23.371 An Order to Authorize Partial Termination of Notice of Activity and Use Limitation re Parcel B on the southerly side of the Roundhouse Parking Lot
WHEREAS, the City of Northampton is the record owner of Parcel B by virtue of the deed of Elizabeth Hynes, dated November 3, 2020, and recorded in the Hampshire Registry of Deeds in
Book 13882, Page 352; and
WHEREAS, Parcel B is a portion of Parcel 224 on Assessors’ Map 31D; and
WHEREAS, Parcel B is shown on a plan entitled Plan of Land in Northampton, MA, Hampshire Registry, Prepared for Tighe and Bond, Inc., dated June 15, 2017, and recorded in the Hampshire
Registry of Deeds in Plan Book 241, Page 38 (“the Plan”); and
WHEREAS, Parcel B is one of four parcels subject to a Notice of Activity and Use Limitation recorded with the Hampshire Registry of Deeds in Book 12916, Page 33 ("the AUL");
WHEREAS, the limitations on activities and uses, conditions and obligations set forth in the AUL are no longer necessary as to Parcel B as shown on the Plan in order to meet the applicable
DEP regulations, and the AUL may be terminated as to Parcel B, only.
Ordered, that
The Mayor is authorized to execute a Partial Termination of Notice of Activity and Use Limitation and such other instruments as necessary to terminate the Notice of Activity and Use
Limitation as to Parcel B as shown on the Plan referenced above.
