DESCRIBE AGRICULTURAL RESOURCES (Soils, fields, landscape features):
The six acres oflevel fields along Sylvester Road are underlain by Walpole and Gloucester fine sandy loams; see Soil
Map, page 8.
The remainder of the APR is gently to steeply sloping Paxton, Woodbridge, Charlton and Gloucester very stony fine
sandy loam and Charlton-Rock outcrop-Hollis complex. The southeast section of the APR is covered by wooded
marsh; see DEP Wetland Map, page 8a.
DESCRIBE AGRICULTURAL ACTIVITIES (Type of production, retail, approx. volume):
The five acre front field to north of driveway produces ~12-15 tons of silage com per acre. The one acre south field
produces a small amount of hay.
DESCRIBE ENTRY/ ACCESS POINTS (Roads, parking lots, former logging roads, trails):
Access to the field is along Sylvester Road (waypoint #32).
Access to the trail system is through a parking area at the southeast comer of the APR (waypoint # 1 ). There is a trail
which enters tl1e APR near its northwest comer (waypoint # 19).

INSPECTOR'S COMMENTS:
This APR was previously land of Armand and Rosel LaPalrne and sold to the City of Northampton at a greatly
reduced price. It is part of a larger Mineral Hills Conservation Area which extends to the Westhampton town line.
Signs in the parking area at the southeast comer identify this as the Northampton Conservation Commission Mineral
Hills Conservation Area and a gift from Armand and Rosel LaPalrne (waypoint #1, photos #2 and #4). Further

Sarah La Valley is the contact at the Northampton Conservation Commission.
There is a level open field along the road which is worked by a local dairy farm to produce silage com. The land
slopes upwards to the west and is part of the Mineral Hills trail network; the trails are marked with blue blazes. The
southeast area is wet and there are multiple small bridges and walkway along the trails.
I met the abutter encroaching near the southwest comer (waypoint # 11, photo # 18) when he came out to ask if I
needed directions. I told him I was writing a report on the Conservation Area land and asked him ifthe yellow
blazed line was the property line, which he affirmed. The exchange was pleasant; no mention was made of the rutted
area.
The trails observed were free of trash.

Premises that are either south, south and east, and/or west of
Parcels 1, 2, and 3, as referenced in Appendix A.
J. The installation, maintenance, repair, replacement,
removal and relocation of underground electric, gas, cable, or
other communication utility facilities and services fer the
Premises for the purpose of providing utility services to the
Premises, for agricultural uses or other approved uses, and to
the three lots shown on the referenced survey, and the right
to grant easements over the Premises for these utility
purposes.
4. The installation, maintenance, repair, replacement, and
removal of a maximwn four car parking lot in the south-
easterly corner of the property, provided such lot does not
extend more than forty feet from Sylvester Road and does not
encroach on any cultivated agricultural field.
5. The dredging of existing farm drainage and streams and
the expansion of wetland areas by dredging surrounding
wetlands and uplands, provided any expansion of wetland areas
does not encroach on any cultivated agricultural field.
E. PROHIBITED USES
Except for rights specifically retained in paragraph D of this
docwnent, the Granters covenant for themselves, their heirs,
devisees, legal representatives, successors and assigns, that the
Premises will at all times be held, used and conveyed subject to,
and not in violation of, the following restrictions:
1. No use shall be made of the Premises, and no activity
thereon shall be permitted, which is or may be inconsistent
with the intent of this grant, as stated in the statement of
Purpose.
2. No temporary or permanent structure, building,
residential dwelling, tennis court, in-ground swilllll\ing pool,
recreational horse riding facility, golf course, golf range,
airport landing strip, asphalt driveway, road, parking lot,
utility pole, tower, conduit or line shall be constructed,
placed or permitted to remain on the Premises, except
structures existing on the Premises at the time of the
execution of this Restriction.
J. No refuse, trash, vehicle bodies or parts,
debris, junk, waste, radioactive or hazardous waste
substance or material whatsoever shall be placed,
dumped or permitted to remain on the Premises.
4. The Premises may not be used for:

