The landowner must still sign the original Forest Cutting Plan, and any major amendments. It is important to understand that the landowner remains responsible for ensuring that the statutes are followed, and any fines for non - compliance still apply to the owner of record. Having an agent is not required. If you appoint an agent, any correspondence will be sent to both you and your agent. Based on details of the Plan and information in the NHESP database, the NHESP has determined that there is potential for activities proposed in the Plan to result in "Take" (as defined in 321 CMR 10.02) of Wood Turtle (Glyptemys insculpta), a species listed as Special Concern pursuant to the Massachusetts Endangered Species Act (MESA) (M.G.L. c. 131A) and its implementing regulations (321 CMR 10.00). Local populations of Wood Turtle are centered on perennial streams, rivers, and associated ponds and swamps, where individual turtles spend the winter months.relatively dormant under the banks or at the bottoms of the wetlands. During early spring, Wood Turtles become more active and begin to'spend time on land. Terrestrial habitats used during spring fall include upland forests, shrublands, and fields, where the turtles seek food and appropriate shelter. Although recent research suggests that most individuals inhabit areas' <330 feet from a wintering stream or wetland, some individuals will stray much farther (e.g., >1,000 feet) to reach preferred field habitat or suitable nesting habitat (i.e., open areas with loose or exposed soil). Most nesting in Massachusetts occurs during June, with hatchling turtles dispersing through uplands in search of wetlands during late summer -fall. Presence of Wood Turtles is not always observable, as individuals may spend periods of time hidden under vegetation, logs, leaf litter, or other ground -level substrates. Marble Brook, its associated wetlands, and the upland forest surrounding the wetland complex are classified as habitat of Wood Turtle. Therefore, there is concern that harvesting activities will result in direct mortality of individual turtles (e.g., as a result of crushing by motorized vehicles) if conducted during spring -fall. To avoid prohibited Ti ake,of Wood Turtle, the NHESP requests that the following language be added to the Plan prior to its approval: • Operation of motorized vehicles in.the area 0 -50 feet from Marble Brook and its associated wetlands shall occur only during the time period beginning November 15 and ending February 28. • Operation of motorized vehicles in remaining portions of the harvest area shall occur.only during the time period beginning November 1 and ending March 31. The practices listed above are designed to coordinate operation of motorized vehicles at the site with times that Wood Turtles are unlikely to be present in uplands. Please note that SC -4 must be bridged as currently indicated in the Plan; any alternative method of crossing this stream must be approved in writing by the NHESP. Please also note'that there may be options for operating motorized vehicles year-round in portions of the site that do not coincide with Priority Habitat. However, such options could include . requirements that the boundary of Priority page 1 of 2 www.nh 4X Natural Heritage & Endangered Species Program North Drive, Route 135, Westborough, MA 01581 Tel: (508) 389 -6360 Fax: (508) 389 -7891 NHESP No. 09 -27529 I January 26, 2010 - .. .. page 2 of 2 Habitat - be marked clearly in the field and that the landing be relocated to an area farther from Marble Brook. With this in mind, the landowner, plan preparer, and operator should be advised that the.boundary of Priority Habitat currently depicted in the Plan is outdated and inaccurate (as of 30 September 2008). The latest version of Priority Habitat is available in the 13th Edition of the Natural Heritage Atlas, online at the NHESP website, or through MassGIS. Lastly, please note that operation of motorized vehicles on maintained roads is exempt from the seasonal requirements described above, pending; written approval by the NHESP Generally, a maintained road is a lawfully - — - -- - -- - constructed- roadway - that,- in the- opinion of the NHESP is -in -a- condition- that is- uncharacteristic of- habitat. -In--- - - -- - - -- - -- - - determining whether a road meets this definition, the NHESP shall, in part, judge whether the roadway is (a) compacted soil /gravel or an otherwise impervious (e.g., paved) surface, and (b) predominantly free of vegetation, leaf litter, duff, and/or other biotic features. The NHESP may rely on information provided by the landowner and/or by you in making this determination: Please notify the NHESP if the landowner wishes to pursue the maintained road exemption. Please copy the NHESP on any proposed amendments to the Plan and on the approved plan for the site. If you have any questions about this letter, please contact Jacob Kubel at (508) 389 -6373.
