There is a unique hardship under the City Council Ordinance Chapter 27 adopted
October 7, 1999. This serves as a CERTIFICATE OF HARDSHIP, with the
condition that all work be done in accordance with the description provided by the
applicant and with the following conditions (if any):
PROJECT IS NOT APPROPRIATE NOR A HARDSHIP under the Ordinance.
This serves as a disapproval of Certificate of Hardship. If, within 14 days, the
Applicant does not modify their project as detailed below, this shall also serve as
a disapproval of a Certificate of Appropriateness.

If, within 14 days, the Applicant addresses the reasons for denial, modifies their
project as detailed and files these modifications with the Office of Planning and
Development for review by the Committee, the Committee shall,within a
reasonable time period, issue a Certificate of Appropriateness and a Central

City Clerk's office which will start the required twenty-one (21) day appeal period. Once
the appeal period passes, (without an appeal being filed) the applicant must pick up a
Certified copy of the Determination from the City Clerk's office and record it at the

Registry of Deeds. Permit is not valid until the Determination is recorded at the Registry
of Deeds. Please call the City Clerk's office at(413) 587-1224 prior to picking up your
certified copy.
Proof that the decision has been filed at the Registry of Deeds must be brought to the
Building Department,before a Building Permit will be-issued.

At a meeting conducted on July 24, 2003,the Northampton Zoning Board of Appeals voted 3:0 to
GRANT the request of Tristram Metcalf under the provisions of Sections 7.2 and 7.4 in the
7—Northampton Zoning Ordinance,for a Special Permit to place three ground signs on property
located at 17,25, 35 New South Street in accordance the information submitted with the
application:
1. Old School Commons Renovations and Additions to the Sullivan Building 17 New South
Street,McDonnell Building 25 New South Street, and Hawley Building 35 New South
Street. Site Plan A-1,Graphics A-6,Details A-7,dated 6/14/03.
Zoning Board Members present and voting were: Chair Bob Riddle,Vice Chair Sara Northrup,
and Associate Member Malcolm B. Smith.
In GRANTING the Special Permit to locate ground signs in the Central Business District, and
more than one ground sign on a lot,the Board found that the provisions of§7.4(4C)had been
met. Specifically the location of the Hawley building at the corner of the major intersections of
Elm Street and New South Street which have significant setbacks was unique to this
establishment,the size of the signs are modest with heights no greater than 10' and the sign is
located on the same lot as the establishment. In addition,the Board found that the two additional
signs met the standards in§7.2(13)and allowed for pedestrian visibility for patrons seeking
entrances to the various uses and establishments that are located in different sections of the
building. The Board further found that because one portion of the building is entirely residential
a ground sign indicating the multi-family component of this property was beneficial for the
public.
