Negative Determination
Note: No further action under the Wetlands Protection Act
is required by the applicant. However, if the Department of
Environmental Protection is requested to issue a Supersed-
ing Determination of Applicability, work may not proceed
on this project unless the Department fails to act on such
request within 35 days of the date the request is post-
marked for certified mail or hand delivered to the Depart-
ment. Work may then proceed at the owner's risk only
upon notice to the Department and to the conservation
commission. Requirements for requests for Superseding
Determinations are listed at the end of this document.

0 Appeals
The applicant, owner, any person aggrieved by this Determina-
tion, any owner of land abutting the land upon which the
proposed work is to be done, or any ten residents of the city or
town in which such land is located, are hereby notified of their
right to request the appropriate Department of Environmental
Protection Regional Office to issue a Superseding Determina-
tion of Applicability. The request must be made by certified
mail or hand delivery to the Department, with the appropriate
filing fee and Fee Transmittal Form (see Appendix E: Request
for Departmental Action Fee Transmittal Form) as provided in
310 CMR 10.03(7) within ten business days from the date of
issuance of this Determination. A copy of the request shall at
the same time be sent by certified mail or hand delivery to the
conservation commission and to the applicant if he /she is not
the appellant. The request shall state clearly and concisely the
objections to the Determination which is being appealed. To the
extent that the Determination is based on a municipal bylaw,
and not on the Massachusetts Wetlands Protection Act or
regulations, the Department of Environmental Protection has no
appellate jurisdiction.

PUBLIC HEARING NOTICE
The Northampton Conservation Commission will conduct a meeting on Monday, October 23,
2000 at 7:00 P.M. in Hearing Room 18, City Hall, 210 Main Street, Northampton, at which
time Public Hearings will be conducted on the following, as required under M.G.L. Chapter 131,
Section 40, The Wetlands Protection Act and Chapter 24 of the City of Northampton's
Ordinances, Wetlands Protection
7:30 P.M. - Public Hearing on a Request for Determination filed by Sandra Yell to replace a
failing septic system for property located at 214 Riverbank Road, also known as Northampton
Assessor's Map 25, Parcel 12. Work will take place within the floodplain of the
Connecticut River, but there will be no change to finished grades.
7:40 P.M. - Public Hearing on a Request for Determination filed by the Northampton
Department of Public Works for drainage improvements within the roadway and adjacent to
the roadway within the buffer zone of a stream and Bordering Vegetated Wetland for
property located at 206 Coles Meadow Road, also known as Assessor's Map 8, Parcel 40.
Work will include the installation of two new catch basins, plugging an existing culvert under
Coles Meadow Road, and removal of an existing paved waterway.
7:50 P.M. - Public Hearing on a Request for Determination filed by the Northampton
Recreation Department to install guardrails and speed bumps along entry roads and parking
lots to control traffic, and to remove a portion of paved parking and replace it with grass at
Maines Field - Riverside Drive, also known as Assessor's Map 23C, Parcel 31. Possible
resource areas affected include the 100 -year floodplain of the Mill River, Bordering Land
Subject to Flooding and Riverfront Area.
8:00 P.M. - Public Hearing on a Notice of Intent filed by the Massachusetts Highway
Department/Northampton Department of Public Works for wetland replication associated
with the proposed replacement of the Old Springfield Road Bridge over the Mill River
Diversion, also known as Assessor's Map 45, Parcel 31.

Area consists of a low area on Coles Meadow Road, where untreated stormwater currently flows off
of the road via a paved waterway into an adjacent wetland. Stormwater flows have been damaging
the property owner's land because an existing pipe, under the road, has been blocked and no longer
functions The wetland located down - gradient to the worts is adjacent to an in termittent brook.

a new berm along the edge of the road, installation of two new catchbasins (with 4' sumps for water
quality) and a new armored stormwater outfall, the removal of a paved waterway, and the installation of a
