wetlands Protection Act (MGL Chapter 131, Section 40) and its' resulting regulations (3 10 CMR 10.0). (i.e., Section 10.55 (2) (c) of the regulation states "The boundary of Bordering Vegetated Wetlands (BVW) is the line with which 50% or more of the vegetational community consists of wetland plant indicator plants and saturated or inundated conditions exist. ") %.r -"Pool The wetland area was evaluated for the presence of hydrophytes and an inventory developed. The wetland indicator status for each species was determined using the '- "National List of Plant Species That Occur in Wetlands" for the state of Massachusetts 1988 distributed by Massachusetts Department of Environmental Protection Division of '- Wetlands and Waterways dated April 1995. - The land in the westerly direction slopes to the rear of the parcel where a flat area supports an intermittent stream and Bordering Vegetated Wetland. The following terminology is used to explain the indicator status and the frequency of occurrence for each species. Obligate (OBL) - Always found in wetlands under natural (not planted) conditions (frequency greater than 99 %), but may persist in non wetlands if planted there by man or in wetlands that have been drained, filled, or otherwise transformed into non wetlands. Facultative Wetland (FACW0 - Usually found in wetlands (67% - 99% fre uenc but occasionally found in non wetlands.
