At their meeting on May 26, 1988 the Northampton Planning
Board voted unanimously to recommend that the City Council accept
Emily Lane as a City Street.
On June 24, 1987 the Planning Board released all of the lots
in the development from its Covenant in lieu of a $5,000 Letter
of Credit, which will expire on June 25, 1988, sufficient to
complete some minor improvements. The DPW has since determined
that said minor improvements have been completed and that the
City accept Emily Lane as a.City Street.

On April 7, 1988, the City Council referred to the Board
of Public Works a petition for the acceptance of Emily Lane as
a City Street.
The Board of Public Works held a public hearing on May 11,
1988 and at its meeting on May 11, 1988, after considering the
petition voted unanimously to recommend the layout and acceptance
of said Emily Lane to the City Council.

At held on October:10, 1985, the Planning
of Northampton voted unanimously to grant the Special PerMit request of
Baker Hill Associates, Crafts Avenue, :Northampton for the purpose•of. .establish-
ing a 13 lot cluster development (which includes an ex,sting
to be entitled "Emily Lane Subdivision" • located on the westerly side
of Cooke Avenue, Northampton and.containing a new roadWayentitled"Emily
Lane". Public Hearing for this application was held on August'24' 1985; •

Based upon evidence presented t�-the Board at said Public Hearing and
after due deliberation, the Planning Board issues the following findings
in accordance with Section 10.10 of the Northampton Zoning Ordinance:
1. The requested use is listed in the Table of Use Regulations of the
Northampton Zoning Ordinance as allowed by Special Permit in the district
for which application is made.
2. The requested use bears a positive relationship to the public convenience
or welfare by increasing the number and quality of the City's housing
stock.
3. The requested use (proposed twelve single family homes) will not
create undue traffic congestion or unduly impair pedestrian safety..
4. The requested use will not overload any public water, drainage or
sewer system to such an extent that the requested or any developed
use in the. immediate area or in any other area of the City will be •
unduly subjected to hazards affecting health, safety or the general
welfare;
5. All specific regulations for the use, set forth in Article XI have
been fulfilled.
6. The requested use will not impair the integrity or character of the
district or adjoining zones, nor is.it detrimental to the health,
morals or general. welfare. The use is in harmony with the general
purpose and intent of the Ordinance. The proposed development is
creating single family housing on comparable-sized lots in a pre-
dominantly single-family neighborhodd.
In addition, the Planning Board attaches the following conditions
to this Special Permit:
1. The common area of the developMent is to be extended throughots
#6, 7, 8, 9, and 10, thus creating a "loop" system. Said extension
to be 25 feet wide and to be located along the outside boundary
of said lots and through the above mentioned lots.
2. Lots #5 & 6 and #7 and 8 are to share a 'common curb cut

3. The developer shall construct the cul-de-sac as shown cinthe
construction plans with the central area of the cul-deTO:ojlanted
with appropriate low-maintenance vegetation to

Findings
The Conservation Commission has reviewed the above - referenced Notice of
Intent and plans and has held a public hearing on the project. Based on the information available to the
Commission at this time, the Commission has determined that
the area on which the proposed work is to be done is significant to the following interests in accordance with
the Presumptions of Significance set forth in the regulations for each Area Subject to Protection Under the

of Intent, the conditions shall control.
General Conditions -
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory meas-
ures, shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state or local statutes, ordinances, by -laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(a) the work is a maintenance dredging project as provided for in the Act; or
(b) the time for completion has been extended to a specified date more than three years, but less than
five years, from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or de-
bris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes,
refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if
such an appeal has been filed, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land
Court for the district in which the land is located, within the chain of title of the affected property. In the
case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name
of the owner of the land upon which the proposed work is to be done. In the case of registered land, the
Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done. The recording information shall be submitted to the rnmmi s s i nn
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size
bearing the words, "Massachusetts Department of Environmental Quality Engineering,
File Number 246 - 142 : --
10. Where the Department of Environmental Quality Engineering is requested to make a determination and
to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings
and hearings before the Department.

Certificate of Compliance be issued stating that the work has been satisfactorily completed.

1) All construction areas shall be restored to roginal condition or better
upon completion of the project, including vegetation;
2) No areas within the 100 year floodplain nor within 100 feet of a wetland
area, as defined in Chapter 131, Section 40, M.G.L., shall be permissable
disposal sites, unless otherwise approved by the Conservation Commission;
3) Excavated material and topsoil stockpiles shall be located and stabilized so
as to minimize washing into wetland areas or waterways;
4) Adequate measures shall be taken to prevent erosion and siltation of all
disturbed areas;
5) This Order Of Conditions shall apply to any successor in interest or successor
in control;
6) Members and agents of the Conservation Commission shall have the right to
enter and inspect the premises to evaluate compliance with the Conditions
and to require the submittal of any data deemed necessary by the Commission
for that evaluation;
7) The upstream headwall shall be constructed high enough so that it remains above
the brook's 100 —year storm elevation;
8) The bank and all other disturbed areas shall be adequately stabilized to prevent
erosion immediately upon completion of that phase of the project;
9) Prior to construction, siltation /sedimentation traps shall be constructed just
downstream from the project (Leave Space Blank) sufficient to prevent any erosion
or siltation from this project from proceeding downstream.

THAT I am the Assistant Clerk of Valley Design and Development
Corporation, that at a meeting of the Board of Directors of the
corporation duly called and held at the office of the corporation at
Amherst, Massachusetts, on the day of 1988, all the
Directors being present and voting at all times, the following
resolution was unanimously adopted:
VOTED: That the President, Arthur J. Pichette, is hereby
authorized and directed in the name and on behalf of the corporation
to purchase real or personal property for the corporation in his or
her discretion; to sell, mortgage or lease any and all real estate
owned or which may hereafter be owned by the corporation, as any one
of them shall deem expedient and proper in carrying out the business
of the corporation, and in connection therewith to sign in the name
and on behalf of the corporation, seal with the corporate seal,
acknowledge and deliver any mortgages, deeds, promissory notes, and
other instruments of every nature, which may be necessary or proper in
carrying on the business of the corporation, and to do any and all
acts necessary and proper for imposing restrictive covenants and
agreements on any property now or hereafter owned by said corporation.
This vote shall remain in full force and effect until an instrument
revoking the same shall have been recorded in the Hampshire County,
Massachusetts, Registry of Deeds.
I DO FURTHER CERTIFY that the above vote has not been altered,
amended, rescinded or repealed.
I DO FURTHER CERTIFY THAT the corporation is a duly organized
corporation; that the foregoing vote is in accordance with the
Articles of Organization of the corporation; that Arthur J. Pichette
is the duly elected and qualified President of the corporation, and
that I am the duly elected and qualified Clerk of the corporation.
