2022.01.13 Staff Report.pdf January 13 2022 Staff Report To: Conservation Commission From: Sarah LaValley RE: Staff Report, January 13 2022 Commission Meeting Requests for Certificate of Compliance: 348 Westhampton Road, DEP File 246-621 The Commission issued an Order of Conditions for construction of a common driveway and house in 2008. All work within resource areas was proposed to occur on what is now a separate lot from the lot subject to the request. The driveway was not constructed, but a barn and other work exists on the adjacent parcel. Staff recommends issuing a partial certificate of compliance releasing only map ID 36-199 from the Order. Kennedy Road, DEP File 246-547 The C0mmission issued an Order in 2005 for construction of a house, and no work was done. Staff recommends issuing an ‘invalid’ certificate of compliance indicating such. 2-18 Randolph Place, DEP File 246-068 This 1981 Order permitted filling a section of riverfront area. The area was indeed filled. This would not have been allowed under the Rivers Protection Act, but this did not exist at the time of the Order. The filling but seems to have been done as shown on the plan. Staff recommends issuing a complete certificate of compliance. Recommendation to Planning Board – Reduction of Frontage Requirement, 1397 Ryan Road The City, through the Conservation Commission, is acquiring approximately 13 acres from the owner of 1397 Ryan Road, and an additional 3.2 acres will be retained with the house. The land we are purchasing abuts the existing Saw Mill Hills Greenway to both the west and the north, and the purchase has already been approved by the Commission. In addition to that connection, we would like to obtain a sliver of their property on Ryan Road to provide an additional means of access and a neighborhood trail connection. That sliver, however, would take away some of the frontage that Matusko is required to have. As a result, we are crafting this as a purchase by the City of most of the property, and a donation of that narrow sliver on Ryan Road. A Special Permit from the Planning Board is being sought that would allow Matusko to get "zoning credit" for the frontage they are donating to us, allowing them to stay in conformance with zoning. The process for that Special Permit is that the Conservation Commission makes a recommendation to the Planning Board. We obviously hope for a positive recommendation to make our acquisition possible and provide that second means of access to the property.