a. Transferring development rights to any property
adjacent to the Premises;
b. Calculating permissible lot yield of the Premises,
or of any adjacent property;
c. Use in any calculations involving development of any
adjacent property in any manner whatsoever.
5. No excavation, dredging, depositing or removal from the
Premises of loam, peat, gravel, soil, sand, rock or other
mineral resources or natural deposits shall be permitted.
6. No subdivision, recording of a subdivision plan,
partition, or any other division of the Premises, or any
portion thereof, into two or more parcels shall be permitted.
7. The use of any and all motorized vehicles, including but
not limited to snow mobiles and dirt bikes and the like, is
prohibited for other than for agricultural purposes, trail
construction, property maintenance, and emergencies.
ENFORCEMENT OF THE TERMS AND CONDITIONS
l. The Grantee reserves the right to make periodic visits to
the Premises to verify that the Premises are being held, used
and conveyed subject to, and not in violation of, this
Restriction.
2. In the event of a violation of the terms of this
Restriction, the Grantee reserves the right to pursue any
remedy available at law and equity, including injunctive
relief.
AFFIRMATIVE COVENANT
The Granters agree for themselves, their heirs, devisees,
legal representatives, successors and assigns, that the
cultivated fields in the Premises shall remain in active
agricultural use, and the land shall not be abandoned, except:
1. in accordance with a U.S. Department of Agriculture Soil
Conservation Service Plan, approved by the conservation
district for the locality in which the Premises is located; or
2. if, after advertising for a farmer to use the property
for active agriculture, in accordance with any statutes and
regulations that apply to the Granters and in accordance with
a U.S. Department of Agriculture Soil Conservation Service
Plan, no acceptable bids are received; provided, however, that
if no acceptable bids are received the property shall be
offered for bid every year until the property is back in

active agriculture.
H. AUTHORIZATION
The foregoing Restriction is authorized by Massachusetts
General Laws, Chapter 184, Sections 31 through 33, and Chapter
132A, Section 3 and Sections 11A through 110, and otherwise by law,
and is intended to ensure the protection and preservation of
agricultural lands.
This Agricultural Preservation Restriction shall be
administered on behalf of the Grantee by the Commissioner. This
Restriction shall be enforced by the Grantee as they in their sole
discretion may decide. Nothing herein shall impose upon the
Grantee any duty to maintain or require that the Premises be
maintained in any particular state or condition, notwithstanding
the Grantee's acceptance hereof.
This Agricultural Preservation Restriction hereby conveyed
does not grant to the Grantee, to the public, or to any other
person the right to enter upon the Premises, except that the
Granters hereby grant to the Grantee and his successors at law, the
right to enter the Premises in a reasonable manner and at
reasonable times, for the purpose of inspecting the Premises to
deternine compliance herewith, of enforcing this Agricultural
Preservation Restriction, or of taking any and all actions with
respect to the Premises as provided in Section F, above, as may be
necessary or appropriate, with or without order of court, to remedy
or abate any violation hereof. The rights hereby granted shall be
in addition to, and not in limitation of, any other rights and
remedies available to the Grantee for enforcement of this
Restriction.
This Agricultural Preservation Restriction is in gross and is
not for the benefit of or appurtenant to any particular land and
shall be assignable to any oth~r governmental or any non-
governmental non-profit organization whose purposes include
conservation of natural areas. The burden of this Agricultural
Preservation Restriction hereby imposed :.hall run with the Premises
and shall be binding upon all future owners of any interest
therein. This Restriction may only be released in whole or in
part, by the Grantee by the procedures established by Section 32 of
Chapter 184 of the General Laws, as amended and otherwise by
Article 97 of the Amended Articles of the Massachusetts
Constitution and otherwise by law.
If any section or provision of the Restriction shall be held
to be unenforceable by any court of competent jurisdiction, this
Restriction shall be construed as though such section had not been
included in it. If any section or provision of the Restriction
shall be subject to two constructions, one of which would render
such section er provision invalid, then such section or provision

shall be given the construction that would render it valid. If any
section or provision of this Restriction is ambiquous, it shall be
interpreted in accordance with the policy and provisions expressed
in the General Laws, Chapter 184, Sections 31 through 33, and
Chapter 1J2A, Section J and Sections llA through 110, and the
regulations duly pronulgated in accordance with said Chapters.
This instrum.ent is not a deed. It does not purport to
transfer a fee interest to the Grantee. No Massachusetts deed
excise stamps are affixed hereto as none are required by General
Laws 640, section 1, as a.ended.

Northampton, Hampshire county, Massachusetts containing ninety one
(9l) acres, more or less, more particularly described as follows:
Being a portion of the Land described in a Deed recorded at
Book 1134, Page 353 in the Hampshire County Registry of Deeds,
including Parcels A and B shown on a plan entitled "PLAN OF LAND IN
NORTHAMPTON, MASSACHUSETTS PREPARED FOR DOUGLAS A. KOHL, AUGUST 11 ,

