Zoning Board Members present and voting were: Chairman Dr. Pater

In Granting the Special Permit and Site Plan Apprvoal, the Zoning
Board of Appeals found: -
A. A Bed and Breakfast establishment is allowed with a Special
Permit in a URB district under S5.2, Table of Use
Regulations.
B. The requested use bears a positive relationship to the
public convenience or welfare by adding a three bedroom Bed
and Breakfast establishment to the area and for the
convenience of tourists.
C. The requested use will not create undue traffic congest on
or unduly impair pedestrian safety since the applicant as
provided adequate parking and will require Bed and Brea .fast
guests to park on -site.
D. The requested use will not overload any public water,

E. There are no additional special regulations set forth in the
Zoning ordinance that the applicant must meet.

the Planning Board:

conditions imposed upon the project are as follows:
1. Three on -Bite parking spaces be supplied that meets sowing
requirements (8 -1/2' B 18' with a 16' backup space).
2. Adequate arrangements must be made to assure that all
parking spaces and turn -a -round areas remain clear of now
in the winter months, so as not to reduce available pa king
spaces.
3. Applicant must meet the requirements of the Board of S alth
and the Fire Department.
4. Landscape screening for the parking area must not impeise or
block traffic visibility.

- Chairman Laband said that the Public Hearing on the request o =

Florence had been closed and the, ZBA would try to reach a decis on
at this meeting. Present and sitting on the case were: Chai an
Peter Laband, Member. M• Sanford Weil, Jr. and Associate Member
Elaine Reall.
M. Sanford Weil stated that under §9.3(c) in the Zoning' Ordinanbe
for a Finding the ZBA had to find that the applicant's request
would not be any more detrimental to the neighborhood than the
previous use, and he, found that this request would not be
substantially more detrimental to the neighborhood by adding ee
bedrooms to be used for a Bed and Breakfast: establishment. Weil
noted that the only opposition which came before the ZBA dealt v ith
parking on the street. Weil noted that the applicant had agreec , to
keep the Bed and Breakfast clients from parking on the street and
has provided adequate parking on site for clients.
M. Sanford Weil reviewed the criteria for a Special Permit umder
510.10 and found that:

Chairman Laband reviewed procedures for public heatings and read
the copy of the legal advertisement which was published in the
gail Hamcshire Ga� ,ette on July 6, 1994 and July 13, 1994. Members
of the Board sitting are: a' MembeY' M.
Sanford Weil, Jr., and As sociate Member Elaine Reall
I,aband noted that an error had been made on the legal notice for
the hearing �lhich had been incorrectly advertised as
_ Street instead of ,the correct 185 North Main Street,, and said ,:hat
all abutters were re- notified of the continuation of the pudic
hearing tonight.
Correspondence dated June 15, 1994 from the neighbors on Greeley
Avenue expressed concern over the parking issue for the proposed
Bed and Breakfast at 185 North Main Street. The letter stated that
North Main Street (Rte 9) is a very heavily traveled road with no
room for parking. Additionally Greeley Avenue, is a private way,
_ is very narrow (18' in width) and creates a parking problem for the
reeley Avenue. Therefore,
residents on G the residents of Greeley
Avenue are objecting to the additional parking that would be
created on Greeley Avenue. The letter was signed by five Greeley
Avenue residents.
A memo from Sam Brindis of the DPW stated that he had no concerns
with the proposal.

garage and driveway. Billings noted that there would be ad quate
parking for the bed and breakfast guests. Cars will be for ed to
back up into the driveway in order to turn around and then drive
out onto Route 9. Sandy Weil asked about parking on Greeley venue
and was told that no parking was proposed on Greeley Avenue,

Billings said he would tell his guests that there be no parking
allowed on Greeley Avenue. _
Peter McNulty of 9•'Greeley Avenue said he had concerns with the
parking. He said there was an over -flow of parking on Gre ley
Avenue at the present time. McNulty said he felt that the font
yards in the neighborhood, if taken up by parking, would ruin the
look of the neighborhood since there would only be a very small
green area left in the front yard. McNulty thought that the
parking should be located in the rear of the house. There is no
way to limit parking on a private way such as Greeley Avenue. 'Mr.
Billings said they would have a maximum of five cars parked at one
time, and further reiterated that they would advise guests that
parking is not allowed on Greeley Avenue. Billings stated that
there will be shrubbery and landscaping planted to make the front
.? yard as attractive as possible.
Peter Laband asked whether there was any room to locate parking in
the back of the property. Mr. Billings said no, because the area
in the rear drops off and, therefore, would not support any parking
spaces.• Mr. McNulty suggested that if the Board issued a permit,
they consider setting a condition that parking for the Bed and
Breakfast guests not be allowed on Greeley Avenue. McNulty also
said the neighbors would like to request that additional shrubbery
be planted to screen the parking area from view on Route 9.
X. Sanford Weil moved that the Public Searing be closed. Blaine
Reall seconded the motion Which passed unanimously 3:0. The SBA
said they Would make a decision at a meeting held on August 3, 1994
