General Conditions 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory meas- ures, shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: (a) the work is a maintenance dredging project as provided for in the Act; or (b) the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or de- bris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until.all proceedings before the Department have been completed. 8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index'under the name of the owner of the land upon which the proposed work is to be done. In the case of registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is to be done. A sign shall be displayed at the site not less than two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Quality Engineering, File Number 246- 10. Concrete headwalls per attached plans to be built at the end of outfalls. Riprap and energy dissapators to,'remain unchanged. 2. Hydrant at the end of Winterberry Lane to be relocated in accordance to sketch submitted 1-16-85. 3. 8" ductile iron water main crossing at the brook to be constructed as follows: a. Water main to be placed within a steel sleeve (12" minimum diameter), approximately 12' long. b. Space between sleeve and water main to be grouted with a mixture of sand and cement (no stones).. C. No pipe joints to fall within the steel sleeves. d. No angle on water main at the crossing to exceed 450. 4. All sleeves for future utilities to be approved by each respective utility prior to construction. 5. Depression on northerly side of Winterberry Lane (Sta. 19+00+) to be filled in and the plans changed accordingly. 6. Drainage from Birch Lane to Winterberry Lane to cross water main at Winterberry at right angles and then proceed northwesterly and connect to proposed storm drainage at Sta. 19+00+, Pipe sizes to be adjusted accordingly. Street sign and stop_sign posts to be supplied by the developer and to be standard metal posts used by DPW throughout the City. 8. The January 16, 1985 letter from F.K. Sheehan to the Planning Board to become part of these conditions. 9. The waiver of the depth requirement of bituminous concrete on the proposed roadway within the subdivision from 5" to 3" is granted. 10. The waiver of the elimination of sidewalks within the proposed subdivision is granted. 11. Developer can use Cape Cod berms throughout the Subdivision. 12. The scale (1"=100' instead of 1"=40') of the lot layout plan (Sheet of 8) is acceptable. 13. The waiver for length of cul-de-sac regulations (500' maximum) for both Wi.nterberry Lane and Birch Lane is granted. 14. The developer has the right to reduce the lot frontage along the two cul-de-sac,s by 20% if the need arises. 15. Width of road from face of berm to face of berm to be 30' instead of 28'. The applicant shall provide the City with a Performance Guarantee, subject to approval of the Planning Board and City Solicitor prior to the commencement of construction. Said Performance Guarantee may take the form of either 1) a covenant or 2) a bond, deposit of money or negotiable security or a letter of credit in conformance with the provisions of Section 81-U of Chapter 41, MGL. Should the developer choose a bond, deposit of money or negotiable security or letter of credit, then the developer shall complete all. public roads and utilities nine months prior.to' expiration date of bond to enable the City to draw upon bond if necessary. The. monetary value of the bond shall be agreed upon by the DPW and shall be 100% of,the cost of completion as of the date the bond expires. 17. The developer shall notify in writing the DPW and Planning Board five days in advance of the date of commencement on construction, and subsequent phases of construction so that proper inspection can take place. 18. The developer shall grant to the City.drainage easements for all drainage pipes located outside the layout of the proposed streets shown on the submitted construction plans. Said easements to be approved by the City Solicitor. 19. The developer shall submit revised Definitive Plans with the above required changes, for the Planning Board's endorsement following the expiration of the statutory Appeal period (where no Appeal has been filed) and prior to the commencement of construction. 20. All lots are subject to Board of Health approval regarding sewage disposal. 21. All conditions imposed by the Conservation Commission shall become part of this order of conditions. 22. All roadways and common utilities within the Subdivision shall be completed within three years from the date of approval.
