ISSUANCE OF A FILE NUMBER INDICATES ONLY COMPLETENESS OF SUBMITTAL, NOT APPROVAL OF
APPLICATION
Although a file # is being issued, please note the following:
[1] The Commission should confirm parcel ID and street numbering listed on the WPA Form 3 as it is different than
what MassGIS data shows. The Commission should also confirm the lat/long.
[2] The Commission needs to wait to close the public hearing until NHESP has issued its determination.
[3] The WPA Form 3 indicates that the proposed project will take place on one parcel; however, the USGS
topographic map indicates that the project will take place on three parcels. Please clarify and ensure that all property
owners have signed the WPA Form 3.
[4] Timber mats in the Mill River should be secured to prevent movement downstream during a flood event.
[5] There is no Buffer Zone to Isolated Vegetated Wetlands under the Wetlands Protection Act.
[6] The Applicant did not determine if Isolated Land Subject to Flooding is present in the location of the Isolated
Vegetated Wetland.
[7] The Mill River is considered a Cold Water Fishery Resource. Preventing sediment from entering the water and
maintaining and/or increasing shading of the water column is important to protecting this valuable resource.
[8] Notice of Intent (NOI) numbers (246-0546, 246-0593, and 246-0734) have been issued for the same project locus.
The Conservation Commission should be mindful of the Multiple Notice of Intent Filings for the Same or Similar
Projects on the Same Property (DWW Policy 88-3) (aka the “dual notices policy”). Please see the following link for
additional details: https://www.mass.gov/guides/wetlands-program-policy-88-3-multiple-filings. If the work areas of the
current project and the referenced prior OOCs do not overlap, the Commission may not have concerns having dual
notices. Should the projects overlap, the Commission may wish to consider issuing COCs for the original OOCs and

subsequently issuing a OOC for the proposed project.
[9] A Chapter 91 license may be required. Application and transmittal forms are available on the MassDEP website

[10] The Limited Project Provisions require the Applicant to the extent possible to meet the performance standards for
each Resource Area. The Applicant should address the performance standards for each wetland resource area
impacted and indicate which performance standards the project cannot meet. The Applicant should indicate which
Performance Standards they are requesting Limited Project Status for and how they have attempted to meet those
Standards.
[11] The Applicant should provide information regarding the justification for extending the existing retaining wall and
soft-armoring alternatives considered for Bank stabilization. In addition, the Applicant should provide information
regarding the justification for additional retaining walls in the Riverfront Area.
[12] The Applicant has indicated their intention to submit revised plans. The Department reserves the right to review
these plans and submit additional comments.
