Construction of the driveway is the only portion of the project which will directly impact the existing wetland resource area. All other aspects of the project will be limited to the buffer zone. Note that although the parcel address is in West Hatfield, the rear portion of the property is in Northampton. A Notice of Intent will also be filed in Hatfield. Existing Conditions The subject site is presently an undeveloped parcel consisting of a periodically mown field at the front of the property and a steep wooded hillside at the rear. The front half of the site is generally flat, sloping slightly uphill to the west. An existing drainage ditch close to Linseed Road helps facilitate drainage of the front field. The ditch bisects the site from north to south and is culverted under Linseed Road near the southeastern corner of the property. This parcel was formally part of a larger property that was farmed in some capacity. The delineated wetlands separate Linseed Road from the buildable, upland portion of the site at the back of the field. The wooded rear half of the site will remain undeveloped. Proposed Construction The project involves the construction of a single - family home and septic system. The driveway and septic system are the only portions of the project which will disturb portions of the wetland and associated buffer zone. A 12' wide bituminous concrete driveway from Linseed Road is also being proposed as part of this project. To access the buildable portion of the site at the rear, the driveway must cross a portion of the wetlands which separate the front and rear portions of the property. The driveway will be of minimal width and is designed to disturb the least possible amount of wetland resource. A culvert has been designed at the location of the crossing to permit continued and unobstructed water movement through the wetland. It is also proposed as part of this project that the area of disturbed wetland, all of which is located in West Hatfield, be replicated on site in conformance with the "Massachusetts Replication Guidelines" DEP March 2002). Construction of the driveway is the only portion of the project which will directly impact the existing wetland resource area. All other aspects of the project will be limited to the buffer zone. Existing Conditions The subject site presently an undeveloped parcel consisting of a periodically mown field at the front of the property and a steep wooded hillside at the rear. The front half of the site is generally flat, sloping slightly uphill to the west. An existing drainage ditch close to Linseed Road helps facilitate drainage of the front field. The ditch bisects the site from north to south and is culverted under Linseed Road near the southeastern corner of the property. Proposed Construction The project involves the construction of a single - family home having a proposed footprint of 2450 square feet. A 12' wide bituminous concrete driveway from Linseed Road is also being proposed as part of this project. To access the buildable portion of the site at the rear, the driveway must cross a portion of the wetlands which separate the front and rear portions of the property. The driveway will be of minimal width and is designed to disturb the least possible amount of wetland resource. A culvert has been designed at the location of the crossing to permit continued and unobstructed water movement through the wetland. It is also proposed as part of this project that the area of disturbed wetland be replicated on site in conformance as per the "Massachusetts Replication Guidelines" DEP March 2002). The delineated wetlands on this property currently run roughly north to south and separate the frontage street, Linseed Road, from the buildable upland portion of the property. To access the upland portion, it is necessary to construct a drive that crosses the wetland and wetland buffer zones. While the applicant realizes that this is not a preferable situation, alternative means of access are not available. The abutting parcel to the north contains similar wetlands separating Linseed Road from the upland portion of the property. Additionally, the northern parcel is currently developed with a single - family home by a different property owner and alternative means of access to the project property from the north is not an option. The adjacent parcel to the south, while currently undeveloped, contains similar restrictions. The wetland from this project site continues to the south and expands as the topography flattens. Access to Linseed Road through this southerly parcel would disturb more wetland and wetland buffer than is being proposed with this project. While the front half of the project property is flat to gently sloping, an abrupt grade change occurs as one approaches the tree line across the center of the parcel. A steep wooded hillside characterizes the rear half of the property thereby restricting alternative means of access from the west. The applicant is fully aware of the limitations and restrictions on this property. In an effort to concentrate construction of a home and driveway to the limited buildable area available however, encroachment on the wetland buffer zone became unavoidable. The proposed project does disturb area within the 100' wetland buffer as well as a small portion of area within the 50' buffer, from which a variance from City Wetland Bylaws is being requested. The disturbance within the 50' buffer is necessary for the construction of a small portion of