Enclosed please find the original signed Order of Conditions for the above referenced project.
This Order has been recorded in the Hampshire County Registry of Deeds, and filed with the Department
of Environmental Protection as required.
The ten business day legal appeal period from the date of issuance has expired, so the project may begin at
anytime once pre-construction conditions are met.
Please read the document carefully, as it contains conditions that must be adhered to before, during, and
after work on the project. Condition 36 requires that an invasives removal and planting plan be filed with
the Commission 45 days after the Order was issued, and approved prior to this work being started. As
discussed in our conversation this afternoon, you are requesting two additional weeks to prepare this
plan. The plan must be provided by June 22, which is 60 days following the date of the Order.

Dear Ms. LaValley;
On behalf of Mr. Frank Fournier, I am responding to your email of January 19, 2011.
The wetland boundaries were determined by the following measures:
- Observed vegetation on site before construction began. The area for the proposed
Infiltrator Leaching bed system was lawn grass, red cedar trees along the
southerly property line and two red maple trees.
- Soil Evaluation using the Munsell Soil Color Chart.
- Determination of approximate high water line on the existing bank of Bike Path
drainage channel before construction began.
The following mitigating measures are proposed to meet the standards of Northampton’s
Wetland Ordinance. If approved they will be undertaken upon completion of the
proposed sewage disposal system and will have no unacceptable, significant, or
cumulative effect on the protected resource area:
Erosion Control
: As a temporary measure, straw bales were installed on top of the slope
west and northerly of the block wall to prevent runoff. Straw mulch was placed on the
existing slope north of the block wall to prevent soil erosion. Hay bales and silt fence
were installed at the toe of slope along tree line 10’ from the existing bank (resource area)
and will serve as a sediment barrier and prevent runoff into the no-build zone: ie: 10’
buffer zone of the resource area. A permanent vegetated cover will be established, as
weather conditions permit, in the buffer zone easterly and northerly of the existing
concrete block wall. This cover will hold soil particles in place, slow the velocity of
runoff and promote water infiltration.
Plantings:
Indigenous plant species are proposed which are adapted to the existing range
of soil moisture conditions typical of this area. They will act as a barrier to the Bike Trail
and provide food and shelter for wildlife. Suggested plant species include but may not
limited to the following:
-highbush blueberry - vaccinium corymbosum (18” – 24”)
-blackberry – Rubus Allegheniensis
-red raspberry – Rubus idaeus
-silky dogwood – Cornus amomun Mill.(18” – 24”)
-red osier dogwood – Cornus stolonifera Michx.
