ZONING BOARD OF APPEALS 3 / a
At its meeting on November 17, 1980, the Zoning Board of Appeals for the
City of Northampton voted unanimously to grant _the petition of Edward Devarennes
for a special permit to construct a building at 100 King Street for the care
and grooming of pets.
Based upon evidence presented to the Board, the Board made the following
findings in regard to the special permit:
1. The proposed use is listed in the Table of Use Regulations.
2. The proposed use bears a positive relationship to the public
convenience, in that it would provide a service which is
needed in the area.
3. The proposed use would not create traffic congestion because
of the infrequency of cars coming to or leaving the premises.
4. The proposed use would not impair the character of the neigh-
borhood, but rather would add an attractive structure on► a
previously vacant lot.
5. The proposed use will not overload the public facilities.
The special permit is, however, granted subject to the following conditions:
1. That the building be constructed according to the submitted
plans.
2. That cats and dogs not be sold on the premises unless the
applicant re-applies to the Board for such a use.

9. Set forth reasons upon which application is based:
Granting a special permit for use of the premises for offices is
not detrimental to the existing uses in the nei•hborhood or the Highway
Business Zone. A variance is requested because it is a vacant lot
and because of its shape and small size it is i possible to build any
structure without a variance from the dimensional regulations . A variance
would not affect generally the zoning district which consists mostly et
small lots , and a literal enforcement of the provisions of the ordinance
would involve substantial hardship to the owner of the property and the
applicant. A variance can be granted without substantial detriment to
the public good and without nullifying or derogating from the intent
or purpose of the ordinance.