driveway. The applicant is restricted to the proposed site layout by the steep wooded hill to the west and the wetlands to the east. It is understood that disturbance of any wetland or buffer zone is not preferable and should be avoided if at all possible. However, the wetlands located on this parcel are characterized as wet meadows and are a result of the surrounding drainage patterns. This site was a former farm and remains to be periodically mown by others to maintain a low grass ground cover. While the value of any wetland merits protection, this particular wetland has significantly less value to wildlife and species diversity than do neighboring wetlands. The hydrological value of this wetland meadow is recognized as it serves to drain the adjacent lands. The driveway crossing and associated culvert have been engineered so as not to disrupt the existing flow of water. A replicated wetland has been proposed as part of this project that seeks to improve and enhance the species diversity of this particular wetland. The replicated wetland also proposes that the narrow drainage ditch that currently conveys water be widened to distribute the flow of water over a larger area minimizing the potential for soil erosion and displacement. It has been recognized that the proposed project is not an ideal situation. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his /her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and /or damage prevention controls it may deem necessary. Based on the information presented at the hearing, the NCC made the following findings in support of the denial of the application: Related to the significance of the resource areas on the site to the interests identified in the Northampton Wetlands Protection Ordinance and the Massachusetts Wetlands Protection Act: The NCC found that the Bordering Vegetated Wetland and 100' Buffer Zone to the Bordering Vegetated Wetland are significant to the protection of the following interests: agriculture, aesthetic value, wildlife and wildlife habitat, ground water, public and private water supply, flood control, storm damage prevention, erosion and sedimentation control. Related to the expected impacts of the project on those resource areas: The extent and location of the proposed work would cause adverse and undue disruption of an area consisting of steep slopes in a significant percentage of the Buffer Zone to a Bordering Vegetated Wetland, which in turn adversely affects the interests of the Massachusetts Wetlands Protection Act. Under the current proposal, these activities will result in adverse impacts to the resource area from stormwater runoff, erosion, siltation, loss of groundwater recharge, poor water quality, vegetation change and harm to wildlife habitat either immediately, as a consequence of construction, or over time, as a consequence of daily operation and the existence of activities. Related to the adequacy of the proposed mitigation measures: The application did not propose mitigation to prevent adverse impacts caused by work on the steep slopes within the Buffer Zone of a Bordering Vegetated Wetland, a resource area protected by the Northampton Wetlands Protection Ordinance. Furthermore, the proposed project leaves little opportunity for mitigation within the area of remaining undeveloped buffer zone on the parcel. Related to the speck proposal The Northampton Conservation Commission has denied the project proposal, but recognizes that the applicant may design a project on the parcel that is consistent with the regulations promulgated as a result of the Wetlands Protection Act and the Northampton Wetlands Ordinance. Further, the NCC recognizes that based on the application material, there is at least one option that may be approved with reasonable conditions that protect the interests of the Wetlands Protection Act and the Northampton Wetlands Ordinance. DONOHUE C Northampton Conservation Commission Policy on Work Within the Buffer Zone Effective October 23, 2003 Certain areas 50 to 100 feet from a wetland resource may be suitable for temporary, limited or Permanent disturbance as appropriate when the applicant can demonstrate to the Commission's satisfaction that the proposed work, activity or use will not affect wetland values singularly or cumulatively and, by means of a written and visual alternatives analysis, that reasonable alternatives to the proposed work or activity do not exist. The proposed project for the Murphy property, while disturbing areas within the 50' and 100' wetland buffers, proposes to be an improvement over the existing conditions. The current property and adjacent land is used for agricultural purposes with tilling, seeding and mowing occurring on an annual basis. Due to the amount of land area located within wetland boundaries and within the buffer zones, these areas are subject to continual disturbance. This disturbance includes but is not limited to, the prevention of vegetation maturation, erosion and sediment translocation, and soil disturbance. As mentioned previously, this project does proposed to alter and regrade some of the area within the wetland buffer zone in order o accommodate the driveway, residence and barn. This disturbance, however significant, will exemplify a permanent alteration and allow the remaining buffer areas to grow and mature undisturbed. Vegetation will be allowed to mature and the soils will be left in their post construction state minimizing potential erosion and sediment removal, as is the case