Request for a Determination of Applicability
Massachusetts Wetlands Protection Act, G.L. c.131 §40
1. 1, the undersigned, hereby request that the Northampton
Conservation Commission make a determination as to whether the area, described below, or work to be
Performed on said area, also described below, is subject to the jurisdiction of the Wetlands Protection
Act, G.L. c. 131, §40.
2. The area is described as follows. (Use maps or plans, if necessary, to provide a description and the
location of the area subject to this request.)
A 2.2 acre parcel located on North King Street in Northampton
and appearing on Assessors Map 8 as Lot Number 22. The land
is bounded by Routes 5 & 10 to the west, an over -pass ramp
for Interstate 91 to the north, by Route 91 and a State buffer
zone for Interstate 91 to the east and south. The property
contains a stand of evergreen trees to the west, and low -lying
brush on the remainder of the property.
3. The work in said area is described below. (Use additional paper, if necessary, to describe the
proposed work.)
Berkshire Gas intends to construct, on a cement pad, a pre-
fabricated, 24' x 52 metal building on the northeast section
of the parcel. A gravel -based driveway is proposed to be
constructed from Route 5 & 10 to the building. The facility
will require no water, liquid storage or drainage. Small
amounts of fill will be required to shape and fill the access
road, and a minor amount of relocation, or "cut and fill" will
be done in the immediate area of the building location. See
site plan. It is the Company's expectation that generally no
environmental impact will occur as a result of this work. It
is also the Company's expectation that no particular impact
will occur to the "drainage ditch" located bevg5nd / the

ADDENDUM TO:
Request for a Determination of Applicability
to the Massachusetts Wetlands Protection Act, Form 1, Sec. 3

FILED: April 22, 1985
During construction on the parcel the contractor will
utilize, on a limited basis, a bulldozer, back -hoe,
dump truck, and several light vehicles. Contracting
crews will consist of equipment operators, masons,
pipefitters, welders, electricians, laborers and
landscapers. A certain amount of alteration of the
soil could create a temporary, muddy environment in
the immediate area of construction. To prevent any
run -off into the "drainage ditch ", as a result of this
temporary condition, a barrier of hay bales will be
established. Upon completion of the construction the
barrier will be disposed of and loaming, seeding and
landscaping will be performed to insure against soil
erosion into the "drainage ditch ".
