5:40 PM Request for Determination of Applicability to determine if septic work within buffer zone will alter an area subject to the Northampton Wetlands Ordinance and Wetlands Protection Act. Neil Jackson, 27 Dunphy Dr, Parcel 43-084. Application Overview:
The application proposes replacement of a
failed septic system, including a new
distribution box and leach field. At its
closest, work will be within 75’ from the
bank of a stream. The location of the house
and parcel dimensions limit locating
outside the buffer zone. Leach field
material will be brought in;; the designer
has indicated that the grade should not
change substantially.

Consistency with the Wetlands Protection Act and Northampton Wetlands Ordinance,
Staff Recommendation
As proposed, the work should not impact the resource area. The limit of work is currently a
maintained lawn. Boundary confirmation is not requested, but staff concur with the bank flags
as shown on plans. Issue a negative determination by checking box 3, to indicate that work is
within buffer but will not
constitute an alteration.
Include standard conditions,
require erosion control as
shown on the plan, and
reseeding as necessary.

The referenced Order was for
construction of the Ridgeview
subdivision. The applicant
would like to obtain a
certificate in order to begin
construction on ‘lot 7,’ which
was not built out as part of the initial work, but does not
have documentation of the
locations of other house lots.
Since ‘lot 7’ was not built
according to the prior order,
issuing an invalid certificate
of compliance to indicate this
can be issued; this will leave
the full Order in place for
other lots. An RDA or NOI
will be necessary if work is
within resource areas.
Looking upgradient to
work area from
stream. Vegetation
will not be removed.