currently. With the maturing of vegetation also come improvements to the provisions for wildlife habitat and to the diversity of the existing landscape. Currently the surrounding area is void of any significant vegetation over 1 -2' in height is limited to mainly herbaceous vegetation (see images included as part of the original NOI application). By allowing vegetation to mature and by introducing larger, native woody species, as shown in the wetland replication areas and along the proposed driveway, the value of the buffer zone will increase. The Commission may allow the alteration of up to 20 of the area within the 50 -100' buffer zone on a lot, or up to 2,000 square feet on a lot within a cluster subdivision. This is a total, cumulative allowance for all projects on a lot. This project does propose to disturb an access of 20% of the 50' and 100 wetland buffer zones (59 %). Of this amount, 26% of the 50' buffer zone is proposed to be disturbed and 97% of the 100' buffer zone is proposed to be disturbed. It is understood that these amounts are sizable under any circumstance. However, due to the limited amount of buildable land beyond either the 50' or 100' buffer zones, some disturbance is necessary. The driveway crossing alone consumes close to 2247 square feet alone. Construction further away from the resource areas was considered however it would have resulted in substantial excavation of the steep hillside located to the east and the removal of many of the existing mature trees and vegetation. It was determined that this was a more unfavorable solution and would create more disturbances to the existing condition than what is being proposed. A narrative describing other alternatives to the proposed project are included with the original NOI application. Notwithstanding the above, the Commission may allow work within the 50 foot non - encroachment zone (1) in certain circumstances, including in areas that are down- gradientof the wetland resource and on areas that are already degraded by impervious surfaces from existing structures or pavement, and (2) in certain zoning districts, including within the Industrial Park, where development will generally be allowed to within 10 feet of a wetland 0 resource, and CB, URB and URC outside of the WP and WSP overlay districts, where grading and native plantings will generally be allowed up to the 35 foot buffer; provided that the proposed work includes mitigation restoration measures that will improve the existing condition of the wetland resource or adjacent upland area. The ratio of restored area to area of alteration shall be 1:1. Temporary impacts where necessary for the installation of linear site - related utilities are allowed, provided the area is restored to its natural conditions. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2, The Order does not grant any property rights or any exclusive privileges, it does not authorize any injury to private property or invasion of private rights. 3. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. the work is a maintenance dredging project as provided for in the Act; or b. the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing. 7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. Based on the information presented at the hearing, the NCC made the following findings in support of the denial of the application: Related to the significance of the resource areas on the site to the interests identified in the Northampton Wetlands Protection Ordinance: The NCC found that the BV W and 100' Buffer Zone are significant to the protection of the following interests: agriculture, aesthetic value, wildlife and wildlife habitat, ground water, public and private water supply, flood control, storm damage protection, erosion and sedimentation control. Related to the expected impacts of the project on those resource areas Disruption of and activities within such a significant percentage of the buffer zone under the proposal will result in adverse impacts of stormwater runoff, erosion, siltation, loss of groundwater recharge, poor water quality, vegetation change and harm to wildlife habitat either immediately, as a consequence of construction, or over time, as a consequence of daily operation and the existence of activities. Related to the adequacy of the proposed mitigation measures: The application did not propose any mitigation to prevent adverse impacts or mitigate for any impacts caused by work within the buffer zone, a resource area protected by the Northampton Wetlands Protection Ordinance, and did not address performance standards in the NCC Policy on Work Within the Buffer Zone. Furthermore, there is no opportunity for mitigation within the very small area of remaining undeveloped buffer zone on the parcel. The NCC also found that by not maintaining the current agricultural field and ditch, which was proposed, the wetland may expand even closer to the area of the proposed alteration. This project is exempt from Stormwater Management Standards as a "Single- family house project" as per the Massachusetts DEP's Stormwater Management Policy Handbook (Volume One), 1-3. 2. The only potential `dirty' water resulting from the proposed project would be from the driveway. Any roof runoff from the future house is considered clean and will infiltrate on site well before reaching the wetland. Raingardens can he required of the future homeowner however their effectiveness would be minimal. 