To date, the building shell has been completed in terms of framing and siding. At this point in time, plumbing, electrical, and H.V.A.C. work is continuing. In the near future, the landscaping, paving, and other site work items will be completed. In terms of the cracked floor truss that has been identified, we will be repairing it with a system of plywood gusset plates on both sides of the floor truss which will not only repair the truss, but strengthen it. As per our verbal agreement, the unused area will be fire separated from the stairwell area by a means of a two (2) hour drywall fire separation as per the Massachusetts Building Code. To date, excavation for the new foL dation 'is still proceeding and is almost completed. The west side of the concrete foundation wall has been partially poured and is still under construction. We hope to have the concrete foundation completed in approximately three (3) weeks. As soon as we have completed the foundation, structural steel election would begin. We have ccillpleted several test pit-, at the site prior to beginning the foundation and have found a dense blue clay that is typical for this area of le City. Buscher, Dr. Peter Laband, and M. Sanford Weil, Jr. AS TO THE SPECIAL PERMIT UNDER SECTION 5.2, the Findings are as follows: 1. The requested use is listed in the Table of Use regulations as requiring a Special Permit in the District for which application is made. 2 . The requested use bears a positive relationship to the public convenience, in that Northampton is a growing community with an ongoing need for more housing and office space. 3 . The requested use will not create undue traffic congestion, according to evidence supplied in a traffic study which is part of the application. Pedestrian safety will not be impaired, and in fact will be enhanced by the addition of sidewalks on the site where people now walk on dirt paths. 4 . The requested use has not been shown to be likely to overload any municipal systems. 5.The requested use will not unduly impair the integrity or character of the district. There is much evidence in the record that Gothic Street is transitional between the Central Business District and the URC District. This site is bordered on its southerly boundary by the Central Business District, and is the first parcel on the street in the URC District. The architecture of the structure is in keeping with the neighborhood. It is a wooden frame building that looks residential in character. NORTHAMPTON ZONING BOARD OF APPEALS DECISION GOTHIC STREET DEVELOPMENT PARTNERSHIP APPLICATIONS PAGE TWO AS TO THE SPECIAL PERMIT UNDER SECTION 6. 3 (3) , the Findings are as follows: 1 . Applicant wishes to donate, with no financial or other consideration, an approximately 6, 000 square foot portion of the subject parcel to the City of Northampton Recreation Department for use as a public park. Applicant will construct a fountain, gravel path, and wheelchair-accessible, all-weather walk from Gothic Street to the park as shown on the site plan. Applicant will maintain and repair the fountain, maintain landscaping, provide and maintain electricity and water for the fountain, and place conduit necessary to the future connection by the city of park lights to the city street light grid. Applicant will provide supporting documents necessary to the transfer, survey, recordable plan, easements and deed. 2 . This Special Permit is subject to obtaining the approval, within nine months of the expiration of the appeal period of the Special Permit, of a Conservation Restriction/Public Right- of-way Easement by the City Council and the Secretary of the Executive Office of Environmental Affairs that will remain in effect in perpetuity for that property being transferred, or transfer the land to the City Recreation Commission. 3 . The Board voted unanimously to allow the dedication of the parcel to public use. AS TO THE VARIANCE FROM THE PROVISIONS OF §8. 10 (1) (E) , the Findings are as follows: 1. There are circumstances relating to the shape and topography of this parcel, especially affecting this parcel but not affecting generally the zoning district in which it is located. The parcel has an "hourglass" shape, which forces the location of the structure at the front of the parcel. There is a seven foot increase in elevation from the front of the parcel to the rear of the parcel . To locate the driveway at the right end of the structure, rather than the left, where it is less than fifty feet from the next driveway on Gothic Street, would disrupt and make less safe the pedestrian access to the park at 1the rear of the parcel, and would involve almost impossible i� grading techniques to make the driveway and adjacent handicapped access route possible. Literal enforcement of the Ordinance, would therefore, involve substantial financial hardship to the Applicant. ,i 2 . Granting this request will not be a substantial detriment to the public good, nor will it nu lify or substantially NORTHAMPTON ZONING BOARD OF APPEALS DECISION GOTHIC STREET DEVELOPMENT PARTNERSHIP APPLICATIONS PAGE THREE diminish the intent and purpose of the ordinance, because the intent of the ordinance is to protect the safety of the citizens, and to construct a driveway in such a fashion as to meet the requirements of the ordinance, the driveway would connect to Gothic Street at a substantial angle, which would create an unsafe situation, particularly for motorists making a right turn. In addition, the Department of Public Works, in the interest of safety, recommends that the driveway be located as shown on the plan, less than fifty feet from the next adjacent driveway. The Variance is granted. AS TO SITE PLAN REVIEW, the Findings are as follows: 1. Present and voting were Chairman Robert C. Buscher, Dr. Peter Laband, and M. Sanford Weil, Jr. Ch. Buscher opened the Public Hearing by reading portions of the Application, the Legal Notice, Section 10. 