I am reviewing the plans for the addition/renovation at 68 Hillcrest Drive. The windows that have a sill height of 24" or less off finished floor and are greater than 72" above finished grade will be required to have opening limitation devices per code section R312.2 thru R312.2.2: R312.2 Window fall protection. Window fall protection shall be provided in accordance with Sections R312.2.1 and R312.2.2. s• Section R312.2 requires compliance with Sections R312.2.1 and R312.2.2 for window fall protection. Section R312.2.1 indicates that the window fall protection is only required for windows that meet all of the following conditions: 1.Are operable, 2.Are located more than 72 inches (1829 mm) above finished grade or other exterior surface below, and 3. Have a sill height of less than 24 inches, as measured vertically from the floor surface of the room in which they are located. Where a window meets all of these conditions, Section R312.2.1 requires that they comply with at least one of the following: 1. Have openings which will not allow passage of a 4-inch-diameter(102 mm) sphere, 2. Be equipped with a window fall prevention device in accordance with ASTM F2090, or 3. Be equipped with opening control devices in accordance with Section R312.2.2 (see Commentary Figure R312.2.1). R312.2.1 Window sills. In dwelling units, where the top of the sill of an operable window opening is located less than 24 inches (610 mm)above the finished floor and greater than 72 inches (1829 mm)above the finished grade or other surface below on the exterior of the building, the operable window shall comply with one of the following: 1. Operable windows with openings that will not allow a 4-inch-diameter(102 mm) sphere to pass through the opening where the opening is in its largest opened position. 2. Operable windows that are provided with window fall prevention devices that comply with ASTM F2090. 3. Operable windows that are provided with window opening control devices that comply with Section R312.2.2. R312.2.2 Window opening control devices. Window opening control devices shall comply with ASTM F2090. The window opening control device, after operation to release the control device allowing the window to fully open, shall not reduce the net clear opening area of the window unit to less than the area required by Section R310.2.1. Yanoshak and Melinda M. Mason, (herein after referred to as "Owners"); and Bradford Builders Inc., a Massachusetts corporation, and its owner, Bradford J. Moreau II, Construction Supervisor License number 075408 (expiration 02/09/25), Home Improvement Contractor number 170018 (expiration 03/03/26), (hereinafter referred to as "Contractor"). In consideration of mutual promises contained herein, Contractor agrees to perform the following work, subject to the terms and conditions below: Scope of work: Contractor and all of the work performed by Contractor will follow directions in the work plan set provided by Owners and prepared by licensed Architect and Structural Engineers. Permits: Contractor will be responsible for obtaining the following permits on Owners behalf(if required): Building Permit, Plumbing Permit, Electrical Permit, Demolition Permit, Certificate of Occupancy/Completion. IT IS THE OBLIGATION OF THE CONTRACTOR TO OBTAIN THESE PERMITS AS OWNERS AGENT. Original house work: - Bradford Builders will follow the stamped architectural plans, unless discussion with Owners results in a sign agreement to change the work. - Remove existing pull down stairs in the garage, frame, patch ceiling hole with sheetrock and apply joint compound, sand, and paint. It might not match exactly. - Bradford Builders will use the existing exterior door from the kitchen into the garage. Bradford Builders will re-install the door according to plan. - Bradford Builders will remove existing coat closets in the kitchen and install new shallow pantry cabinets, allowing owners to purchase new pantry cabinets. - Bradford Builders will build new stairs into kitchen area (per stamped architectural drawings and Mass code) - Bradford Builders will move the existing east wall in the kitchen, in accordance with stamped architectural drawings, approximately 3 feet towards the front of the house. Bradford Builders has met on-site with the architect and structural engineer. All parties involved know that the architect will be getting approval from structural engineers regarding the kitchen/dining room area. - Bradford Builders will install new kitchen cabinets in the kitchen. Owners to determine the new location of cabinets. This includes the Island. - Bradford Builders to replace the window and sliding doors in the kitchen. - Bradford Builders will change the stairway leading from 1st floor to 2nd floor. Bradford Builders has discussed this area with architects and Owners and Bradford Builders will follow stamped architectural drawings. Bradford Builders will follow plan from MUZATA to reconstruct the stairway. - Bradford Builders will remove the existing chimney on the south end house. - Bradford Builders will remove existing chimney and flue pipes in the living room. Bradford Builders will contract Czar Energy Solutions and or a comparable company to install a 12" triple wall insulated black pipe from the wood stove location up through the roof, or similar, to meet the requirements of the wood stove (to be