347 King St Conditions permit amendment 2013-03-04Kimberly Marsuik Colvest/Northampton LLC 1259 East Columbus Ave Suite 201 Springfield, MA 01105 March 4, 2013 Dear Mr. LaPointe, I have received your building permit application to build out a portion of the main building at 327 King Street for Bay State Health. I cannot issue that permit at this time. The most recent Planning Board site plan approval decision dated May 26, 2010 requires that a cross-access easement with the abutters be executed prior to issuing a building permit. It is my understanding that you are scheduled to appear at the Planning Board meeting on March 11 to ask that condition #4 of that decision be modified to require that the cross-access easement be executed prior to issuance of a certificate of occupancy rather than prior to issuance of a building permit. I issued a building permit for structural, façade, roof and mechanical systems work on the main building in September 2011. Pending the outcome of the Planning Board hearing, I am willing to amend the existing permit to include interior partitions in the north portion of the building. This is not a permit for the whole Bay State Health project. I will not issue that permit until the original or amended Planning Board site approval conditions are met. Also, unless specifically allowed by the Planning Board, I will not issue a certificate of use and occupancy, either temporary or permanent, for the Bay State Health medical offices until all conditions of the most recent site plan approval are satisfied. Please submit a letter of acknowledgment with any application to amend the existing building permit. Feel free to contact me if you have any questions.
