June 13, 2013 Minutes The Northampton Zoning Board of Appeals Zoning Board Minutes of Meeting June 13, 2013 City of Northampton Hearing Room 18, 210 Main St, Northampton Malcolm Smith Presiding as Zoning Board Administrator 4:00 PM Malcolm Smith opened the meeting and noted that there was no public comment. Smith opened the Request for residential finding for expansion at 37-39, 41 Woodbine Ave, Northampton, Map Id 25A-153, 154. Connie Fender, applicant, described the project which included modifications to both the front building and the rear building. There was no public comment. Staff described the encroachment of the egress into the side yard setback. New encroachments would not be allowed and recommended conditions that this egress be modified. Malcolm Smith closed the hearing and issued the Finding with the condition that there be no further encroachment into the sideyard setbacks. 4:10 Adjourn City of Northampton Council Chambers, 212 Main St., Northampton, MA Members Present: Time  Chair, David Bloomberg  Vice Chair, Malcolm B. “Barry” Smith  Sara Northrup Bob Riddle, Assoc. Upon noting that there was no general public comment, David Bloomberg opened the request for the special Permit for home business-dog boarding at 960 Park Hill Rd, Florence Map Id 49-11. Caroline Moore presented the application and a list of signature obtained from butters that showed support for her permit application to board dogs. Malcolm Smith asked if there was any intention to sell goods from the premise. Moore replied no. David Bloomberg asked if the animals would ever be left alone? More stated that they would be for short periods only. Smith asked if the operation would be 24/7? Moore stated she would be there 24/7 but pick up and drop off would be during normal business hours. Elizabeth Silver asked if 7 AM to 9 PM would be acceptable for time limitations for drop off? and she confirmed that up to 5 dogs were being requested. David Bloomberg asked why this was not considered a kennel? Staff clarified that because there were no employees and this was accessory to a residence it fit better under home business. Elizabeth Silver noted that kennels typically also have sales of other items. Sara Northrup asked about the wet area of the parcel. David Bloomberg asked about signage? Moore stated she hadn’t decided but it would be within the context of what the zoning allowed. Sara Northrup noted that signatures were from all the surrounding abutters. Upon motion by Malcolm Smith and second by Elizabeth Silver, the Board voted unanimously to close the hearing. Upon motion by Sara Northrup and second by BS, the Board voted unanimously to approve the permit with the condition that drop off and pickups be between 7 AM and 9 PM. The Board discussed minutes of 5-9. Upon motion by BS and second by Elizabeth Silver, the boared voted unanimously to approve the minutes.