purchased by Owners).. Bradford Builders will work with the company and install through the roof, if possible into the existing chimney structure. Bradford Builders will patch with a 30-year architectural shingle. - The Parties acknowledge that any location where patching in of new shingles is done, new shingles will not match existing shingles (due to exposure to sun and the weather). - Bradford Builders will be following the architectural drawings in construction of a new hallway through the existing 1st floor bedroom. - Bradford Builders and owners have spoken about the new shelving units that will be in that area. At this time it will be determined which way the shelving unit will be accessed. - Bradford Builders will remove balcony railings upstairs and replace them with supplied railing from MUZATA. - Bradford Builders will frame new opening in bedroom #2 for the window. The location of the new window opening will be framed in accordance with stamped architectural drawings. - Bradford Builders will frame door opening and install door bought by owners. This will be done on the North wall going into the attic above the garage, per stamped architectural drawings. - Bradford Builders will work on the upstairs existing bathroom according to stamped architectural drawings. Bradford Builders will try their best not to crack or damage tiles in said area. If this occurs Bradford Builders will discuss with owners the problem. Both parties will agree on a solution. This could result in extra cost. - Bradford Builders will remove the existing window on the south wall of the new office. Bradford Builders will reframe this opening so as to access the new addition. This opening may not line-up with the existing window. Bradford Builders understands this. - Bradford Builders will follow the plan and frame the area of the existing walk-in closet and new office. This new area on plan is the new 2nd floor ensuite. The doorway from new addition into new ensuite will be a pocket door. - Bradford Builders will re-paint collar ties on the second floor. - Bradford Builders will frame a new closet and doorway entrance into the front upstairs bedroom. This will be done according to the plans. - Bradford Builders will follow the plans as far as the reconstruction of the old closet area that will encompass the new primary ensuite. New Addition: - Bradford Builders' subcontractor will pour the new foundation according to plan. The foundation walls will be approximately 9' 2" finished height. - Bradford Builders will install a 3 1/2 " Rigid insulation and a 6 mm poly plastic under concrete floor in the basement. - Bradford Builders' subcontractor will pour the new concrete slabs in the new addition basement. (Bradford Builders will follow the stamped architectural drawings and any code that the town requires) - Bradford Builders and subcontractor, Complete Concrete, have walked the premises of the property and will move the extra dirt in a way that has been discussed and with further consultation with Owners. (Bradford Builders will only be using on-site material for the grading of the property. If there is not enough material on-site the Owners will have to purchase more material, trucking included) - Bradford Builders will have a concrete cutting company cut the new entryway from existing basement to new basement. Exact size to be determined. - Bradford Builders at this time has not calculated anything for radon mitigation and feels there is no need to do so. If the owners decide otherwise, Bradford Builders can appropriately have a radon filter installed. - Bradford Builders will follow the window and door schedule created by Owners, Architect, and Bradford Builders. - Bradford Builders will work in accordance with the representative from the window company on coming up with the best plan for installation. Bradford Builders will use special tape, silicone, and spray foam insulation for protection against the weather and air flow. - Bradford Builders will case all new windows with a Hardie concrete 1 x4 trim board. - Bradford Builders will have to create an extension jamb and case each window and door in new addition and existing house. - Bradford Builders will be installing new Hardie siding. It will be 5 '/2 " wide by '/2" thick. The siding will be pre-painted. Owners to decide the color of the trim (corner boards, rakes, soffits, and fascias will also be Hardie board). - Bradford Builders will be removing existing soffits, rakes and fascias on existing house and replacing with Hardie trim boards. Bradford Builders will install Hardie trim boards on the new addition. - Bradford Builders will remove siding on the existing house and will install new Hardie siding on the new addition and existing house. - There will be a new Laundry area in the addition. This will be done according to plan. - Per the stamped architectural drawings there will be four pocket doors in the new addition area. - Owners have agreed to pick out and have a different company than Bradford Builders install the tile and membrane in the new master bath. - As far as the construction of the addition goes, Bradford Builders will follow the approved blueprint in a reasonable and customary manner. - Bradford Builders will be using the Zip system for the exterior plywood on walls and roof. - Bradford Builders will use advantech 3/4"tongue and