3. Within Northampton, the driveway crossing combined with the grading required for the septic system currently disturbs 20% of the 50' -100' buffer zone, a `limit' outlined in the City of Northampton Wetland Bylaws. We have made the effort to minimize the amount of disturbed area as this was a concern expressed by the Commission. 4. Should a water quality basin be required, compliance with DEP's Stormwater Management Standards (Volume One) for water quality (1 -6) requires a basin having a volume to accommodate 0.5 inches of runoff times the total impervious area (driveway) be constructed. This basin would need to occur at the low point on the site which is well within the wetland. The resulting storage volume of 220 cubic feet needed would add an additional 500 square feet of disturbance within the wetland. Additional disturbance may be required if soil conditions are found to be unsuitable. 5. A vegetative buffer will be added to the plans which delineate portions of the wetland boundary within Northampton (see attached sketch) We would like to proceed with the project as currently proposed and have the opportunity to address the topics during the hearing. We are prepared to incorporate several of the features into the plan however feel that it is prudent to discuss the implications of each issue with the Commission as it relates to their concerns. The wetland boundaries were marked in the field with consecutively numbered pink `wetland delineation" stake - flags. While the wetland edge has been accurately delineated, the final determination of the extent of the wetland resource areas can be made only by the Hatfield Conservation Commission or, upon appeal, by the Massachusetts Department of Environmental Protection. Wcdand Delineation The wetland delineation was based upon the methodology outlined in the Regulations at 310 CMR 10.55 and in the DEP handbook Delineating Bordering Vegetated Wetlands Linder the Massachusetts Wetlands Protection Act (1995). This is a two - parameter methodology that uses both vegetation and hydrology (of which hydric soils is an indicator) when delineating wetland lines. While the rear portion of the property is upland, the area near the roadway contains a large wet meadow wetland. This wetland has been disturbed in the past by normal agricultural maintenance activities, including the dredging of the existing stream (ditch) within the site. In addition, the field was mown at the time of our initial site visit on September 9` Therefore, utilizing vegetation on this site was extremely difficult, although wetland indicators such as soft rush (Juncos effusus) were still identifiable within the wetland. Two flagged lines were used to mark the extent of the wetland. The boundary closest to the road encloses a higher area that contains soils that appear to have been dredged from the stream_ The line to the rear of the site marks a less disturbed boundary between hydric and non- hydric soils. Existing Conditions The subject site is presently an undeveloped parcel consisting of a periodically mown field at the front of the property and a wooded hillside at the rear. The front half of the site is generally flat, though gently sloping uphill to the west, with the exception of a drainage ditch located close to the Linseed Road previously constructed to facilitate the drainage of the front field. The ditch runs primarily north to south before being culverted under Linseed Road. This parcel was part of a previously larger property that appears to have been fanned in some capacity. The delineated wetlands separate Linseed Road from the buildable, rear upland portion of the property. The rear half of the site represents a steep wooded hillside that remains undisturbed. Proposed Construction The project involves the construction of a single - family house with a proposed footprint of 3100 square feet and attached 625 square foot garage. The project also proposes the construction of a detached barn with an estimated footprint of 1650 square feet. A driveway, which crosses the wetlands separating Linseed Road from the buildable upland portion of the site, is also necessary for the construction of this project. The proposed driveway will be of minimal width and is designed to disturb the least possible amount of wetlands. A culvert has been designed at the location of the wetland crossing to permit continued and unobstructed water movement through the wetland. It is also proposed that the wetland area disturbed as a result of this project be replicated on site. The delineated wetlands on this property currently run roughly north to south and separate the frontage street, Linseed road, from the buildable upland portion of the property. To access the upland portion, it is necessary to construct a drive that crosses the wetland and wetland buffer zones. While the applicant realizes that this is not a preferable situation, alternative means of access are not available. The abutting parcel to the north contains similar wetlands separating Linseed road from the upland portion of the property. Additionally, the northern parcel is currently developed with a single - family home by a different property owner and alternative means of access to the project property from the north is not an option. The adjacent parcel to the south, while currently undeveloped, contains similar restrictions. The wetland from this project site continues to the south and expands as the topography flattens. Access to Linseed Road through this southerly parcel would disturb more wetland and wetland buffer than