Are you still a partner/owner of Quickbeam Realty Trust?
In 1990, you petitioned to request that the portion of Fulton Avenue that sticks into your property be
discontinued. You then withdrew that application when you had concerns about the zoning impacts of such
discontinuance.
Since that time, we have changed our zoning and no longer require any frontage in the General Business
District (or in the Central Business District, which would be the most likely district to rezone that property if it
was ever rezoned). As such the reason for your withdrawing your request no longer applies but the reason for
originally making the request (for you to own and control the land) still exists.
Do you have any interest in renewing your request? We are always interested in cleaning up these old streets
that do no one any good.

RECOMMENDATION OF THE PLANNING BOARD
TO THE CITY COUNCIL
The Planning Board reviewed the petition to discontinue a
portion of Fulton Avenue at their meeting on February 14, 1991.
The Planning Board voted to recommend that the petition for
discontinuance be denied (7 -0 with one abstention) . The Planning
Board found that the proposed discontinuance would create a
hardship for Matthew Pitoniak by removing the current access to a
part of his property.

On February 15, 1990, the City Council referred to the Board
of Public Works a petition for the discontinuance of a portion of
Fulton Avenue.
The Board of Public Works held a public hearing on March 28,
1990 and at its meeting on November 14, 1990, after considering the
petition voted unanimously to table indefinitely said petition.

Dear Dr. Beauregard:
The Board of Public Works has recently voted to discontinue a
portion of a city street known as Fulton Avenue. I was the original
petitioner who requested such discontinuance. Subsequent to
my request, I wrote to the Board of Public Works withdrawing
the request. However the Board of Public Works voted to discontinue.
I have requested the Board of Public Works to reconsider their
action and to be present to explain my reasons as to why this
section of Fulton Avenue should not be discontinued.
If,.as or when the Planning Board takes up the issue of
discontinuance of Fulton Avenue, I would respectfully request
that 1 be advised of such deliberation, so that I may be.,present
to explain to your Board my reasons for no discontinuance.
Thank you for your consideration of this request and your
attention to this matter.

determine the degree of completion of the subdivision.

to approve the petition for the discontinuance

Pursuant to the Northampton Code - Streets, Sidewalks, Public
Property, Article II. Laying Out Altering and Discontinuing,
Section 19 -42. Petition to council required, we the undersigned,
hereby petition the Northampton City Council to discontinue a
portion of Fulton Avenue as delineated on the attached plan.
Our request for discontinuance involves that portion of Fulton
Avenue which lies to the east of Pleasant Street and which dead
ends into the property currently owned by Quickbeam Realty Trust.