10 of the Northampton zoning ordinance, and the Section 10, Chapter 40A Variance criteria. No correspondence was read. Atty. Benjamin Barnes made the presentation on behalf of the partnership, of which he is a principal. He described a three- story wood frame building, with parking in the rear, housing four two-bedroom apartments and five professional offices, two of which are likely to be subdivided, making a total of eleven units. The size of the parcel would support twelve units. He stressed that all dimensional requirements are met, i. e. , setbacks, percent open space, etc. He directed his attention first to the Special Permit for the use. He felt that the positive relationship to the public good is that the proposed building will be a far better asset to the neighborhood than the existing overgrown vacant lot. He described Gothic Street as transitional between the CB District and the URC District, this parcel being on the boundary line. He said the structure will be "commercial in size, residential in appearance detailing. It is consistent with the streetscape. " He claimed that there will be no significant impact on traffic patterns or pedestrian safety, citing a traffic study prepared by Champagne Associates which stated there would be no changes in level of service at either end of Gothic Street. He maintained that the proposed structure would not overload any municipal facilities, and would not impair the integrity of the district. He then turned to Site Plan Review, using the new regulations, and went through the criteria from start to finish. The project will have 61 parking spaces, exactly what is required by the ordinance. Although two curb cuts now exist, only one, the one closer to Main Street, will be used. Construction of the project will fold in with the proposed reconstruction of Gothic Street this summer. Northampton Zoning Board of Appeals June 5 , 1991 Meeting Page Two Mr. Barnes then turned to the Variance request, pointing out that he disagreed with the Senior Planner and City Solicitor, both of whom felt a variance was needed. He directed attention to a diagram on Page 56 of his application packet, which showed a conforming driveway, i. e. , 50 ' from the Heritage Bank driveway, but one which the DPW would not approve because of the angle which made right turns difficult. The DPW has issued a driveway /curb cut permit for a driveway which meets Gothic Street at a 90 degree angle, but this requires a Variance. He felt that the variance criteria were met because of the shape and topography of the parcel . "The shape of our lot requires that the length of the building face Gothic Street, leaving only a limited area for a driveway. The unique topographical feature was that the rear lot line is some seven and a half feet higher than the front lot line, not typical of other lots in the area, and having the driveway located on the right side of the parcel, instead of the left, as planned, would create an irreconcilable grading problem between the driveway and the handicapped-access walkway. As to the Special Permit for dedication of a 6, 000+ SF park to public use, Mr. Barnes read a substitute paragraph for insertion on Page 44 of his Application, spelling out exactly what the Planning Board agreed to. He claimed, "Dedication of the park is consistent with the Open Space plan for the city, " and went through the §6. 3 criteria. Mr. Weil inquired, "What is the variance hardship?" Mr. Barnes responded, "The cost and technical difficulty of grading the parcel to accommodate both vehicle access and pedestrian access. " Ch. Buscher injected, "I 'm hung up on the Variance. I understand your problems and I agree it is preferable to have the driveway away from the residences, but isn't all that premised on the size of your building? If the building was smaller, you could move the driveway farther from the bank parking lot. " Mr. Barnes ' response was, "We need a project as large as is allowed to make it work financially. " Mr. Ed Jendry, a principal in the partnership and architect for the project, said, "We could flip the driveway and the pedestrian entrance, but we would then lose handicapped access to the park. The DPW says that the spirit of the ordinance does not require a 50 ' distance in this instance. " Ch. Buscher countered, "The ' 50 ' rule ' has been in the ordinance for a long time. You are creating a business use in a Residential district, and it falls into the intent of the ordinance. " Ch. Buscher called for proponents, and no one spoke. He called for opponents, and Don Grant, a direct abutter to the park section of the parcel, said, "We object to this being a city park. We want it to be a private park. People gather and drink on St. Michael ' s land now. I can see these people moving into the park. The people in the four apartments will be concerned about misuse of the park. Buscher commented, "I assume the city will light the park. If it were private, the owners would not have to light it. " Dr. Laband commented, "I think the police can handle this. " Mike Kirby said, "I support Mr. Grant. I 've talked to the abutters. I 'd rather have it privately owned, and on the street, not tucked away in back of the building. It ' s not a good site for a public park. Otherwise, the neighborhood is favorable about this development. " Mr. Weil inquired, "Why are you offering this to the city? Out of the kindness of your heart, or is there a business reason. What ' s the motivation?" Mr. Barnes replied, "The reasons are altruism, and the liability issue makes it better for us not to own it. " Barrett Zold (sp. ?) , said he lives in the neighborhood, and wanted the park kept private for the reasons already mentioned. He said, "My biggest concern is there ' s no sidewalk on the driveway. Can the park be eliminated, move the building to the right, and add a sidewalk next to the driveway?" Susan Grant, 24 Trumbull Road, commented, "I entirely disagree with whoever said this vacant lot is an eyesore. I want the large trees saved. There is a carved stone that marks the former location of the Clarke School. I 'd like that to stay. " David McCutcheon, an abutter, said, "I 'm in favor of everything, especially the proposed location of the driveway. " Coun. Kirby suggested making Allen Place one-way. Rick Klein, Landscape Architect for the project, said, "I like the project. " Gerard Rodrique, 180 Trumbull Road, said, "I like the project as presented except for the private park. " Dr. Laband moved that the Public Hearing be closed, and the matter taken under advisement. Mr. Weil seconded, and the motion passed unanimously. Atty. Barnes asked for a decision on June 19th.