groove plywood for the floor sheathing in the new addition. Plywood on the floor will be glued with a construction adhesive. - Bradford Builders will follow insulation requirements according to plan and any city or state codes as to being able to pass an insulation inspection. Bradford Builders will be using conventional insulation and spray foam insulation according to plan. - Bradford Builders will use a standard '/2 light sheetrock in all applicable areas. In bathrooms Bradford Builders will use moisture resistant sheetrock. - Sheetrock to have compound and tape applied, sanded and primed with new construction primer. - Bradford Builders will be applying the trim that owners picked out on all trimmed areas of existing and new construction, including all interior doors, windows, and baseboard molding. Also, Bradford Builders will have the trim that was picked by owners pre-applied to the split jamb doors, if any, otherwise to trim in accordance with direction by Owners. The doors are going to have black hinges applied from the factory. Owners to provide door knob or door lever. - Bradford Builders will install the same trim as baseboard throughout the new addition. - Bradford Builders will apply one coat of paint over the new pre-primed trim that has been installed. Also, will fill nail holes and caulk. - Owners to out-fit the primary walk-in closet. Meaning shelving units and drawer kits. - Bradford Builders and owners have discussed that the Owners are responsible for purchasing the toilet, vanity, vanity top and fixtures. - Bradford Builders and Owners have agreed that the Owners will take care of any and all flooring and tiling associated with the project. Excluding the floor for the new master on-suite. - Owners will also buy any and all cabinetry and accessories associated with the project. - Owners will source and purchase all windows and doors for the project. - Bradford Builders is an advocate of plants, trees, and bushes but with the extent of construction occurring we might break or squish a plant. Bradford Builders is not responsible for any of these types of damages. - Bradford Builders will dispose of all construction related debris associated with this project. - Bradford Builders will subcontract excavation and foundation work, HVAC, plumbing, electrical, and chimney work. Attached with the contract will be an Extras agreement to use if any amendments to this contract occur. Total cost- $356,000 Will be paid in 5 disbursements; 1. $70,000- Due upon signing of the contract 2. $120,000- Once foundation of new addition is in and backfilled 3. $80,000 - Once new addition is shelled and roof shingles installed and the original house is 50% done 4. $75,000 - Once new addition is sheetrocked and ready for paint and the original house is 70% done 5. $38,900- Once the entire project is complete "Substantial Completion" is the point at which the Work, or a designated portion of the Work the Owner has agreed to accept, is sufficiently complete consistent with the requirements of the Contract Documents to enable the Owner[ or its tenants] to take possession of, occupy, or use the Project, or such designated portion, in all respects for its intended use without [material interference/significant disruption] from the completion of any remaining work. Substantial completion of the Project or any such designated portion, will not be achieved until: 1. (a)All Project systems included in the Work or that designated portion are operational as designed and scheduled, and where required by the Contract Documents, have been inspected and commissioned. 2. (b)Owner's personnel have received the requisite number of operational manuals and all instruction and training in the use of such Project systems as required by the Contract Documents. 3. (c)All required governmental inspections and approvals associated with the use and occupancy of the Project or that designated portion including. without limitation, a [temporary/permanent] certificate of occupancy for such use are obtained and provided to the Owner[ unless the failure to obtain same is due to circumstances unrelated to the Contractor's Work]. 4. (d)All utilities[for the Project or that designated portion] have been connected and are in working order. 5. (e)All final finishes[for the Project or that designated portion] specified in the Contract Documents are in place. 6. (f)The Project or that designated portion has been fully cleaned and cleared of any debris and is readily accessible, operable, and usable for its intended purpose. This Agreement and all related documents [including all exhibits attached hereto][, and all matters arising out of or relating to this Agreement, whether sounding in contract, tort. or statute] are governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts, United States of America [(including its statutes of limitations)][, without giving effect to the conflict of laws provisions thereof to the extent such principles or rules would require or permit the application of the laws of any jurisdiction other than those of the Commonwealth of Massachusetts]. [The parties agree that the United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.] This Agreement may be executed in counterparts, each of which shall be deemed an original, but all of which together shall be deemed to be one and the same agreement.
