The area for which this determination is requested is located partially on Massachusetts Electric Company property on Haydenville Road in Leeds, (Assessors Parcel No. 6 -51 and a portion of 6 -6) and is shown on the attached locus map. The area in question is a small wet depression on the portion of Parcel No. 6 -6. This area receives the stormwater runoff from a parking lot constructed several years ago. The area is isolated from a larger apparently isolated wetland on the abutting property and is shown on the attached topographic worksheet. No work is proposed within 100 feet of the larger wetland, nor is there any intention to alter its watershed. At a recent site visit by the City's Planning and Conservation officers, it was observed that the area is not large enough to be considered isolated land sub- ject to flooding. It does function as a stormwater retention basin for the parking lot's drainage, and any change in the drainage characteristics of the site should be accomplished through an acceptable drainage design prepared by the applicant's engineer. The area is not a certified vernal pool, nor does it appear to possess a favorable habitat to be one due to the quality of runoff from it's principal watershed, (the parking lot), and it's small size (1200 S.F. + ). The water level in the depression may represent the regional groundwater level, and the area may be a wetland, but it does not border on an applicable resource area and therefore would not be subject to the Wetlands Protection Act. The site does not appear in the 1988 edition of the "Atlas of Estimated Habitat of State - Listed Rare Wetlands Wildlife" issued by the National Heritage and Endangered Species Program. Question U3 The applicant is beginning preliminary planning for an addition to the existing building, a new storage area to be located westerly of present facility, and an access road to reach the proposed storage area. These projects are in various design stages and will take place well outside of the 100' buffer zone which may exist around the area in question. Any changes to the hydrology of the site will be addressed by an overall drainage study done in conjunction with the access road design. At this time, the applicant wishes to spread fill and grade the area near this retention basin to enable him to temporarily relocate his utility pole storage area and to gain access for soil tests which are required for the access road design. The applicant, therefore, is respectfully requesting this determination to confirm his engineer's opinion that this area is not within the Conservation Commission's jurisdiction under the Wetlands Protection Act. Basins or lagoons which are part of wastewater treatment plants shall not be considered ponds, nor shall swimming pools or other impervious man -made retention basins. The water level of the pond on the abutter's property (379.9 feet) is low due to the time of year. Our estimate of its maximum lateral extent in the last ten years is based on Mr. McNiff's recollections, together with the field evidence of the higher water level. As far as we can determine, there is no historical data of this pond's water elevation. This area could also be isolated land subject to flooding, but in any case we do not propose to increase the flood level. We estimate that during times of high groundwater this pond will be raised about two feet in height to an elevation of 382 feet. This will increase the lateral extent of the pond's edge by as much as 25 feet, but the resulting area is only 9,500 s.f. Therefore we are asking the Commission to confirm our belief that this area is not a pond as defined by the Act. If the Commission determines that this pond is a resource area and that a buffer zone does exist, we have shown all the proposed work in that zone. Although this work may be in the buffer zone, the design and construction methods used will ensure that there is no adverse effect to this wetland. If this area is determined to be a buffer zone, the Commission can still grant a negative determination for this work in accordance with Section 10.00, V. A. of 310 CMR, which states: "Of course, anyone contemplating a project within 100 feet of a bor- dering vegetated wetland can forego this preliminary determination by simply filing a Notice of Intent, an option that may be appropri- ate in those cases where it is obvious that the proposed work will indeed have an impact on the wetland. Equally, where the applicant proposes to take appropriate engineering measures to prevent impact on a neighboring wetland (and fully documents such measures in the Request for Determination of Applicability), there is no legitimate basis for requiring a Notice of Intent." The original small retention basin will remain as an outlet for the existing parking lot drain. The applicant proposes to install a siltation barrier along the work limits. All grading and slopes are proposed to be revegetated and stabilized before the siltation barrier can be removed. Without management, the runoff from the hill which presently empties into this pond could be increased by the construction of the access road. For this reason, the applicant proposes to construct a new retention basin as shown. This basin will handle all of the additional runoff generated by the new road- way. Overland flow to the pond would also be reduced, but groundwater levels would be unchanged. We hope this additional information will be helpful to the Commission when making your determination.
