Upon the recommendation of the Mayor, Planning & Sustainability, and Planning Board
20.087 An Order to Approve Spending to Complete the Northview Subdivision
Whereas, The Planning Board has ordered the calling of the financial performance guarantee
(Lenders Agreement) on the Northview Subdivision at Village Hill because of the failure of the
developer/owner to complete the subdivision in accordance with the subdivision plans; and
Whereas, The Planning Board also holds the covenants on two lots as an additional
performance guarantee; and
Whereas, Northview Subdivision needs additional grading, site stabilization, drainage,
sidewalk, asphalt, and related work to complete the project; and
Whereas, The City will only fund improvements to the extent those improvements are funded
from the financial performance guarantees and the release of covenants.
Ordered that, Northampton City Council in accordance with the subdivision control law
(Massachusetts General Law Chapter 41U, Section 81U) and the Northampton subdivision
regulations, authorizes the expenditure of performance guarantee funds to meet the costs and
expenses of the city in completing the work as specified in the approved plan and to refund
remaining funds, if any.
