23.372 An Order to Authorize Notice of Activity and Use Limitation re Parcel B and Parcel C on the southerly side of the Roundhouse Parking Lot
WHEREAS, the City of Northampton is the record owner of Parcel B by virtue of the deed of Elizabeth Hynes, dated November 3, 2020, and recorded in the Hampshire Registry of Deeds in
Book 13882, Page 352; and
WHEREAS, the City of Northampton is the record owner of Parcel C by virtue of the deed of Biapita, LLC , dated May 27, 2020, and recorded in the Hampshire Registry of Deeds in Book
13657, Page 132; and
WHEREAS, Parcel B is a portion of Parcel 224, and Parcel C is a portion of Parcel 223, both on Assessors’ Map 31D; and
WHEREAS, Parcels B and C are shown on a plan entitled Plan of Land in Northampton, MA, Hampshire Registry, Prepared for Tighe and Bond, Inc., dated June 15, 2017, and recorded in the
Hampshire Registry of Deeds in Plan Book 241, Page 38 (“the Plan”); and
WHEREAS, Parcels B and C are a part of a disposal site of hazardous materials as a result of its proximity to a manufactured gas plant historically operated by the Northampton Gas Works
at the property known as the Roundhouse property; and
WHEREAS, in order to comply with M.G.L. c. 21E and the regulations of the Department of Environmental Protection, the City must encumber Parcels B and C with a Notice of Activity and
Use Limitation.
Ordered, that
The Mayor is authorized to execute a Notice of Activity and Use Limitation and such other instruments as necessary as to Parcels B and C as shown on the Plan referenced above.