BASELINE PREPARER AND PHOTOGRAPHER AFFIDAVIT
The undersigned hereby certifies that acting in my capacity as contractor of the Massachusetts
Department of Agricultural Resources on 4/9/2013 I visited the Northampton Conservation
Commission Agricultural Preservation Restriction Property (the "Property") located in the Town
of Northampton, Massachusetts, Agency ID# 122794214NOR and that:
1. I took documentary ground photographs ("the Photographs"), with file numbers IMG _1828
through IMG_1857 and IMG_1880 through IMG_1885, and that the Photographs, attached
hereto, together with accompanying descriptions, List of Waypoints and Documentary
Photographs, and Photo Location and Waypoint Maps, fairly and accurately depict the property
as it appeared on the date the photographs were taken.
2. I prepared the accompanying Baseline Documentation Report (the"Report") dated 4/9/2013
describing the Property.
3. This Report describes and documents the agricultural and other resources of the Property
protected under an Agricultural Preservation Restriction recorded in the Hampshire County
Registry of Deeds in Book 4607 at Page 172 on 12/27/1994.
4. Based on all the information cited in said Report and to the best of my knowledge and belief,
the Report is an accurate representation of the Property and its condition as of the date of the
Report.
Notwithstanding the above, the undersigned agrees that the conditions documented in the Report
do not necessarily constitute the entirety of conditions of the Property allowed or required by the
Agricultural Preservation Restriction and that the Massachusetts Department of Agricultural
Resources in no way waives any rights, in law or equity, to enforce any provisions of the
Agricultural Preservation Restriction, whether or not directly addressed in this Report.

4. The Grantors and their successors-in-interest hereby retain a
utility easement i'or existing power, tel.epbone, and cable
lines feeding their existing hOl!le and for future underground
util.ities under those existing lines.
5. The Grantors and their successors-in-interest hereby retain an
easement to allow them the right of access across the Land to
allow access to their septic tank for the purposes of repair,
replacement and maintenance of the same.
6. The Granters and their successors-in-interest and assigns
hereby retain a freel.y assignable permanent farm use easement
to grow and cut hay from the hay field if the Grantee allows
the field to lay fallow for at least four years, provided all
agricultural practices are done in accordance w~th a
conservation Plan from the U.S.D.A. Soil conservation Service.
The Grantors, their successors and assigns may continue to
exercise said farJDing rights until in any given year they are
notified by the Grantee by February 1 of said year that the
Grantee or its successors or assigns will farm the land and
the Grantee or its assigns do in fact i'arm the land during
said year. Upon said notification the Granters' farming
rights shall be suspended but no event shall it be terminated
or revoked.
7. The Grantors personally reserve the non-transferrable right to
name the conservation area within one year of closing, subject
to approval of the name by the Northampton Conservation
Co1ll1tl.ission. Said approval shall not be unreasonably withheld.
8. The Granters and their successors-in-interest hereby retain
the right to use existing trails southwesterly, westerly and
north westerly of above referenced Parcels 1, 2 and 3 on the
Premises property for walking and riding horses, provided that
horses are used in a reasonabl.e manner to avoid undue trail
erosion and that horses are not allowed unattended on the
Grantee's property.
9. A Reciprocal Drainage Maintenance Easement is hereby granted
to the Grantee and is retained by the Granters and/or their
successors-in-interest in Parcels 1 and 2 (described above),
as shown on a plan entitled •pJ.AN OF LAND IN NORTHAMPTON,

WHEREAS, the Conservation Comlnission has identified a eighty acre,
more or less, parcel of land off Sylvester Road as being
critical to preserve scenic vistas, the character of the
area and farmland and being important to provide hiking
opportunities and linkages to the Mineral Hills; and
WHEREAS, the Conservation commission has specifically listed this
parcel as a tap acquisition priority in their recently
approved open Space and Recreation P1an, 1994-1999; and
WHEREAS, the current owners of the parcel are willing to bargain
sell the property to the City at approximately 10% of
fair ~arket price; and
WHEREAS, the 0>1ncr wants to reserve limited temporary timber and
agricultural rights and permanent utility ·and farm
easements and wants to insure that an agricultural
preservation restriction is placed on the property;
NOW, THEREFORE BE IT RESOLVED,
The city Council hereby authorizes the conservation
Commission to accept an Option and a Deed for said
property from Armand R. Lapalme and Rosel A. Lapalme, or
their successors in interest, in consideration of the
payment of $30,000, with the easements and descriptions

My company has been contracted by the Massachusetts Department of Agricultural Resources to
prepare baseline documentation reports for farm properties that are protected by an Agricultural
Preservation Restriction (APR). This is usually done soon after the APR is put in place, and
documents the current conditions for future reference. The Department uses this opportunity to
maintain open channels of communication with the landowner and farmer and to detect trends in the
State's farming enterprises.
Records indicate that 89 acres of town land in Northampton are subject to an APR, recorded on
12/27/1994 in the Hampshire Registry of Deeds, book 4607, page 172. The next step is for me to
complete a report which shows the current condition of the property. Both you and the Department
will get a copy of this report. To create the report, I will be walking the property and documenting the
farm activities, structures and current condition of the land.
I will be calling you soon to discuss a date to visit the property. I will need to conduct a short interview
with you prior to walking the land. This is usually done at the time of the site visit or, if that is
inconvenient, it can be done over the phone when your schedule allows. It will not be necessary for
you to join me on the inspection but you are certainly welcome and encouraged to do so.
