ZONING BOARD OF APPEALS
At a meeting held on December 12, 1984, the Zoning Board of Appeals of
I. the City of Northampton, in a split decision, voted to deny the special permit
request of William and Marilyn Pichette, 300 Elm Street, Northampton to
construct a two-family dwelling on the northerly side of Warn r Street=
mi
Northampton. Present and voting were: Chairman Robert Buscher, William
Brandt and Peter Laband.
The findings were as follows:
I! R. Buscher, referring to Section 10. 10, found the use is listed in
1, the Table of Use Regulations, as a two family dwelling is allowed in
`; a URB zone with a special permit; that the use bears a positive relation-
Ij ship to the public convenience by providing additional housing in
I. Northampton; that the proposed use would not create any undue traffic
congestion or pedestrian safety, although Warner Street is narrow,
a two family dwelling would not place a traffic burden on the area and
there is more than ample parking; that the request use would not overload
municipal systems. He stated that the area is predominantly one of
smaller, single family homes with few two families, and found the
construction of a two family dwelling would have an effect on the
neighborhood and because the intent of the Ordinance is to maintain
residential districts in the highest possible state, he voted to deny
the petition.
W. Brandt found the use listed in the Table of Use Regulations; that
the proposed use would bear a positive relationship to the public con-
venience in that it would provide additional housing in the central part
of the City; that the construction of a two family dweling would not
create traffic congestion or impair pedestrian safety; that it would
,; not overload municipal systems; that Article XI does not apply; and that
the requested use would not impair the integrity of the district, as
there are some two family homes in the area. He found in favor of the
,I special permit.
P. Laband found that whereas there are many one family homes in the
area, the size of the proposed two family would be the same if built as
a single family; that there are enough two family homes in the neighbor-
hood that an additional two family dwelling would not impair the integrity
of the district; and that it would be the proper and wiser use of the land
to build a two family home. He also found in favor of the special permit.
