38B_231 58 Fort Street Violation 10-1-2010 October 1, 2010 Cheryl Muzio and Andrea Fiske 58 Fort Street Northampton MA, 01060 RE: 58 Fort Street Dear Ms. Muzio and Ms. Fiske: It has been brought to the attention of the Northampton Conservation Commission that there is a large amount of fill/excavated material located on your property at 58 Fort Street. Recent rainfall has washed significant amounts of this material into the wetlands area to the southeast of your parcel, and the 100-year floodplain to the Connecticut River. Even minor construction activities can have negative impacts to wetlands, which are important resources for habitat and prevention of pollution. Sediment releases to wetland resource areas constitute violations of both the Massachusetts Wetlands Protection Act and the Northampton Wetlands Ordinance, which can be subject to enforcement actions if not addressed. Temporary erosion controls to prevent further releases of sediment must be installed around the unstabilized area by Tuesday, October 12, 2010.