is being proposed with this project. While the front half of the project property is flat to gently sloping, an abrupt grade change occurs as one approaches the tree line across the center of the parcel. A steep wooded hillside characterizes the rear half of the property thereby restricting alternative means of access from the west. The applicant is fully aware of the limitations and restrictions on this property. The purchase of this parcel signaled the end of 3 years searching for a comparable piece of property upon which to build. Relocation from their existing home has become a necessity due to increasing commute times to and from job sites in his profession as a builder. Among other reasons, building a new home on property located close to major highways and suppliers was guided by economic incentives. Being a builder, the requirements for the applicants include enough space for a home and barn where equipment and supplies could be safely stored. Despite intense searches for comparable property, no reasonably priced land could be found that could accommodate their needs, As a result, they purchased this property because they felt that they could responsibly develop the front portion of the parcel, despite the extensive wetlands located on site, while leaving the rear half of the site undeveloped and untouched. In an effort to concentrate construction of a home, barn and driveway to the limited buildable area available however, encroachment on the wetland buffer zone became unavoidable. The proposed project does disturb area within the 100' wetland buffer as well as a small portion of area within the 50' buffer, from which a varience from City Wetland Bylaws is being requested. The disturbance within the 50' buffer is necessary for the construction of a small portion of driveway to service the barn. The applicant is restricted to the proposed site layout by the steep wooded hill to the west and the wetlands to the east. It is understood that disturbance of any wetland or buffer zone is not preferable and should be avoided if at all possible. However, the wetlands located on this parcel are characterized as wet meadows and are a result of the surrounding drainage patterns. This site was a former farm and remains to be periodically mown by others to maintain a low grass ground cover. While the value of any wetland merits protection, this particular wetland has significantly less value to wildlife and species diversity than do neighboring wetlands. The hydrological value of this wetland meadow is recognized as it serves to drain the adjacent lands. The driveway crossing and associated culvert have been engineered so as not to disrupt the existing flow of water. A replicated wetland has been proposed as part of this project that seeks to improve and enhance the species diversity of this particular wetland. The replicated wetland also proposes that the narrow drainage ditch that currently conveys water be widened to distribute the flow of water over a larger area minimizing the potential for soil erosion and displacement. It has been recognized that the proposed project is not an ideal situation. However, the work that is being proposed should have a minimal effect on the resources located on the site and that the improvements that are shown on the plans submitted with this application will result in an enhanced condition and not disrupt the existing wetland functions. The wetland boundaries were marked in the field with consecutively numbered pink `wetland delineation" stake - flags. While the wetland edge has been accurately delineated, the final determination of the extent of the wetland resource areas can be made only by the Hatfield Conservation Commission or, upon appeal, by the Massachusetts Department of Environmental Protection. Wetland Delineation The wetland delineation was based upon the methodology outlined in the Regulations at 310 CMR 10.55 and in the DEP handbook Delineating Bordering Vegetated Wetlands Under the Massachusetts Wetlands Protection Act (1995). This is a two - parameter methodology that uses both vegetation and hydrology (of which hydric soils is an indicator) when delineating wetland lines. Since the entire wetland boundary is within an agricultural area, hydric soils and wetland hydrology alone were used in order to determine the line that would support wetland vegetation under undisturbed conditions as outlined in the Regulations at 310 CMR 10.55 -2 -c -3. Site Description The frontage of the property is entirely an agricultural field, while the hillside to the rear of the site is wooded. While the rear portion of the property is upland, the area near the roadway contains a large wet meadow wetland. This wetland has been disturbed in the past by normal agricultural maintenance activities, including the dredging of the existing stream (ditch) within the site. In addition, the field was mown at the time of our initial site visit on September 9' Therefore, utilizing vegetation on this site was extremely difficult, although wetland indicators such as soft rush (Juncos effusus) were still identifiable within the wetland. Two flagged lines were used to mark the extent of the wetland. The boundary closest to the road encloses a higher area that contains soils that appear to have been dredged from the stream. The line to the rear of the site marks a less disturbed boundary between hydric and non- hydric soils. The site includes the following wetland resource areas, each of which has a 100 foot "buffer zone.'
